(Signature) ACTION OF THE BOARD Granted: Denied: t , t Town of South Windsor Request for Variance/333 Troy Road(Barton Property) This variance request would allow a residence without a garage at 333 Troy Road(Parcel 3) and is contingent upon granting of the variance request for 313 Troy Road. If the previous variance is granted, then the property at 333 Troy Road will not have a garage (see Map B). If the previous variance is not granted, this variance is not necessary. As discussed in the variance application for 313 Troy Road, the property boundaries for these two lots are at an oblique angle to Troy Road, and 333 Troy Road is nonconforming to the lot frontage requirements in the RR zone(120.33 feet existing, 175 feet required) (see Map A). Although these two residences have existed with their oblique property boundaries for quite some time, they have done so within the confines of related families., the realignment of the lot lines would have several benefits: ♦ The lot lines would be more nearly perpendicular to Troy Road, thus creating"typical" lots ♦ The nonconforming frontage at 333 Troy Road would become conforming ♦ The garage that appears to belong with 313 Troy Road would now be part of that property, and the front yard that appears to belong with 333 Troy Road would belong with it. There is a hardship in that the garage that is currently on this property is an existing, awkwardly- located garage that is only conducive to a"family"ownership arrangement, whereby two related families purchase the two residences. The garage properly belongs with 313 Troy Road. . (It should be noted that there is available space on this new lot for a future property owner to construct a garage if so desired.) If this variance is not granted, then the Town will either have to construct a new garage at 333 Troy Road or reconfigure the lot lines as shown on Map C, resulting in awkward, impractical lots r , 1 Barton Property Legal Description Parcel 1 Beginning at a point, said point being the southwest corner of said Parcel 1, said point also being the remains of a brown stone; thence S 67° 58' 32" E , along property now or formerly of Terry A. & Sandra H. Dear Matt: At the meeting of the South Windsor Zoning Board of Appeals held on September 4, 1997, the Board approved your request for a variance to Section 11.2 to allow a single family residence without a garage, at 333 Troy Road, RR Zone. Approval is subject to the Planning and Zoning Commission approving the new site plan as shown on the Map B which was submitted with the application drawn up by Designs Professionals. The Board concluded the hardship on the property to be as follows: There is difficulty realigning the boundary lines because of an existing septic system. Having the property without a garage would be the only viable solution. Any new building, or alterations/additions to existing building, require a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense. Very truly yours, 4 k6 CcX-L-L4,(-(- Jos' ph J.
