Although we have been informed by Mir. Davies that this is not a new application, we think that due to the length of the elapsed time since your last meeting with the Agency,it would be well advised for the applicant to place a sign on the property, where it may be seen from a town street. As you are aware the sign must be posted at least five continuous days prior to the meeting and is available at the Town Hall. Z,Ihen the agenda for the December 13 th. meeting has been prepared, you will be notified the time you are scheduled for review. Very truly yours, Constance Erri sson, Chairman INLAND 1'y ETLANDS AGENCY TU,111 OF SOUTH '+INDSOR CE;chm CC: A. Bowen Davies, Deputy Town Engineer v PLANNING & ZONING COMMISSION NOVEMBER 30 , 1982 PUBLIC HEARING SOUTH WINDSOR TOWN HALL MEMBERS PRESENT: Montana, Evans , Hallowell , Conde , Sorosiak ALTERNATES PRESENT: Gilligan (sitting for Norman) ; Mainelli (sitting for Sorenson) PU IC HEARING /1 . Application of Bernard W. Lapuk, Trustee , for a Special Exception/ Site Plan approval in accordance with Section 4 . 6 . 3 . 2 of the Zoning Regulations, for property located on the south side of Ellington Road abutting Bryrewood Condominiums and the South Windsor Fire Department , consisting of . 43 acres in an MF-A zone, to be known as Indian Ridge Condominiums. Attorney Arnold Sbarge , 100 Constitution Plaze, Hartford, was present on behalf of the applicant . He stated that in July of 1981 the zone change was approved along with a general plan of development . Since that time they-have gone over the plans with the Town Engineer and Planning Director many times and they have incorporated their suggestions in these plans . They are asking for approval of Phase I which will include 56 units immediately abutting Ellington Road , as well as the recreational facilities , such as swimming pool , tennis courts , etc . The applicant has met with the Inland Wetlands Agency and the final hearing is December 13th at which time they expect to receive approval . The architect for this project , Tom Bazzano , produced a large aerial photograph of the area showing the site of- the . proposed development in proximity to the surrounding area . The driveway will be opposite Foster Road. There is a difference in elevation of more than 20 ' between the pond and the proposed units . The trees are not dense and will permit a view of the pond . Mr . Bazzano then proceeded to review the plans consisting of 43 pages, one -page at a time . Page 1 shows the land use data . The property consists of 52 acres of which 9 acres are in the flood plain and 2 . 7 acres is not useable . The land area to determine density is 40 . 25 acres which would permit 320 units , and they plan to build 284 units . _ There will be 60 Type A 1-bedroom flats ; 120 Type B and C 2-bedroom flats ; 120 Type D and E 2-bedroom town houses ; and 26 Type F 2-bedroom split town houses . Some of the units will have walk-out basements , and there are 88 covered parking areas out of a total of 568 spaces . Sheet 3 of the plans is the key map , and sheets 4 through 7 , 11 , 12 , 14 and 15 show the layout of the six styles of units . Sheets 8 , 9 , 10, 13 and 16 show the exterior of the buildings which will be vertical wood or clapboard or a combination of the two . The buildings will primarily be of the same color, but with different textures . Page 10 shows the walk-out basement and inthe center of the building is a common area which can be used for additional storage by the Association or as a meeting room or for other functions . Planning & Zoning Commission -2- 11/30/82 Building #2 on sheet 11 shows units with garages in front that are separated by a landscaped court and the entrance from the garage to the unit is covered by a canopy. Brick is also introduced on the lower levels of the units . Page 18 shows the pump house, bus shelter , observation deck and trash enclosure . The observation deck is actually a small gazebo which will be located in the area overlooking Mill Pond . Sheet 19 is the plot plan which basically shows Phase I . Recreation areas are identified by the letters A, B, C, etc . through L. A, for example, consists of 3 tennis courts , swimming pool, tot lot , handball wall and pool house; B is badminton, volley ball and picnic area; C is horseshoes and picnic area; H is a golf putting area; L is for gardens ; with most of the other areas designated as picnic areas. A jogging trail winds through the development and will be about a mile long. Sheet 23 shows the realignment of Foster Road. and remaining sheets show the drainage, sewers , landscaping and lighting . Landscaping and plantings will be done by Joseph Caruso, a local nurseryman, and they are going to try to preserve as much of the natural vegetation as possible. The areas adjacent to the pond will be left undisturbed. Willows will be planted in the detention areas , and flowering trees will act as screening between units . Mr . Fred Hesketh, the traffic engineer , then passed out updated copies of his report . They have been in touch with the State Traffic Commission in accordance with Section 14-3 of the General