Notary Publi My Commission Expires &-ZA2 57t INLAND/WETLANDS AGENCY PAUL UCCELLO/WYNGATE COMMONS APPLICATION 9644P NOVEN MER 6, 1996 Okay 9644P,Paul Uccello. Wyngate Commons. Now. Okay, gotta change folders here. Where we stand on this one, if I recall is that we had asked for an opinion from the Town Attorney. Which . . Um,well we've got a couple of parliamentary procedures to do because currently the motion is tabled Oh. The motion to approve is tabled. To approve is tabled. There was a motion to approve. ZJQ&,tW Right. JIL+ Which was tabled. Right. That's okay. So if. . we need to um. Untable it. Yeah. Raise it from the table so that we can reopen discussion on it. Right. on the table, I mean, whatever you don't have to remove every motion that's on the table Yeah, that is one way of killing things. So why do we want to. . . Because we can't discuss it while it's tabled. Okay. So I move to raise from the table. Raise the motion from the motion. The motion to suspend 2 No. No. The motion to table. The motion to approve. Oh okay. I'm sorry. ALI* Was tabled. Right. So,I'm moving to raise the motion from the table,i.e. bring it back into active discussion. Okay. So we can discuss. ` &&UtQQ n Right. Second it. Okay,we have a motion to untable. Can we discuss that. Is there a. . Yes. Yes. I have it,Bonanno. ec Okay. Any discussion. I don't know on untable can you get a discussion. I don't think there is. All those in favor. 3 Aye. Opposed? Okay. I'll follow my. . But now we have to keep in mind that we have in fact, a motion to approve the application. Yes. But now we can talk about it again. Yeah, right. But I don't want that, you know, confusion about, where does that motion go? (Laughter). Well I'm going to shoot Susan for not showing up,she's the . . although it was nice. Jeff did send out,I assume you all got copies of. Memo should be withdrawed too. I'm withdraw it. Oh. Okay. I'm just saying, you know. But we can leave the motion open for as long as we want to continue discussing it. Okay. True. Yep. Or until we run out of time on the twentieth. (Laughter). Right. Right. Okay. All right. We do have a response from the Town Attorney. Which,I guess,Jeff I think handed out to all of you tonight. And we also have a letter from Mr. Alter,I believe, the attorney for the applicant. I frankly, haven't had time to read the whole thing. And,I don't know, maybe Jeff talked directly with Barry Guliano. He's connected to a satisfy Guliano. Um,Jeff spoke to Barry today? Right. So,maybe I'll let him report back what Barry said. How's that? Sure. Well as you can see by the time here on the fax,I received this at 4:40 in the afternoon, ,4 -e3VZ- this afternoon. Um,but I did have a chance to talk to Mr. Guliano, prior to him faxing this over. And explained this, what he had said. He went over his comments and he did say that if 4 Xlt the commission wanted to,he would be willing to appear on the 20th. And discuss his response. If they, you know,if the commission wished that. So that was the offer um,that he had That makes great sense to me. To have them here in person. I think he laid out the questions fairly logical for us to understand Yeah,he said it's up to you folks however you want to . . I have a little problem as far as um unless we adjourned or something, interpreting this tonight and then voting tonight. Yeah. I think I would rather have um . . Time to do more than just skim it. Yes,exactly. Exactly. And I'm not sure,I'm the worst one for following legalese, you know, kind of thing. Although couldn't be too much of that, but. I don't know. What's the commissions feelings? Well I'd like some time address these two letters. Uh huh. Uh huh. Um,try and piece together all of the 22A and the A3G's and the um P896157's. (Laughter) And the dozen other um numbers I see tossed out here. Yes,he has made reference to. Both of them make numerous references to the law, which would be expected. Since that's what they were asked about. There is one one change that I'd just like to mention, it would be on the third page. It would be the last sentence at the bottom,or half way up. It talks about these amendments, however, did not take effect until October 1, 1996. He's discussing the prior changes to the wetland law. Um,and that really should be January 1, 1996. It doesn't have any real bearing on the statement at all,it's just that it's inaccurate and. . January 1, 1997. Yes,Mr. Guliano was probably not aware of the exact time. I know we've discussed it quite a bit, so we'll probably have to comment on that one. 5 I believe some aspects in the law did go into effect October I and some . . Some portions did. go into effect on January 1,so. From the standpoint of these questions,it's a mute point as to which. That's all,it's just a. . Date it goes into effect. We'd still be going by the old statutes no matter what. Okay. So Jack for one and Susan, and how does it would like to take some time to read this over. Yeah. As long as he's offered to be here why not? I mean other questions will come up when we're discussing this anyway, probably, even after. . . That could be. Yeah Yes. I like the idea of having him here. Then why don't we? Can't hurt. You know, accept his offer. Are we under any time constraints? That is the deadline. That is the deadline for acting on this application. Unless the applicant were to give us an extension,of course. But. We do have that night. Do we have, not as on the side. Do we have any questions to ask of them regarding those other matters that we handed out. 6 VXU"L Oh. While we've got them here do we want to . . . that may not be a bad point, yes. &7c . - you know, all the questions. Yeah, and perhaps arrange the agenda in a way that we could have that follow. Okay. Yeah, that's a good idea. He called me with a follow up on that, you weren't here at the last meeting. He said he's going to amend the motion and he amended the for Jeff to(Tape Change) Okay, shall we continue the discussion on the . . . till the next meeting. The 20th of November, the next meeting. y/ Everyone's agreeable to that? Yes. And we don't need to vote on,we have an open motion on the floor. We just have an open motion on the floor. Okay. And to continue to discussion to the meeting to the 20th? Everybody's agreed? Okay.
