Application #1872-89 : Richard Szeluga, c/o Attorney Bruce Fader, 45
Hartford Turnpike, Vernon, CT. 06066, a variance to section 5 . 2 of
the zoning regulations to allow the creation of two lots with less
than the required frontage; Lot #1 would have 104 ft, Lot #2 would
have 100 ft. and less than required lot area: Lot #1 would have
25,480 sq. ft. and Lot #2 would have 24,500 sq. ft. on property
located on the west side of Newmarker Road, A-30 zone.
The Commission felt that the hardship with this appeal is that the
surrounding lots are already small due to open space zoning. This
approval is subject to Planning & Zoning approval. The wooden barn
is to be removed and disposed of properly and sidewalks are to be
installed on both lots .
Murrin said that the house is too large for the size of the lot that
the applicant is requesting. Murrin feels that open space
developments have to be planned carefully and this appeal goes
against that kind of planning.
Anthony made the motion to approve with conditions Application #1872-
89 . Murray seconded the motion. The motion carried and the vote was
4-1 with Anthony, Murray, Eriksson, and Warren voting for the motion.
Murrin voted against the motion.
Application #1835-89 : Plum Ridge Condominium Association a variance
to section 4 . 6 . 2 .F. 2 (b) and 5 . 2 of the zoning regulations to allow
28 of the decks widened which will encroach 4' on building line
and/or 50 , separating distance on property located on the southerly
side of Sand Hill Road, MF-AA zone.
The Commission felt that the hardship stems from the fact that 32 of
the decks at Plum Ridge was already granted a variance to enlarge
their decks . The existing decks are too small to be utilized
efficiently.
Murrin made the motion to approve Application #1835-89: The motion
was seconded by Warren. The motion carried and the vote was
unanimous .
Application #1881-89 : Harold R. Cummings & Robert M. Finch, request
a variance to section 4 . 1 . 2 to allow professional offices ; Section
5 . 2 to allow a 20, buffer on property located at 819 Clark Street, RR
zone.
The Commission came to the conclusion that development of this area
should be taken care of by Planning & Zoning. The area consists of
Ellington Road, Oakland Road, Sullivan Avenue and Clark Street.
There will be a transition someday but the Commission felt that they

Samsel Shopping Center. The Commissioners decided to table this
application until further questions are answered and the
Commissioners will delve into the what and where the dry cleaners are
allowed.
Application #1465-89: Franklin Distributors, 140 Nutmeg Road, South
Windsor, request a variance to section 5.2 to allow 68% impervious
coverage (55% allowed) on property located at 140 Nutmeg Road, IP
zone.
The hardship with this appeal is the change in impervious coverage
requirements since the applicant purchased the property. Also the
placement of the original building.
Gallicchio made the motion to approve Application #1465-89 . Murray
seconded the motion. The motion carried and the vote was unanimous.
Application #1864-89: Plum Ridge Condominium Association, 504
Sandstone Drive, South Windsor, request a variance to section
4 . 6 .4 .2.F. 2 (b) and 5 .2 of the zoning regulations to allow the decks
widened which will encroach 4' on building lines and/or 50,
separating distance with the option to enclose these decks by
greenhouses and/or screens, MF-AA
Murrin said his definition of a patio, deck or porch is if it is
right on grade, its a patio (permits are not required for patios) .
If it is above grade it is a deck, if it has a roof over it, its a
porch. A porch can still have screens, jalousies, or permanent
windows to enclose it as long as the exterior wall and prime door
remain between the living space and the porch. If the wall or prime
door is removed, then it is considered an enlargement of a room.
Warren made the motion to approve with conditions Application #1464-
89 . The motion was seconded by Earley. The motion carried and the
vote was unanimous .
The variance is to read to extend the decks only 4' and that the
existing wall and prime door are to remain in place.
Application #1944-89: Michael H. Hadley, 926 Ellington Road, South
Windsor, a request for a variance to section 4 . 3 . 1 of the zoning
regulations to allow office and/or retail on property located at 926
Ellington Road, A-20 zone.
Earley made the motion deny Application #1944-89 . The motion was
seconded by Warren. The motion carried and the vote was unanimous.
It was the concensus of the Commissioners that no hardship was
demonstrated for this appeal.
