Layout of the property, buildings, trees, and slopes limits possible position to area between house and shed. 2. Adherence to 40 foot side border rule would position the pool in almost exact center of back yard. This creates the following concerns: • Poor drainage for yard. We have experienced water in the basement on many occasions due to the poor grade. The water pools by the back basement door when it cannot flow down the backyard. Last year we had some trees removed and the yard re-graded in an attempt to alleviate this problem; a pool at this position would aggravate the situation. • This position would also place the pool in an awkward position that is either too close to the deck stairs or to the fireplace/patio in back. This would diminish the functionality of both. 3. The street on the south side of the property(Woodland St.)is not paved. It is an area of grass that the town does not maintain. We believe that this variance is unlikely to become an issue for this"road" for the following reason: the property to which the road gives access is a sloped, wooded area on the Vernon border which overlooks a trailer park. This is not prime real estate for development, and may never require the finishing of the road. 4. The neighbors surrounding us on all sides do not object to this variance(see attached petition). 5. We intend to install a fence for privacy reasons, which would eliminate the pool's visibility, and any aesthetic issues. -n SCHEDULE A That certain piece or parcel of land, with the buildings and improvements thereon, situated in the Town of South Windsor, County of Hartford and State of Connecticut, known as 112 Oak Street, and also known as Lot No. 22 on a map entitled "Map of Woodland Acres Avery Street South Windsor, Conn. I ti We, the undersigned, understand that the Gentile family, at 112 Oak Street, in South Windsor, CT, are proposing to install an above ground swimming pool in their backyard, and that they would like to be given a zoning variance which will require the pool to be only six feet from their side border on the south, rather than the usual 40 feet required for corner lots. We have reviewed the attached plan and do not object to the position in which the Gentiles propose to place their pool, nor do we object to this variance being granted. Dear Mr. & Mrs. Gentile: At the meeting of the South Windsor Zoning Board of Appeals held on March 5, 1998, the Board approved your request for a 34'variance to Section 10.2 to allow a pool 6' from the property line at 112 Oak Street, A-20 Zone. The Board concluded the hardship to be the slope of the land; water drainage problem, shed and trees on the property which prevents the applicant from putting the pool in accordance with the zoning regulations. Any new building, or alteration/additions to existing buildings, require a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense. Very truly yours, ey r.
