(s12) Regular Report Mr. Davies noted that T. & M. should be sta to dig foundations soon. Miirs. Warren thought they should be doing some more seeding, as there is a lot of open area, piles etc. Mr. O'Sullivan told the Agency they have foundations in, he was t there yeaterday. He thought that was quite a riprap area down Ave St. , they must be expecting a deluge when that fills up with water I The Agency did discuss the riprap. Mr. Lane asked Mr. Davies about the property across from Capital Z the .50 or 60 Acres that have been strip ped (the Spielman/Schneider appliaation) . Mr Lane said he had gone in there Sunday and it di look much different to him than it did 6 or 8 months ago. IdIrs. E`riksson thought he did not plant it. Mr. Lane thought it looked as if all they had done- was taken the wood off it. Nothing has be done. Didn't he say in his application that he intended to be far IIit by the end of the season. Mr. Davies explained that due to the inclement weather most of June. It created a certain amount of he in his own farm and other areas that he was getting together. In addition to the weather, he was planning to use 5 tons of lime to acre, which is $100 an acre just in lime. Mr. Lane asked how long did the permit run, a year. Firs. Eriksson thought the permit woul run until next spring. Ivlr. Davies noted Mr. Speilman was talking of getting together twenty acres this year and get the drainage tc work and the ground turned over. Mr. Davies has been in and talks with him a number of times, but he has been a victim -of the weath( Mr. Lane said OK, _ ` Mr. Davies gave the IVIA members a little-background to the activi• on 90 Foster Road, near the CTown garage. He asked if the Agency were concerned that he is pushing water on . his neighbors. g Mrs. 1Eriksson agreed that could be part of it. Mrs. Warren explained that it is a wetland area, and he is filling it in. Mrs. Eriksson explained that he is not suppose to do that. She added%±hat he probably would not see it in the deed, as the house was probably built prior to the inlad wetland act. Mrs. Warren was curious to know how he would know that. Mrs. Eriksson said a lot of homeowners don't. Mr. Davies observed that when one buys a house or lot, it says you will abide by the rules and regulations and zoning regulations, etc. of the Town of South Windsor. Mrs. Eriksson asked how would you specifically know, and Mr. Jurewicz noted that you would not specifically know unless one made the effort. Mrs. Eriksson asked Mr. St. Onge why he had the fill there, and what does he propose to do with it. Mr. St. Onge explained he was bring- ing the grade up as far as touching the part as what they would call the pond or the swamp. He would in future years like to dig it out. He would like to make a regular farm pond. H_e noted that in the last few days it is a mud puddle. In August and September it al- ways goes down. Mrs. Marren asked if there were any source of water or if it were there because of a low area. Mr. St. Onge said yes, plus there are layers of clay that has trapped the water. Mrs. Eriksson observed that if he wanted to make a pond, why was he bringing in fill. Mr. St. Onge told the Agency he would like to bring the pond back further from his new neighbor, Perzan, the ZAK, raised ranch.. He;didn t have to get a permit. Mr. Davies told him that he got a permit from this commission. Mr. St. Onge noted the house had been built within two years. He told the Agency that he was going to call Town Hall and put in a grevience because he doesn't have a 90 ft. frontage he was supposed to have a lateral. Mr. Davies reminded them that he did get a permit, he was suppose to put in hay bales and drain it away from the house, etc. Mr. St. Onge explained he had a hard time finding out what was going on over there and they are still not on speaking terms. his geese overrun his pond. Mrs. Eriksson suggested that what he is trying to do is eventually build some kind of a farm pond. Mr. St. Onge said he would like to. Mrs. Eriksson asked if he had talked to anybody, that is. trained in Monday, September 13, 1982 Page 16. in this kind of work like the Soil Conservation Service,as far as how to go about doing it, what you should do and shouldn't do. Mr. St. Onge said he had read books on how to clay line farm ponds and this a.nd .that, but he thought the grading around South Windsor was just condusive in itself to it. Mrs. Eriksson explained that the Hartford Count So'. . y it & Water Conservation District based in Windsor is available to residents W is free and they will help you actually design it. They will come out to your property, walk it with you and tellyou exactly how to design, what to bring in, what not' to bring in, with the least dis- ruption to neighboring properties. The Agency cannot tell