McCahill, Zoning/Wetlands Enforcement Officer i Re: Application #92-28P, Pin Oak Estates DOCUMENTS REVIEWED: Application form, Plans for Pin Oak Estates (dated July 10, 1992, revised July 31, 1992) and previous application COMMENTS: 1. This application was submitted on July 31, 1992. Based on Section 7 .8 of the Inland Wetlands, Watercourses, and Conservation Regulations the, "plans shall be officially received at the first regularly scheduled meeting of the month, providing such meeting is no earlier than three business days after submission; or thirty-five days after submission, whichever is sooner. " As we have no meetings scheduled in August the official receipt date is thirty-five days after submission which is September 4, 1992 . 2. This property was the subject of application #89-54P which was denied on October 30, 1989 but, through the legal process, was sent back to the Inland Wetlands Agency/Conservation Commission. At the July 15, 1991 meeting the Agency approved a motion to, "move that pending litigation, known as Fairway Estates vs . IWA/CC be settled. . . " . The plans currently submitted represent 4 lots with two common driveways. The previous plans for application #89-54P showed 5 lots and a short road with a cul-de-sac. 3 . A copy of plans showing the basic layout approval as part of application #89-54P should be submitted with this application for the purpose of discussing alternatives considered by the applicant. 4 . Note #10, on sheet 1 of 9, indicates that "inland wetland boundaries were field delineated by Northeast Soils, Inc. on December 3rd, loth, and 11th of 1986" . Copies of the soils report should be submitted with this application. 5 . It would appear that they are intentionally leaving access to the remaining "other land of A.B. Realty Corp. , 40 . 9 acres" between lot 1 and the Mongeon property. If they have future plans for this remaining property a preliminary, or concept plan, should be submitted with this application. I Elizabeth A. Warren Page Two August 5, 1992 Application#92-28P 6 . The proposed common driveway for lots #3 and 4 -would appear to create a ponding situation northeasterly of the proposed driveway. There is a small intermittent watercourse that feeds into this area. Drainage calculations should be submitted which address the potential ponding problem in this area. 7 . In the previous application a "Natural Resources Inventory and Impact Assessment" was accomplished and submitted. It would seem that such a study should be submitted based on the current proposal . 8 . Drainage calculations should be submitted for this application. 9 . The previous application (#89-54P) for this site included . 05 acre of wetlands to be altered and 100 lineal feet of proposed stream alteration. This application (#92-28P) represents .12 acre of wetlands to be altered but, there will be no stream alteration. 10. Sequence house construction note #6, on sheets 6 and 7, indicates a yard drain will be installed for lot #4 only. This is actually a "shallow well drain" and a detail is provided on sheet 8 . 11 . The critical areas, as identified on sheet 9 of 9, include entrance/exit to the site, dust control, and driveway through the wetland. The erosion control plan, as detailed throughout the plans, appears to address these concerns . 12 . A note should be added to the plan which states that there shall be no direct travel of construction equipment from lots #1 and 2 over to lots #3 and 4. Construction equipment shall not travel across the wetlands between these lots. 13 . The plans do not show the existing tree line for the site. This should be shown. The houses appear to be located in open areas but, any changes (ie. clearing for site line) should also be shown. 14 . Stumps, in the event that tree clearing is determined to be necessary, shall be chipped on site or removed from the site; not buried. This should be noted on the plans . There is a sma-1 1 watercourse- that r i s$s. in the northeast corner of the site near Nark Street, and carrys flow direct Ty to the Podunk upstream of- the site. Soils A high--intensity on-site soil survey and we-t 1 and boundar-y d-el fneation has been conducted by :Northeast Soils (dopy attached) . The predominate upland soil east of Plum Gulley Brook is Elmwood, a moderately-welt drained outwash sail underlain by lake bottom silts and clays at a depth of 24- 48" . There is also a small area of Terrace Escarpment, consisting of sands and clays on steep slope. Vey-etat i on - Although relatively small , the 13 _acre p-arceT is rather diverse, with old f i-eld, mixed hardwood and pine- forest uplands, as well as several wetland types. Each plant community is described below, and a complete floral spe-cies list is shown in Appendix A. U_p 1&nds 1 . Old Field- Most of the Phase 1 area is an agricultural fi.cld which . has become overgrown with common su.cces.sional grassers, forbs, and shrubs. Goldenrods, Queen Anne' s Lace-, L i tt Te B l uestem,. brambles, M.0 1 t i-f 1 ora rose, arr-d R.ed Cedar are common, as we-11 as some moister environment p:la.hts such as: Meadows..-eat, Silky Dogwood, Smooth- 41-cam, wand w-f l l ows. -3- 2. Mixed Hardwood Forest- This plant community is found on a slope on th-e northern edge of the parcel . Red and white oak, S-hagtrark Hickory, Sugar Maple, and Black Cherry are common, with Map-le-leaf Viburnum, Ironwood, Silky Dogwood, Wi-tch- hazel , HavO-horn, and Japanese Honeysuckle in the und-efstory. 