Unit 101
Wheeler Estates Senior Residence Development
November 15,2001
Variance Request: 3.3 feet variance to Section 4.1.12g to allow a deck closer to the side property
line than otherwise allowed.
Hardships or particular factors that support this application are:
1). This is a senior residence development, and all decks have been designed to
be flush with the first floor to make a seamless transition from house to deck. This will
readily allow for wheelchair accessibility, which is necessary to meet the needs of those
seniors with physical disabilities.
2). All units are handicap adaptable.
3). This unit is designed to add in a lift device (shaft is in place) and ramp, if
requested, to accommodate wheelchairs.
4). The deck would be too small and irregular to readily accommodate a
wheelchair if it were built fully observing the side yard setback.
5). The deck would be generally unusable and too small if it were built
observing the yard setback.
6). An alternate concrete patio was investigated, which need not observe the
yard setback, however, that would require four stairs, which would present a hardship to a
resident or guest with physical disabilities.
7). We regret that this problem was not uncovered during the design process,
and we seek your assistance in remedying this situation.
8). The side yard setback for the abutting residence on the adjoining new lot is
only ten feet. Our setback will still be more than twice that amount.
9). The carpenter who built the deck thought the setback was twenty feet, and
thought he had 1%2 feet to spare.
Thank you.

Re: Appl. #2518-01 —KF Properties, LLC, Unit 101,Wheeler Estates SRD, Wheeler Road, A-20
zone.
To Whom It May Concern:
At the meeting of the South Windsor Zoning Board of Appeals held on December 6, 2001, the Board
approved your request for a variance to section 4.1.12g to allow a deck 21.7' from the property line, at
Unit 101, Wheeler Estates SRD, Wheeler Road, A-20 zone.
The Board concluded the hardship on the property to be that the deck will enable a handicapped individual
to exit safely to the rear of the premises to enjoy sitting outdoors on the deck, and also move safely around
the deck.
These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own
expense.
Very truly yours,
Con"] xcit n . n"hr

Zoning Board of Appeals