Statues but have not yet been issued a certificate since it takes about 4-6 months . The entrance will be slightly to the east of Foster Road and will be slightly widened providing for two lanes exiting, with one marked for right turns . The left lane will be reserved for left turns . There will be a slight widening or flare on the south side of Route 30 to facilitate right turns into Indian Ridge. They do not feel a traffic signal is required or recommended, however, they are willing to place monies in escrow for that purpose should it be necessary at a future date. Mr . Sbarage noted that an agreement has been reached with Patricia Ericson who owns the land they are buying in order to enlarge the intersection of Foster Road and Ellington Road . Mr . Igor Vechesloff , the engineer for this project, stated that the site basically drains from north to south or from Route 30 to Mill Pond. The total flow will be into three detention basins . The first will have a 30" pipe draining from the existing basin on Town property . All of them are above the flood elevationof 57 and have been computed based on the 100 year flood. The peak flow for #1 is 48 . 6 cu. ft . per second, which has been reduced to 42 ; basin #2 existing peak flow is 16 reduced to 7. 7; and basin #3 is 11 . 5 reduced to 6 . 5 . Planning & Zoning Commission -3- 11/30/82 Mr . Sbarge then reviewed the approval letter of the Commission for the zone change and noted that they have complied with items 1 and 2 on the first page . Regarding the second page , he noted erosion control methods have been proposed and a conservation plan has been submitted. Item #2 concerning the recreation area has been corrected, and each unit will have approximately 840 sq . ft . Item #3 - drainage - this has been worked out and there have been numerous meetings with the Town Engineer , and it has been approved . Mr . Sbarage said he feels they have complied with #4 and 5 concerning better mix i of exterior building materials and recreational areas , and the technical items in #6 , #7 and #8 have been complied with. Peter DeMallie , Planning Director , then reported that the plans are in conformance with the previously approved General Plan. There is an agreement with Mrs . Ericson to sell the land necessary for the improvement of Foster Road, and this land should be deeded to the Town and should be a condition of approval . Dumpsters should be on concrete pads and adequately screened. Mr . Bazzano noted that they plan to fence the dumpsters with a rail type fencing and shrubs . He felt this is more attractive than the typical stockade fence . Mr . DeMallie went on to say the gazebo is an excellent idea and it should . be shown on page 25 of the plans . He noted that some units have storage in adjacent buildings and questioned whether this is a good idea . He noted the plans have been revised at least five times . The floor plans are pretty much the same but it is a very workable layout . Town Engineer Page reported that he has had numerous meetings with the developers and they have incorporated the Engineering Depart- ment ' s idea into the plans . The fire house is just to the right of the shaded area on page 3 , and there is a detention area serving the fire house with a swale that by-passes drainage from Ellington Road . Drainage from reconstructed Foster Road will be directed to the swale and proceed to the south and there is a large ditch or natural swale and the fire house drainage and Ellington Road drainage will cut across this property. Behind Building #5 water will be gathered and then let out through a control outlet into a large swale that continues along the left boundary behind Building #8, 9 and 10 , and it will go into the pond like it does today . This will all be constructed during Phase . I . Detention basin #2 will be built as further phases are approved and will handle approximately one-third of the remaining site and will be outletted into a natural swale and basin #3 is to the south behind buildings #24 and 22 and will handle the remaining one-third of the flow in future stages . Page 32 shows the area across the road and there will be two catch basins installed at the intersection and the flow will be directed under Route 30 into the swale . Either a swale or catch basin will be constructed on Mrs . Ericson' s property. Page 39 shows that all the retention basins are below all the basement floor elevations so there shouldn ' t be any problem with flooded basements . Page 24 shows the pump house and pool house . The pump house design and location will be changed, but this is not part of Phase I , and eventually it will be designed in accordance with Town specifications . 