Dear Mr. Russo:
Your application to the Inland/Wetland Agency of the Town of
South Windsor is premature at this time.
According to Section 9 of the Town' s Zoning Regulations, you
.must apply to the Planning and Zoning Commission and be
granted approval before removal of material from any district.
A copy of this section is enclosed for your reference.
Also, this does not appear to be a permitted use in the Flood
Plain Zone. However, you may make application for this use
under Section 4.10.2.4 - "Special Exceptions. " Although you
also need a permit to work within the wetlands, I think it
will be to your advantage to acquire the necessary approval
from Planning and Zoning, prior to review by the Inland/
Wetland Agency.

Before a permit is granted under' this section, the applicant
shall post a bond with the Town Treasurer in an amount
approved by the Town Planning and Zoning Commission after
consultation with the Town Engineer as sufficient to guarantee
conformity with the provisions of the permit issued hereunder.
f. In passing on such applications, the Commission shall consider
the effect of such removal on surrounding property and the
future usefulness of the premises when the operation is
completed. In the case of removal of quarry stone , and
mining operations, the Commission may modify the foregoing
requirements where such operations will not endanger public -
health and safety or be detrimental to the neighboring
properties.
g. Such permits shall be issued for a period not exceeding two
years beyond the date of Commission approval except as
permitted in Item h below.
h. Extension of time , or modification of the scope of work
originally approved may be granted by the Commission with
or without a public hearing as determined by the Commission.
Bond requirements under Item e above may be altered as required.
under this Section.
9.4 The following regulation shall apply to those earth removal opera-
tion ,, already in progress at the effective date of these regula-
tions.
a. Within a period of one month following the effective date of
approval of these regulations, any existing earth removal
operation falling under the provisions of this section shall
cease operation.
h. In deciding whether or not an earth removal operation falls
under the provisions of this section, the Metropolitan District
Commission maps on file in the Building Department may be
considered a base for calculations. -

4.9.4.4 Parking and Access
a. Off-street parking shall be provided and at Least
one car space for each 150 feet of gross office
area shall be constructed. E; _
b. Access ways shall be constructed to the street
specifications contained in the South Windsor
_4 Subdivision Regulations. The location and
arrangement of access and parking shall be
consistent with public safety and shall provide r
no undue hindrance to the safety of existing or
proposed ways.
4.9.4.5 Buffer Areas -- These shall conform to Section 4.6.4.8
- of these regulations.
4.9.4.6 Public sewer and public water must be provided.

4. 10. 1 General. for the purpose of securing safety from
flood, prevention of property damage and loss and
all other related dangers, and of promoting health

of areas in the flood plain of rivers, streams and
.l water bodies which have or tend to have overflowed
their banks, the following regulations shall. apply

Gentlemen:
This is to notify you that the Planning and Zoning Commission voted to
approve your application for an earth removal permit for property
located north of North King Street, approximately 3,000 feet west of
Main Street, in a Flood Plain Zone, subject to the following conditions:
1. - This approval is subject to approval by the Inland-Wetlands Commission
of the Town of South Windsor.
2. The removal operation shall be limited to 10 truck trips per day.
3. Signs shall be erected, at your expense, cautioning traffic that
trucks will be exiting onto Main Street. These signs shall conform
to Tom of South Windsor Sign Specifications.
} 4. Grading and stabilizing of the area shall be accomplished according
4 to the plans.
5. This earth removal permit shall be for a period of one year, after
which time it shall be reviewed by the Planning and Zoning Commission.
6. A 24" x 36" black and transparent map, printed on polyester film, j
shall be submitted to the Planning and Zoning Commission to be stamped
and signed. This letter of approval and the letter of approval from
the Inland-Wetlands Commission shall be reproduced as part of the
final plans. A filing fee in the amount of $8.00 shall be submitted
prior to this plan being filed in the Office of the Town Clerk of
the Town of South Windsor.
