It is just easterly of the Podunk River and has contained an operating Dairy Queen since May, 1978 . The Dairy Queen was constructed with connections to city sewer, city water, and city gas . The city utility connections make the use of on site wells, septic systems and fuel oil storage ( possibly underground ) unnecessary. The possibility of on site pollution from these sources is eliminated through the use of the city utilities. The 1977 site plan shows no previous building on this site. A copy of the U. S . G. S . 1"=200 ' Quad Map shows this building and few others along Sullivan Avenue . This is a growing area where the previous land uses had been farming . On undisturbed land along the west border of our site stands a small hill with 30 +/- year old oaks . Thus showing this land was not cultivated in the 1960 ' s or 1970 's . A few years ago, during the reconstruction of a portion of Sullivan Avenue, one mile easterly of this site, 80 loads of excess material ( earth ) were dumped on site. The material is still in truck size piles about mid-site to the rear of the single building . This material appears to be only dirt. Vegetation has taken root and is now growing over these dirt piles . " 4, b hj.S jS FJa arm , .Ltd Aurc9 L 1y1►. ed o d SITE HISTORY RStA arch Today the Dairy Queen is owned by STANLEY W. ABELL and KAREN M. ABELL. They are attempting to sell the business and land to WENTWORTH MANAGEMENT and INVESTMENT, LIMITED PARTNERSHIP. The Abell 's purchased the parcel in October of 1987 from Michael 0. Bell and Fernande Bell ( V503, P216 ) . The Bell 's purchased the site in November of 1973 fromm. Edward L. Meyers and Henry 0. Meyers ( V173, P163 ) . The Meyers received the land in February of 1964 from the Estate of Andrew Meyers ET . AL . ( V100, P652 ) . On October 18, 1977 a building permit was withdrawn for 845 Sullivan Avenue . The records show a C.C. ( certificate of occupancy ) was issued on May 24, 1978 . No other building permit activity has taken place on this site. The site plan for this 70 ' X 36 ' 8" building for Michael 0. Bell and Fernande Bell shows city sewer, city water and city gas connections . The site plan has no indication that a former structure was on this site. i REGULATORY COMPLIANCE The Transfer Program of Connecticut General Statutes requires the notification of transfer of title and the payment of a fee of from 200 to thousands of dollars for Hazardous Waste Establishments . Sections 22a-134 (1 ) defines transfer of establishment as any operations that generates, transports, treats, stores, handles or uses, etc. hazardous waste, and which establishment undergoes a change in ownership, management, corporate identify, etc. . Sections r 22a-134 through sections 22a-134d are included in the appendix of this report . Department of Environmental Protection states that " If a facility is not an establishment, a " negative declaration " should not be submitted ". An establishment is a place that generates, handles, etc. more than 100 kilograms ( 220 lbs. or approximately 1/2 barrel ) of hazardous waste per month or is a 1 ) Dry Cleaning Establishment 2 ) Furniture Stripping Establishment 3 ) Auto Body Repair 4 ) Painting Shop The Dairy Queen at 845 Sullivan Avenue is not an * Establish- went * and the transfer should not be reported to the Department of Environmental Protection. D.E.P. Declaration for Transfer of Establishment ( Appendix B ) requires no application be made. t SITE FEATURES The Dairy Queen at 845 Sullivan Avenue is located on 3.4 acres . The parking lot and building occupy the front third of the lot . The building is on the east side of the lot with the parking to the west . The central portion of the lot has been cleared and leveled . Part of this area is lawn with a picnic table. The east portion behind the building contains some 60 mounds of dumped fill . The rear third of the lot remains in its natural wooded state . Wetlands exist on a portion of the rear of the lot and adjacent to the parcel in the front . The developed parcel to the east has created a wet swale along the property line . The property lies within 500 ' of the Podunk River . The rear of the parcel is less than 200 ' from the river and may be subject to some backwater in the 100 year flooding of the Podunk River . 1 SITE WALKOVER January 15, 1992 I, Kenneth J. Pudeler, P.E., L.S. , visited and walked the site. No indication of hazardous waste was found. ]No inspection of the interior of the present operating Dairy Queen was made . This area is inspected twice a year by the local Health Authorities. They perform an in depth Public Health and Cleanliness Inspection. L FINDINGS No =hazardous wastes were uncovered or found on this site . No records of hazardous wastes or spills were discovered . This site does not meet the " Establishment " Requirements of the Department of Environmental Protection. D.E.P. states no " Negative Declaration " or " Certifica- tion " should be made for this type of site . No application of filing should be made to D.E.P. with this land transfer . i . Prior to transferring an *establishment', the transferor must submit to the transferee a 'negative declaration,, regarding-on-site hazardous waste releases f and current hazardous taste management practices. 