1 Planning & Zoning Commission -4- 11/30/82 No one spoke in favor of or in opposition to this application, however, Mr . Robert Finch of 819 Clark Street said he is a former member of the Inland Wetlands Agency and currently chairman of the South Windsor Land Trust . He noted he is in favor of the general proposal but has concerns regarding access to Mill Pond and the land adjacent to it . He feels there should be access to the pond for the general public and possibly a picnic area and jogging trail for public use . Mrs . Montana informed Mr . Finch that the pond is private property. Mr . Finch said if there is a well defined trail to the pond it would prevent people from going through the woods and destroying property . He said if the public abuses the area the condominium association could reserve the right to come back to the Planning & Zoning Commission to prohibit public use. Mr. Finch also said he is concerned also with the view of the pond from the opposite shore once this site is fully developed. Commissioner Mainelli questioned what the soil and land is like, and Mr . Page said it is very sandy and highly erodible, and there ' s lots of vegetation and it ' s not swampy until you get to the elevations£ Mill Pond . Mr . Mainelli then asked how much of the recreational area will be completed in the first phase, and Mr. Bazzano said that everything in Area A, including the swimming pool , tennis courts, tot lot, etc. Commissioner Conde raised a question regarding the lay-out of the interior road, and Mr . Vechesloff said the road was laid out that way at the request of the Town Engineer in case the Town takes the road over. Mr. Conde noted the dumpster areas were on the sides of parking lots , and Mr . Bazzano said they had to be there so that trucks would have access . Mt. Conde noted that the Town Planner had made a comment about storage areas in other buildings , and said he would hope each building is self-contained. Commissioner Hallowell said he would like to make a couple of comments . The first concerned elevations which look all right , but the plans indicate there could be alternate elevations which means the developer can do anything he wants other than what is specified on the plan. Also , Mr . Hallowell said he would like to see all the recreational areas laid out and defined on one sheet , with an indication of exactly what is being done to the area. He noted a jogging trail could be nothing more than a path in the woods with a few markings on trees. Mr . Bazzano, in replying to Mr . Hallowel.l ' s comments, stated that the elevations in the first cluster will be pretty much . as illustrated ; the jogging trail will be defined by cutting a path, leveling it and mulching it. Mr . Hallowell said he also would like more specifics concerning loaming and seeding shown on the plans - such as how much loam and what kind of seed . He also suggested that the dumpsters . be located behind embankments with shrubbery. Mr . Hallowell then asked the proposed prices of the units and Mr. Bazzano said they would start in the mid-40 ' s for the one bedroom flat , up to the low 70 ' s for the split town house . J J Planning & Zoning Commission -5- 11/30/82 Mr . Hallowell said .that in view of the large number of units and equipment necessary to maintain this property, consideration should be given for a storage area or utility building for the heavy equipment such as snow blowers, tractors , etc . Mrs . Montana said she would like to see an area set aside for children ranging in age for 9 or 10 to about 14 or 15 for use as a ballfield or soccer field. She noted that the adults might get upset with kids using an area designated for badminton or volleyball for other purposes . Mr . Sbarge said the Association could establish rules or regulations concerning the use of such areas . Commissioner Evans said the plans show areas designated "stockpile" and asked what this meant . Mr . Sbarge said it merely means dirt will be stored inthese areas during construction. Mrs . Evans asked who will maintain the detention areas and Mr . Sbarge said the Condominium Association will do that . Mrs . Evans said an area is designated for gardens, and suppose the people don' t wish to garden?- - Mr . Sbarge said that would be up to the Association. He added that there is a large flat area where they originally planned a second access that could possibly be used for ballfields , etc . Mrs . Evans noted that at one time there was talk about Mr . Grigorian ' s abutting property having a joint entrance with the condominiums , and Mr . Sbarge said they attempted to talk to his attorney, but it led nowhere . Mrs . Sorosiak questioned parking areas near the swimming pool , and Mr . Bazzano said there would be additional parking. Mrs . Sor_osiak asked the size of the pool , and was told it will be 20 ' x 40 ' , about 6 ' deep , and there will be no diving . Lighting is shown on the plans . Commissioner Gilligan asked about a large piece of land located at the lower ,end of the property and asked if they plan to develop this , and Mr . Sbarge said they have no plans whatsoever regarding its development . Mr . Gilligan said he understood they originally were willing to deed this land to the Town as open space . Mr . Sbarge said they do not intend to deed it to the Town, but also do not intend to build on it . Mr . ' Gilligan asked about the land between the development and pond . Mr . Sbarge said this is in the flood plain, and there is about 9 acres, and can ' t be developed. Mr . Gilligan noted that last June Mr . Sbarge said the developer