you how to design your pond, it is comprised of lay people, but what they are trying to do is prevent his causing a problems to a neighbor. The Agency is not trying to tell him he can't do what he's trying to do, but would like it done in an organized manner. Mrs. Warren thought that SCS has rules to be followed. Mr. Davies observed that with dams the state and federal rules apply. Mr. Davies suggested to Mr. St. Onge that he make the road passabl ..going in the back. Mrs. Warren asked what was the road for. Mr.I? said he did not know, but they have acerage in the back. Iirs. War asked if that were required. Mr. St. Onge noted there is an acces road in the back. Mr. - Davies reminded them that when he was talk- ing with Mrs. St. Onge she informed him that that was where the ma J. jority of the material would be going. Mir, St. Onge said it hasn' ' gone there, it has gone to the side. He told the Agency that the ` supervisor who was working on the old Buckland School at the last I I minute they were going to dump where 291 was going off Buckland Ro and he (Mr. St. Onge) made a last minute call to the contractor fo that and for some reason in the course of twenty phone calls, of g wire crossed and they could no longer dump there. So,his house is i five miles from there, and he will be filling there; so put it the temporarily. Mrs. Eriksson auggested _that he not accept any more, the reason being that if you have dirt sitting there and you get rain storm, you get silt and dirt running into the wetland areas, I which is polluting them and causing problems and it just is not a ' i good idea. I Mr. St. Onge explained the fellow who would have been pushin SOUTh 01;A-D50R INLAND WETLANDS AGENCY MINUTES S E P Z ( 192 Monday, September 13, 1982 Page 17- the dirt around for him, will not be available until November, as he broke his kneecap playing baseball. Mrs. Eriksson told Mr. St. Onge that would give him some time to talk to SCS and they can suggest something very simple and easy to follow. ) Mr. Lane asked if he did have definite plans for going right ahead with this. Mr. St. Onge said he was just goingto grade what he has now- and put a transit on the grades that he has now and with- out touching the "average" water table he has about 40 inches of a swale in the top part of his land just to fill and the 500 yds, roughly figures into just about level ing it out, without going in- to the pond. When he eventually does hit the pond area, he would like to take the good dirt, run it up over the nasty fill there that was brought in, and make a new pond in the rear, using what dirt is there and more or less, just moving the pond from one point to another. Then filling out and then filling back in, so it would be deeper but probably about the same size. He would like to get a year 'round pond. - Dr. Krahula observed that basically he is not building a new one, but just shifting it. Mrs. Warren asked what is the water source for the pond. Mr. St. Onge said it is just surface water, just a col- lection that comes through the clay. He ma be d Y rying him out. Mrs. Eriksson told Mr. St.Onge- that could be bad, as he has a pond, he may not want to be dried out. Mr. Davies observed that they had a gentleman on another road that was very sensitive about drying his land. He urged Mr. St. Onge that whatever he is doing, to talk to SCS. Mrs. Warren asked if Mr. St. Onge will need a permit from IWA to proceed with his pond. Mrs. Eriksson told her that a farm pond is a permitted use providing you don't cause problems to a neighbor, and suggested they call SCS and then get back to Mr. Davies so he'll know what you are doin Y doing .and keep us informed. SCS may be able to give you some advise regarding the geese/duck situation. Mrs. Eriksson thanked Mr. St. Onge for coming in to talk with the Agency and if he has any further questions to call Mr. Davies, 13. DOCUMENTS REVIEWED: Application Form, Site Plan (sheets 1-2) , fill calculations by Meehan Associates and a letter from Henry Luce, Ph.D, CPSS/SS . COMMENTS AND RECOMMENDATION: 1 . Although the wetlands are adequately flagged on the site consideration should include the wetland area southerly of the site. 2 . The total wetlands to be filled, approximately 200 cubic yards, was provided as a separate calculation. 3 . Based on an on-site observation, I do not feel the pond actually crosses the lot border as shown on the plans . 4 . The majority of this site was flagged as poorly drained soils which have been through extensive disturbance, cutting and filling as a result of the pond installation, (see letter by Harvey Luce, Ph.D, CPSS/SC) . This does not necessary mean this is not a viable part of our wetlands system. SUGGESTED APPROVAL CONDITIONS: 1 . The silt fence, as shown on the plan, should be continued another 40 feet on the southerly border towards Foster Road. 2 . A silt fence is preferred over hay bales as this project will extend through the winter. 