1 copy of this declaration nd accompanying attachments oust be submitted to the Commissioner of anvironsental protection within " days after the transfer. Then a *negative declaration' cannot be made due to the presence of hazardous wastes on-site, a 'certification' fors III must be provided to the DEF by either party to the transfer prior to the transfer of the property. If a facility is not an establishment, a •negative declaration' or 'certification' should not be submitted pursuant to 22a-134 of the Connecticut General Statutes: c 'Establishment' means (t) any establishment which on or after May 1, 1967, generated wore than one hundred kilograms of hazardous waste per month or which recycled, reclaimed, reused, stored, handled, treated, transported or disposed of hazardous waste generated by another person or msmicipality or (B) a dry cleaning establishment or furniture stripping establishment, auto body repair shop or painting shop operating on or after May 1, 1967; 'negative Declaration' means a written declaration on a form prescribed by the Commissioner stating (2) that there has been no discharge, spillage, uncontrolled loss, seepage or filtration of hazardous waste on-site, or that any such discharge, spillage, uncontrolled loss, seepage or filtration has been cleaned up in -accordance with procedures approved by the Commissioner or determined by him to pose so threat to human health or safety, or the- emvironsent, which would warrant contaiasent and removal or other mitigation measures and (2) that any hazardous waste which remains on-site is being managed in accordance with this chapter' and chapter 446k and regulations adopted thereunder. David Woodbury Wentworth Management and Investment Limited Partnership 125 Long Hill Road Andover, CT 06232 RE: Site Assessment 845 Sullivan Avenue South Windsor, CT SW-9 Dear Sir, On February 7th, Mr. Paul Little of Savings Bank of Manchester called with comments on the January 17th, 1992, Site Assessment for 845 Sullivan Avenue . A copy of Mr. Little 's FAX is attached . His comments consist of requesting additional review of files and some soil testing . Additional research has been done with the same negative results as originally reported . Please see the attached list of files and people contacted . Soil samples were taken on February 19, 1992, from 20 locations within the area of dumped fill . Samples 1 through 4, 5 through 8, 9 through 12, 13 through 16, and 17 through 20 were combined to create 5 composite samples (A, B, C, D, and E) that were sent to EnviroTech Laboratory for analysis. A method 8010, a method 8020 and a total petroleum hydrocarbon (TPH) were run on each of the 5 composite samples . A sketch of the sample locations and the tests results are attached. No visible signs of oil or petroleum products exist in the sample area except excavated and broken road asphalt. No odors were detected above ground or 2' down at the sample locations. Method 8010 and $020 show no detectable results . The total petroleum hydrocarbon for samples B and C. holes 5, 6, 7, 8 and 9, 10, 11, 12, show TPH results of 215 and 129 tag/L respectively. Sample A, D, and E have TPH results below 100 mg/L. Test method $010 and $020 are done by Gas Chronometer, which looks for the lighter, more evaporative compounds. The test for Y 1 total petroleum hydrocarbons (TPH) is done by the Inferred Spectroscopy method and individual compounds are not identifiable . The TPH test checks for all petroleum including the higher boiling point materials (tar, asphalt, grease, and oil ) . The central area of the dumped dirt piles, sample area 5 — 8, and 9 - 12, contains broken pieces of road asphalt and stone sub-base. Asphalt chunks were not used in the samples but do exist in the piles that were sampled . With pulverized and broken clumps of asphalt in the same truck load pile, fines and grit may have mixed thus giving a questionable reading. The E.P.A. has no regulated level for TPH. Petroleum hydrocarbons are undesirable in drinking water . Nothing indicates that the hydrocarbons found are soluble in water . Test 8010 and 8020 show that most of the lighter materials don't exist (none detected ) . It should be noted that Sullivan Avenue is on city drinking water and so no wells exist in the area. Asphalt is a non hazardous substance used for roads and paved waterways throughout the state. Continued testing will give a wide range of results due to the incomplete mixing of materials that are found in the dirt piles in question. The materials found in these piles is consistent with highway excavation material; dirt, sand, gravel, stone base, and asphalt. This confirms the Findings stated in the January 17, 1992, Transfer Act Site Assessment. Very truly yours, Kenneth J. Pudeler, P.E. , L.S. There was reference to an Industrial facility on Sullivan Avenue, but it is about a mile away from the Dairy Queen location. 