would be willing to grant this to the Town. Mr . Sbarge said they would be willing to do this, but do not want to commit the Association to permitting the jogging path to be used by the public . He said they would be willing to deed it to the Town but would want it kept in its present condition with proper safeguards . Mr . Gilligan thensaid. page .41 of the plans show there will be a lot of grading near the pond in order to fit a number of buildings on this desirable piece of land, and he noted that since a significant amount of material will be moved that plantings or other erosion control methods should be utilized in early stages of construction. Town Engineer Page said he thinks this is an excellent idea and he will suggest that the Inland Wetlands Agency incorporate this in its approval . 1. i Planning & Zoning Commission -6- 11/30/82 Mr . Conde asked about the heating system and was told it will be electric with heating pumps , and there are double, insulated walls . Mr . Mainelli noted that this is a very large project , compared to other condominiums developments in Town, and suggested the Town talk to other Towns about possible problems that may occur in connection with such a large development . He said storage areas for equipment is one thing that was mentioned , and perhaps some sort of security measures are necessary. He also said he was concerned that with 300 units there ' s a possibility of 200 cars lining up between 7 and 8 a. m. to leave the complex and with one driveway that could be a problem. Regarding a large meeting hall in which to hold Association meeetings, Mr . Sbarge said it ' s more practical to rent a hall for the one or two meetings a year . Mrs . Sally Edlund of 386 Hilton Drive said she wished to express her concern about the pond, which she said would attract children and they will trample the area . She was also concerned with the chemicals from run-off going into the detention basins . In his closing statement , Mr . The soils are: AfA - Agawam fine sandy loam, 0 to 3 percent slopes, well drained NnA - Ninigret fine sandy loam, 0 to 3 percent slopes, moderately well drained NSA - Ninigret, very fine sandy loath, 0 to 3 percent slopes, moderately well drained WvA. - Windsor loamy fine sand, 0 to 3 percent slopes.-, excessively drained WvB Windsor, loamy fine sand, 3 to 8 percent slopes, excessively drained Te - Terrace escarpments sand and clay 3. The area consists of low growing shrubs, saplings# two open areas and a wooded area bordering Mill Pond. EVALUATION 1. , All of the soils found on this parcel are considered important farmland soils. At one time the majority of the parcel was farmed. The extensive development of this area will result in a loss of these soils for any future agricultural activity. Also, the area is underlain by deposits known or -inf erred. to be capable of 'yielding small to moderate amounts of water as shown on the CT Ground Water Availability Map (19-78). 2.- The plans as- submitted have provided for many erosion and sediment: controls. necessary for an intensive development such as this The project is to be constructed in phases and it is planned to have erosion and sediment controls in place before construction of the buildings begin. The removal of accumulated silt from plunge pools and retention basins and sumps should be done when the capacity of these structures is reduced to 50 percent.. 0lJThe Soil Conservation Service SCS-AS-1 is agency of the Department of Agriculture 10-79 FOR: Constance Eriksson, Chm 12/28/8.2 Inland Wetlands Agency page -2- South Windsor RE: Indian Ridge .Condominium, :Ellington Rd EVALUATION (CONT"D) 3. . The question arises as to whether .to. stabilize the area abutting the pond in conjunction with phase I. The installation of hay bales, grading, and construction of retention basins would be necessary to accomplish. These measures are shown on the plans. Since the area is presently stabilized with natural vegetation such as. trees, shrubs and grasses, it would require disturbance of this area to provide erosion controls along the entire area abutting the pond. The hay bales in place.for along period of time will decompose possibly. by.the time the additional phases are constructed. The plans state that erosion controls will be done l year in advance of actual construction of future phases. It would appear that to leave the area abutting the pond in the existing natural vegetation might be the -best .alternative and then follow the plans as future phases: are constructed. This should provide maximum protection to Mill Pond during construction of phase I and as each future phase is constructed. Should any further information be needed, please call me. You confirmed for me that Condition No. 1 in the Agency's letter of January 12, 1983 relating to a fence delineating the limits of Phase I can be satisfied if the bounds of Phase I are indicated by appropriate markings such as easily seen moles. The purpose of such markings to delineate the limits of Phase I is understood to be to keep construction equipment operating on Phase I from causing any damage to areas outside Phase I.