3 . A contact person should be identified directly on the plans in the event any site problems arise 4 . An area should be designated on the plan for temporary stockpile of excavated materials, including erosion and sedimentation controls . /v S Ye Z jR % S J. Meehan Associates 387 N. Main Street Manchester , Connecticut 06040 Dear Mr . Meehan: On May 24, 1988, at your request , I delineated the wetlands , as defined by Connecticut General Statutes Section 22a-37(15) , i . e. , those soil types designated as poorly drained , very poorly drained , alluvial , or floodplain by the National Cooperative Soil Survey, on a parcel of land of Mark St. Onge , 90 Foster Road , South Windsor . CT. Soils were examined to the extent necessary to classify them at the soil series level according to the system of soil classification used by the National Cooperative Soil Survey (Soil Survey Staff , 1975 , Soil Taxonomy, U. S. Government Printing Office , Washington , D. C. ) by exposing soil profiles with a spade and auger. The maiorityof the site was found to be wetlands as defined above. The only exce tion was a small "strip" of land adjacent to the Foster oa he poorly raine soils (wetlands) were identifie and delineated by placing flags numbered Al through A8 on vegetation along the boundary separating these soils from the small strip of better drained soils . This was done to facilitate the location of the official wetland boundary by survey . It is my understanding that these flags will be located by your firm using appropriate survey techniques . I request the opportunity to review any maps that are created that show the location of these flags or a wetland boundary based on their location . Soils observed in this wetland were poorly drained soils that had undergone extensive disturbance , cutting and filling . Moran, Jr. , Chairman, Inland Wetlands Agency/ Conservation Commission FROM: John E. McCahill, Zoning/Wetlands Enforcement Officer PIP, RE: Application #89-40W, Mark H. St. Onge, 90 Foster Road, South Windsor, IWA/CC permit for the construction of a single family house located on the easterly side of Foster ,Road and northerly side of Route 30 (Ellington Road, RR zone. DOCUMENTS REVIEWED: Application form and plot plan (dated July 27, 1988 ) . COMMENTS: 1 . This is the same plan that was denied under Application #88- 79W. Perhaps additional information is going to be provided? 2 . The total wetlands to be filled is stated as 11100 cubic yards" on the application form. For the last application a calculation of 200 cubic yards was provided, this requires explaination and verifications of reduced fill. 3 . Based .on an on-site observation, I do not feel the pond actually crosses the lot border as shown on the plans . 4 . The majority of this site was flagged as poorly drained soils which have been through extensive disturbance, cutting and filling as a result of the pond installation. The applicant should resubmit the report from the soils scientist as part of this application. 5 . A copy of the letter sent via certified mail to abutters and a list to whom it was sent to should be part of this application. 6 . This lot would need a variance to the "90 x 90 buildable square" required in the Zoning Regulations as a result of the wetlands . 7 . The house size on the plans is 29 , x 62. 31 . The application form states 1128' x 62" " . If the intention is to decrease the house size, this should be indicated on the plans. IF APPROVAL IS CONSIDERED, SUGGEST APPROVAL CONDITIONS INCLUDE: 1 . The silt fence, as shown on the plans, should be continued another 40 feet on the southerly border towards Foster Road. 2 . An area should be designated on the plans for temporary stockpiling of excavated materials . This should be appropriately protected to prevent erosion and sedimentation problems . Moran t RE: Application -*K 89-40W, Mark: St. Onge,-,,, Foster Rd. Dear Mr. Moran: I am writing to respond to comments on the above referenced application provided to your commission by John McCahill , - Zoning/Wetlands Enforcement Officer. I have been asked recently by Mr. St. Onge to respond -to these inquiries and to present his application to your commission. I understand that this application represents the second application for this activity since his first application was denied without prejudice. Mr. St. Onge has asked me to attend your commission meeting in order to answer questions which he feels he could not answer in the past or did not answer adequately. Mr. St. Onge has apparently made a few minor modifications to his original application in an attempt to minimize what he felt the Commission felt was significant