4 ) The State Map Room was visited and the 1965 Aerial flight (3-13-65 photos # 1854 and # 1853) photos were reviewed . The area of 845 Sullivan Avenue shows as trees and brush, and no buildings are visible on the lot. This confirms the original 1974 site plan that no prior buildings existed on this site. 3) During early January of 1992, the South Windsor Building Inspector 's file of this site was reviewed. It contained only the original 1974 building permit for 845 Sullivan Avenue. # ) During January of 1992 the Town Sanitarian, Mr. Deptula, was contacted and the site was reviewed. The subject of hazardous waste, a possible spillage or accident at 845 Sullivan Avenue was discussed. He knows of no problem on site. It was noted that as a "restaurant" he is required to inspect the operation periodically, usually twice a year. 7) The Fire Marshall was contacted on February 14, 1992. IANNI PROFESSIONAL SOIL SCIENTIST JANUARY 1993 P.O. Box 337 Storrs, Connecticut 06268 - (203) 742.5868 The inland wetland boundaries on the property known as 845 Sullivan Avenue were field delineated in November 1992. The delineation was conducted in accordance with the standards of the National Cooperative Soil Survey and the definition of inland wetlands and watercourses as found in the Connecticut General Statutes Chapter 440, Section 22A-38. I have reviewed the plans prepared by Pudeler Engineering dated 12-30-92 and have found the representation of the field delineated wetlands to be substantially correct. The site is located on the south side of Sullivan Avenue and consists of approximately 3.4 acres. An existing building and associated parking area exists in the north part of the site. The rear of the site is wooded and the area between the parking lot and wooded area has been filled. Three wetland areas were found on the site. The soils on the site are classified as follows. The front third of the site which is occupied by the building and parking lot are classified as Urban Land. The middle third of the site is classified as Udorthents or made land and the rear third of the property contains upaland soils of the Agawam Series and wetland soils of the Walpole Series. The largest of the wetland areas is in the southeastern corner of the site. The soils in this wetland were identified as belonging to the Walpole series. No activity is proposed in this wetland. The second wetland area consists of a drainage swale along the eastern property line. A portion of this wetland is man made. A retaining wall is proposed alongside this wetland. The main focus of this report is the wetland in the central portion of the site along the western property limits. This wetland currently receives stormwater discharges from the existing drainage system on the site. As part of the application for the Minature Golf Course and Batting Cages, the Owners have expressed a desire to enhance the function of the wetlands as well as its appearance. r -2- The soils in this wetland were classified as wet made land. In my opinion the area was not originally classified as wetlands but was a created wetland due to the stormwater outlet for the developed portion of the site. The wetland currently functions quite well in regard to stormwater management, with sediment trapping and nutrient retention being its main function. The vegetation within the wetland is dominated by a healthy stand of Typha sp. (Cat-tails) . Carex stricta (Tussuck sedge) and Juncus effusus (Soft rush) are also present in the wetland. The wetland acts as a retention/detention basin since the outlet is somewhat restrictive. The banks of this wetland are dominated by Alnus rugosa (Speckled alder) and Rhus typhina (Staghorn sumac) along the western side and Myrica pensylvanica (Bayberry) and Rosa multiflora (Multiflora rose) along the eastern side. As part of the proposal these species which have colonized the banks of the wetland will be removed along with an oak tree that has fallen into the wetland. Since the wetland functions well in the area of stormwater management and there is a well developed stand of cat-tails the enhancement plan will consist of additional plantings within the wetland to increase the diversity of plants and include some flowering wetland species. Since the cat-tails are well established, and they are agressive colonizers, it is not feasible to remove that species. There is room along the edges of the wetland for some additional plantings. A listing of potential species to be added to the wetland is included as an appendix to this report. An exact planting plan is not being proposed at this time due to the variability in the availability of plants at planting time, hydrology at time of planting, and season. If the plantings can be accomplished in the spring the hydrology is favorable, but plant availability may be limited. The plants listed in the appendix are available from specialized nurseries in Connecticut and also from the other on-site wetlands. -3- The enhancement plan will be executed by hand and no additional soil materials or mechanized machinery will be placed within the wetlands. The plan will not disrupt the functioning of the wetlands but is intended as a supplement to species diversification ard aesthetics. I would anticipate the plantings to be accomplished in one working day with no adverse impact to the existing wetlands. In conclusion, as part of the application for development of the site enhancement of the wetlands with regard to aesthetics and species diversification is being proposed. The enhancement plan will supplement the existing vegetation in one wetland with plants typically found in Connecticut. The enhancement will not disturb the existing vegetation within the wetland, nor will