The current production facility structure is nonconforming with respect to the minimum front yard setback. The Owner wishes to renovate the existing structure and to construct conforming additions to that structure. FRONT YARD: The Owner is requesting a variance from Section 10.2 relating to the minimum front yard requirement (50 feet) to recognize the non-conforming front yard of the existing structure, which is located approximately 24 feet 4 inches from the front yard property line. While Section 3.10 of the Zoning Regulations permits (under most circumstances) reconstruction or repair of damaged nonconforming structures within 18 months of such damage, it would be beneficial to the Owner if a variance were granted so as to eliminate any future risk related to reconstruction should damage occur. SIGNS: The Owner is requesting a variance from Sections 5.2.4.4 and 5.1.3 relating to the number of signs permitted. One building sign and one free-standing sign are proposed (see attached drawings.) As a retail operation located adjacent to a six-lane road on which vehicles travel at higher speeds, identification signs must be of sufficient size and appropriate location to be noticed. Existing evergreen trees at the site's southeast corner and large willow trees on adjacent property to the north require that a free-standing sign be installed to help announce the facility to travelers going both northbound and southbound. Numerous precedents exist along Route 5 for this variance. • The proposed building sign will be approximately T-0" high x 29'-9" long(or about 60 square feet.) Given a building frontage of about 93 lineal feet, a building sign of up 187 square feet is permitted under current regulations. • By itself, the building sign will not provide adequate visibility to vehicles travelling at higher speeds because it will be partially obscured by existing trees to the north and south.Other nearby commercial properties have large free-standing signs. The proposed free-standing sign will be 4'-0" high x 10'-0" long(or about 40 square feet.) The Owner believes the proposed size of the sign is appropriate for its location and purpose. It is our understanding that a free-standing sign of similar size has recently been approved by the South Windsor Zoning Board of Appeals for a site near the Owner's property. The Board noted your hardship to be that the site is a non-conforming lot. Also, because of the speed of traffic on Route 5, the larger sign will enhance the visibility for cars passing by making it a safer situation. Any new building or alterations/additions to existing buildings, require a building permit prior to start of construction. This action is effective upon your filing of the enclosed form in the Town Clerk's office at your own expense. Very truly yours, ZONING BOARD OF APPEALS Robert W. Warren, Chairman RWW/pmm Enclosure cc: Chief Building Official Zoning/Wetland Enforcement Officer I, Robert W., Warren, Chairman of the South Windsor Zoning Board of Appeals, hereby certify that on October 5, 1995 the Zoning Board of Appeals granted to Gerald & Joseph Puiia a variance to section 10.2 and 5.1.2 of the Zoning Regulations to allow existing 25' front yard (50' required) and to allow additional free standing sign on property located at 19 John Fitch Boulevard, GC zone.
