Re: March ZBA Applications
Appl. #2392-98 — Mr. Peter Churilo. P.O. Box 98, request for a State Hearing under
Section 14-55 and 3.13 of the Zoning Regulations to allow a used car dealership for six
(6)vehicles maximum,at 73 John Fitch Boulevard,GC zone.
New and used salesrooms for passenger vehicles are a permitted use in the General
Commercial Zone subject Section 3.13 of the Zoning Regulations. Section 3.13 lists the
criteria and considerations for the ZBA to use in their review of this type of application.
The applicant has provided a map showing possible locations for the six vehicles. In addition,
he is requesting approval for an area for two vehicles inside the building as required by the
Department of Motor Vehicles.
The applicant is aware that this use (if approved by the ZBA) will require approval from the
PZC(per Section 5.2.3 of the Zoning Regulations.)
At the Board's direction, we have requested the Town Attorney to advise the ZBA of their
ability to place conditions on motor vehicle license requests. The Town Attorney opinion
should be prepared for the March 5, 1998 meeting.
Appl. #2394-98—Robert& Barbara Gentile—request for a 34' variance to Section 10.2
to allow a pool 6' from the property line(40' required)at 112 Oak Street,A-20 zone.
Variance request for an above ground pool proposed to be located closer to the property line
than allowed. The property has two front yard setbacks because it is a corner lot.

Appl. #2394-98 —Paul & Kathleen Bienkowski, request for a variance to Section 3.10.3
to allow a second floor expansion on a non-conforming structure; and a 14' variance to
Section 10.2 to allow an addition to be 36' from the property line (50' required) on
property located at 2422 Ellington Road,A-30 zone.
This is an existing non-conforming house to current A-30 zone front yard setbacks (note the
house has two front yard setbacks as it has frontage on two roads). The variance request to
Section 3.10.3 is to allow for the upward expansion of the existing structure; and the second
variance request is for the addition which is proposedd to be 36' feet off the property line.
The applicant has received two variances for this property in the past. In 1987, a variance to
Sec. 3.10.3 was granted for the second floor expansion on a non-conforming structure, and in
1994 an 18'variance was granted to Sec. 10.2 to locate the pool closer to the property line.
TABLED Application 2390-98—Arthur B. Scheer,ABS Auction Group, Inc., a State hearing
under Section 10-55 and 3.1.3 of the Zoning Regulations to allow a used car dealers license
for this use,on property located at 24 Jeffrey Drive,I zone.
At the ZBA's direction, the applicant has submittedd an application to the Planning and Zoning
Commission for a two year Temporary and Conditional permit to allow automobile auctions.
It is scheduled for a public hearing on March 10, 1998. The Planning and Zoning
Commission will act after that time.
The ZBA application pending with you has a statutory deadline for action of 65 days. Action
must be taken by your Board by April 11, 1998 to meet this requirement.