it affect the function of the wetland. Exact plant species will be chosen based on the time of planting, availability of species and hydrology at time of planting. The wetland agent will be contacted prior to the commencement of work and an detialed planting list will be submitted. Having investigated the Dairy Queen site on numerous occasions over the past year, I can assure you that all of the parking area is served by storm drainage. The only storm drainage leaving 345 Sullivan Avenue is near the rear and first filters through a man made detention facility before entering a natural wetlands and pond area near the Podunk River . This detention facility is so designed as to leach the water out slowly and help keep the wetlands wet during the drier times while retaining any storm flow peaks . The proposed Golf Course expansion will use the same detention facility for storm water discharge . We wish to enhance the vegetation and keep this man made wetlands as a focal point for our "Golfers" . The proposed development will have little or no impact on the wetlands to the rear of your property. If walking the Dairy Queen site will help to alleviate any of your or your client 's concerns, please call either Mr . David Woodbury on site or myself so that we can make ourselves available to answer any- questions . . Very truly yours, Kenneth J . Pudeler, P.E. , L. S. Warren, Chairman, IWA/CC FROM: John E. McCahill, Zoning/Wetlands Enforcement Officer Re: Application #93-01P, Dairy Queen DOCUMENTS REVIEWED: Application form, Transfer Act Site Assessment _ (1/17/92) , and plans entitled Miniature Golf And Batting Cages for Dairy Queen (12/30/92) COMMENTS: 1. The application form, item G, states they are required to supply a copy of the letter (notification to abutter's) with the list of the names of the abutters . This was not submitted at the time of my review (January 8, 1993 ) and I was unable to unable to reach the contact person to confirm that it had been done. The IWA/CC Regulations, section 7 . 3g, states this shall be mailed within seven (7 ) days of the date of receipt of the application. They should clarify whether or not this has been done within the required time frame and should submit a copy of the letter with the list of names of the abutters . 2. The application form, item H, should be more specific with regard to the purpose and description of all regulated activity(s) . It states, "we wish to work outside the wetlands to fill and grade . . . Within the regulated area they will also be constructing a batting cage, a retaining wall, a miniature golf, a small building, and adding additional parking. The only wetlands or watercourses to be altered is listed as 8 sq. ft. . This is associated with cleaning up the outlet area within the existing detention basin. 3 . The Transfer Act Site Assessment (1/17/92) states that, "A few years ago, during the reconstruction of a portion of Sullivan Avenue, one mile easterly of this site, 80 loads of excess material (earth) were dumped on site" . I believe this took place in 1986 but am unaware of whether or not a permit was issued. (Perhaps someone on the Commission, at that time, might recall this activty and offer some additional information?) An IWA/CC permit (#88-19) was approved in April 1988 for a building addition which was never constructed. That permit has since expired. 4 . The Transfer Act Site Assessment (1/17/92) , within the Site Overview states, "the material dumped appears to be only dirt" . In the Site Assessment correspondence dated February 27, 1992 (which summarizes the findings of the soil samples which were taken) IM Elizabeth A. Warren Page Two January 11, 1993 Application #93-01P the report states there were, "no visible signs of oil or petroleum products existing in the sample area except excavated and broken road asphalt" . There are one to two square foot pieces of asphalt included in many of the existing piles of fill. It would seem appropriate (based on the IWA/CC Regulations definition of "clean fill" ) to have the larger pieces of asphalt which are encountered during the proposed activity removed from the site. This should be noted on the plans . 5 . The Transfer Act Site Assessment (.1/17/92) , within the Findings states, "no hazardous wastes were uncovered or found on this site. No record of hazardous waste or spills were discovered" . 6 . The plans state, wetlands determined in the field by Highland Soils and field located Nov. , 1992 by Pudeler Engineering" . The Soil Scientist should verify the limits as shown on the plans and should submit a report summarizing the findings . It would also be beneficial to have comments regarding how this proposal would effect the adjacent wetland areas; and possibly suggestions for improving the wetlands . (They are proposing to, "remove the alders growing upland of wetlands and cut stumps to clear view and keep wetlands open to sun" and "remove the large dead oak laying in wetlands" . ) 7 . The plans should be more specific with regard to the sequence of construction for the site. Depending on how things will progress the fill stock pile and topsoil stock pile may be in the way. It would appear, based on the number of piles of fill material that exist on this site, that there may be an excess of material which has to be hauled away. I would also question how much, topsoil actually exists? 