impact. He intended to reduce the quantity of fill to 100 C.Y. and to reduce the overall size of the house although the plans do not reflect this. This is essentially the same plan which was submitted with the original application however additional information will be provided to clarify the expected impacts. I explained to r. St. Onge that I did not feel e reduction of fill quantity or house size as proposed affected the acceptability of this proposed wetland activity. The fill and house location and overall encroachment into the wetland area is essen is the same for either fill quantities Ouse sizes. This wetland area is connected to an extensive wetland system which is bounded by Foster, Strong, Fierce and Ellington Roads. Drainage from this wetland system is to the south and east ultimately disc arging to the Pad unF; Fiver east of fierce Road an , a ac ed map) . vastness o is exls ing wetland system it can be seen that this proposed active y is insignificant. - 387 North Main Street (203) 643-2520 Manchester, CT 06040 / Mr Moran, Chairperson St. Onge Application #89-48W Page 2 o4 3 June 1g, ig63g Hydrologically the loss of this small area of wetland will ot ~e.s. ^.~^ / .. This represents essentially the same amount of encroachment into the wetland area as for the proposed residence. The i ti t one time as can be observed behind the pond where building debris and junk are located and a former barn was located. Mr. St. Onge has begun to remove this debris from the wetlands in the rear of his lot. The impact to the existing wetland system is insignificant whereas the most significant impact is the limitation of wetlands for residential construction. The most significant restriction is that of groundwater in relation to foundation drainage. The proposed house is to be elevated a minimum of 1.5 feet above existing grade an a minimum o . . This should be considered a new application in that additional information is provided. 2. The total fill to be placed in wetlands remainsCai C. Y. as discussed above. r7k 3. The pond does in .fa(-+ cross the aroperty boundary as shown s on the plans. G 4. The letter report is attached as part of the application. 5. In response to Mr McCahill 's Conditions of Approval I offer the following: 1. The plans have been revised to reflect the silt fence extending to Foster Road. ✓2. An area has been designated on the plans for a stockpile of excavated soils. I trust that you find this information helpful and please indicate if additional information is required. Meehan Associates 387 N. Main Street Manchester, Connecticut 06040 Dear Mr . Meehan : On May 24, 1988, at your request , I delineated the wetlands , as defined by Connecticut General Statutes Section 22a-37( 15) , i . e. , those soil types designated as poorly drained , very poorly drained , alluvial , or floodplain by the National Cooperative Soil Survey , on a parcel of land of Mark St . Onge , 90 Foster Road , South Windsor . CT. Soils were examined to the extent necessary to classify them at the soil series level according to the system of soil classification used by the National Cooperative Soil Survey (Soil Survey Staff , 1975, Soil Taxonomy, U. S. Government Printing Office , Washington , D. C. ) by exposing soil profiles with a spade and auger . The majority of the site was found to be wetlands as defined • above . The only exception was a small "strip" of land adjacent to the Foster Road_ . The poorly drained soils (wetlands) were identified and delineated by placing flags numbered Al through A8 on vegetation along the boundary separating these soils from the small strip of better drained soils . This most likely occurred as a result of the construction of the pond that occurs on the site . A very small area of poorly drained Walpole soils occurs in the eastern most portion of the lot . St. Onge 90 Foster Road South Windsor, CT 06074 Dear Mr. St. Onge: Re: Application #89-40W, Construction of a single family home at 90 Foster Road, South Windsor At the July 10, 1989 meeting of the South Windsor Inland Wetlands Agency/Conservation Commission, the Commission voted to deny Application #89-40W - IWA/CC permit for the construction of a single family home on property locatdd on the easterly side of Foster Road and northerly of Ellington Road, RR zone. The concerns expressed by the Agency are: 1. The proposed building being put in wetlands, disturbed and filled. 2 . That the wetlands had been disturbed for the purpose of constructing a house on this site. 3. That there would be other prudent and feasible alternatives to accomplish this purpose had the applicant sought professional assistance. 4 . The applicant offered no mitigation or wetland area enhancement measures to offset his desire to build within wetlands . Very truly yours, ` John M.
