I'!,EMMEMEMEMIM Dated this 2.3 day of ✓ 5 Year / 7 APPLICANT: (Signature) OWNER: rl (Signature) ACTION OF THE BOARD Granted: Denied: This subdivision dates back to 1988. At that time, a Rev. Ralph Sanders owned the property. We bought the subdivision in 1995. Some of the original maps showed a 14th lot in South Windsor. We asked at the time of purchase and were informed that the 14th lot was dropped from the plan mainly because of the school bus situation. We understood that South Windsor did not want to send a bus down the street for one child or one house on the street. The last two (or three) lots in the subdivision all have property in both East Windsor and South Windsor. In June we went to the Planning&Zoning commissions to get permission to extend the garage on Lot# 13 into South Windsor. This permit was granted. At the hearing, one of the members suggested that the recent Sheff vs. O'Neil ruling might cast a new light on our plan and that we might want to investigate getting Lot#14 back into the plan. The Sheff vs. O'Neil ruling states that if a person owns a piece of property that straddles two towns, the owners have a choice of which school system their children will attend. That would mean all lot owners at the end of Oakwood Dr. would have a choice of school systems. f 7s Lot# 14 lacks the necessary frontage on the cul de sac. There is presently 99 ft. -4-51 ft is required. Our hardship is that we have developed the subdivision up to Lots#7 & 12. Had we known this ruling would change things as it has, we could have designed the subdivision to conform to all the requirements. The only thing we do not have is proper frontage. There is sufficient acreage. The side and rear setbacks both conform. East Windsor has no problem with the sewer hook-ups and CT Water Co.will gladly provide hookups as well. Water St. Phone (860)623-1162 Fax(860)623-0284 i TO: Dave Griffin, Griffin Realty FROM: Kevin Leslie, W.P.C.A. Superintendent DATE: July 22, 1997 RE: Request for an additional lot in Oakwood Estates The Water Pollution Control Authority discussed your request to add an addition building lot to the Oakwood Estates subdivision. It is my understanding from my conversation with Ken Ouellette that this lot is 90 % in South Windsor and 10 % in East Windsor and that you would like to connect the house built on this lot to the East Windsor Sanitary sewer system. It was the opinion of the WPCA attorney that this would be.acceptable under the following conditions: 1. The building lot has frontage in East Windsor, negating the need for an intertown agreement with South Windsor.. 2. You apply to the WPCA office for a connection permit, and follow all of the usual application, construction and inspection requirements. 3. Pay a Facility Connection Charge of$4994.00. Please let me know if I can be of further assistance. cc: Jose' Giner NORTHERN REGION: 25 NORTH ROAUTHECONNECTICUT WATER COMPANY W EAST WINDSOR, CONNECTICUT 06088-0857 A SUBSIDIARY OF CONNECTICUT WATER SERVICE,INC.