8. There is an area where the proposed silt fence (along the westerly property line) is shown on the adjacent property. This should be relocated. 9 . Details should be provided for the proposed retaining wall, batting cage concrete surface, and miniature golf (a general concept) . 10 . The plans do not indicate whether the proposed building (25' x 351 ) will be on a slab, piers, or full foundation. 11 . The drainage calculations do not appear to address the proposed development, specifically the additional pavement. They are stating they will have, "nearly zero (o) increased discharge" . Elizabeth A Warren Page Three January 11, 1993 Application #93-01P 12 . It is my understanding that the proposed miniature golf will not have large amounts of grassed areas which require fertilizer, herbicides, and the like. This should be discussed and clarified with the Commission. 13 . These comments should be addressed prior to approval by the Commission. YX LAW OFFICES FEB 1 1993 .+1 OH N J. Refer to figure 25.6. The following equation is used. K = (H1-H2)L t x H1+H2 • 2 Where: H = Hydraulic head at start of test, in inches. H1 - Hydraulic head at end of test, in inches. L2= Length of sample, in inches. t = Elapsed time, in minutes. K = Sample permeability, in inches/min. This can be converted to feet per day by multiplying the result by 120. inches x 1 ft. x 1440 minutes minute 12 inches day Example 1: A 6 inch long undisturbed soil sample is collected in a 111 inch diameter to be. After thorough saturation, the water level above the surface of the sample is measured to fall 3 inches in 12 minutes. - Therefore: R1 = 31 inches L - 6 inches H2 = 8 inches t - 12 minutes `- (H H )L (11-8) x 6 = 0.16 inches/minute t H +H 12 x 11+8 K 120 x 0.16 = 19 ft./day JOB PUDELER ENGINEERING SHEET NO. The application did not list all the activity such as removing a large oak tree in the wetlands area or any of the work within the regulated setback areas . In the setback area we wish to construct a five person batting cage with a concrete floor, fully fenced to keep the balls in. This area will drain to the wetlands through a 6" pipe that will terminate uphill of the wetlands and have one cubic yard of modified riprap as an energy dissipator and flow disperser . We wish to also construct an 18 hole Miniature Golf Course, most of which is within the wetlands setback limits . To elevate and level the playing area, a _retaining wall -is proposed around two sides of the golf course . This retaining wall will serve to keep the golf course separate from the wetlands . The Keystone or VERSA- LOK retaining wall proposed is built with almost no activity on the wetlands side of the wall . A portion of the parking lot serving the Miniature Golf and Batting Cages as well as sidewalks, the entire proposed all purpose service building, and the new storm drainage catch basin are within the setback limits . r Several items within the setback limits will need detailed "shop" drawings to fully describe the construction and grading of each. The appropriate drawings will be submitted to Town, staff for review and compliance before construction. These items are : 1 . The Batting Cage 2 . The Retaining Wall with P.E. stamp 3 . Banach, Director of Planning John E. McCahill, Zoning/Wetlands Enforcement Officer FROM: Jerry C. Iazzetta, Town Engineer RE: Dairy Queen - #93-01 We have reviewed the revised calculations dated 3/2/93 for the miniature golf course drainage (see attached copy) . Without a layout of the course itself, it is difficult to prove that all of the 10 year rainfall will be absorbed into the ground. The calculations submitted make the best attempt to show this, however without a course layout it is still supposition. It is believed that this absorption can be achieved even if drywells are placed in the course area. Therefore, . if this project is approved, we recommend an approval condition indicating that drainage calculations are to be submitted and approved by the Town Engineer after the course layout is finalized and before construction starts . During a recent meeting the owriers of Dairy Queen and the Ann Fields Shopping center on Sullivan Avenue discussed the mutual advantages to increasing pedestrian traffic between their parking lots . The flat lawn along Sullivan Avenue serves this purpose but further back a storm drainage swail and a strip of wetlands separates the parcels . To cross this strip of wetlands Mr . Woodbury has proposed a short wooden "bridge" . The stile of rails and post will create a bridge like look while structurally it will he framed and constructed as a pressure treated "deck " on concrete piers . A ten foot span will clear the wetlands so no digging or soil disturbance is required in the wetlands . A location was picked opposite the picnic area in front of the new miniature golf coarse . This location lines up with the, middle of the parking area behinds Ann Fields and makes all the stores and shops accessible . The chosen location will disturb the least number of cat tails and other wetlands plants . This "Bridge" is a change to the approved plan,, for 845 Sullivan Avenue and so will need approval from the town . very truly vours hnnet J . Pudeler P .E ..,L .