3_ Mix-e-d Softwood Forest- This community is just east of the Tn-x-ed_ hardwoods on the northern propety l ine. Young white pine- and white spruce may represent an abandoned nursery, or Christmas Tree farm-. Re-d maple, wild grape and Pr i.nces-s Pine. have- also i-nvaded this area, which is good quality wi ldlife hairitat due- to the dense cover.. WETLANM Wetland sails. through-out the property include Saco and S-c-antic silt loans and shallow Peats and Mucks . The Saco s-ol 1 is very pear ly-drai-ned, and found throughout the fl oodp 1 ain of Bath major watercourses. The Scant i c soil is a poor Ty-dra i rred lake bottom soil found in several of the swales and intermittent drainageways-. The Peats and Mucks are found in- small ponding areas (i-n the Phase 2 area) that hav* restricted out.l ets. and may re.presecmt small ice-block ponds or "kett l e- hoT-es". For more detail on soils see attached report of Northeast Soils . Four wet.l habitat types are present in the Phase 1 area. The-ir value i n terms of f 1ood storage, ecological integrity, water qua it.y renavatio'n, and aesthetics is high. The Pl-um Gulley Brook wetlands are a mosaic of habitat types, amd also includes warm-water fish and aquatic habitat. They are. 7not significant groundwater recharge areas, and the recreational and educational potenti-al along Plum Gulley Brook is limited due to difficult access.. The small swales and intermittent tributaries leading* to this major wetland are generally not as significant. They function primarily as drainageways, conveying surface runoff and groundwater discharge from the uplands to the streams. The wooded swamp, wet meadow and channelized waterco-u.rse in the center of the site have been largely disturbed, and t.he-ir ecological integrity and habitat va_lu.& i-s reduced. They are in the center of an old field, and -thus not a significant aesthetic resource. The small kettTehole wetland has moderate ecological integrity, but its habitat. and other values are limited by its small size. The lower (marsh) portion of the nearby watercourse has searsonal to year-round open water , an-d is large enough to serve a localized habitat function for wet land-dependent and aquatic birds, mamcmal s,_ and herpt i l es None of these wetlands is an important recharge area. Wetland Impacts D i-rect impacts on wetlands as a rs-s_ul t o-f the proposed Ptras-0 1 construction will be limited in extent. The proposed 6 lot sub-division and cul-de-sac road will require only one w.etl-a-nd- cross i n-g. The common drive and utility access corH-d.or f-or Lots 3 and 4 -will cross the narrow intermittent waterco-urs-e. -8- A 60' long culvert will be installed to carry the existing flow. This crossing appears to be unavoidable to access this portion of the site, and is located at a very narrow point in the wetland system. As noted above, this watercourse appears to be an old agricultural drain with woody wetland vegetation developed along its margins. The culvert crossing will interrupt a wetland corridor of limited significance. The primary function of this area is as a drainageway, and will not be significantly impaired. This area has a minor function as a wildlife movement corridor, and there will be a minor adverse impact on .this function. Recommended mitigating measures include constructing the utilities in the drive and reducing the culvert length ( if determined to be feasible by the engineer) . There is no wetland filling required for lots. Potential indirect wetland impacts of this (or any other land use, including agriculture) are associated with sedimentation, stormwater discharges, and upland clearing. Due to th-e small size of the project, these impacts should be limited. The- earthwork in the .vicinty of wetlands is limited to a 4 ' i cut at the end of the cul-de-sac, and installation of a single storm sewer outfall and plunge pool . This activity will occur within Elmwood soils, with a low to moderate erosion hazard. Provided work occurs within the soil/subsoil , -and does not penetrate into the underlying clays, this icons truction will not have a noticable impact on the nearby wetland. Consideration should be given to installing a temporary sediment basin in area of the plunge pool until the road base and binder course are installed and the area is stabliized. The small volume of stormwater generated by the short road should be able to be safely assimilated by the wetland. -9_ I Water quailty renavaation is a natural function of wetlands. Preservation-,of, wetland edge and old- field/brvs-h hab-itat Woul.d reduce the impacts on these and other speci-es of wildlife— This can be acc&np 1-i shred by placement a-f corgmrv-at i an easements on the wet 1 an.ds and a portion of t#re abutting uplands in certain areas . These are illustrated on the attached plan. Planting wildlife. attractive native trees , shr-ubs and grasses in disturbed areas and use of native spe,c.i es in site 1 ands.cap i ng can i ncr-ease the attract i ven- ss of the a-r-ea to wildlife, and promote re-po-pu 1 at i..on of the area in the post-construction period . CONCLUS I OtM The site contains several small wetlands tributary to Plum- 'Gulley Brook. These include wet meadow, wooded swamp, shrub swamp, pond, and marsh, as well as woodlan-d and old field/brush habitat in the uplands . Due to the di-v-ersity of habitat types present, the area supports a wide variety of wetland and upland wildlife. Residential development unavoidably will result in loss of -old field and brushy edge. Impacts can be minimized by prey-e-rvatton of ed4es, and discrete blocks of wildlife habitat of one- acre or more in size. Once the lots have pas-sed into homeowner control , a conservation eas-ement is a viable method of controlling cumulative adverse impacts . It shoud be noted that wildlife - impa-cts would occur with any change in land use at the site. The present combination of wetlands arrd past-a-gricultural succession has a high value for many species of birds, sma1T mammals and herptiles. The previous active agricultural use was not protective of these wildlife values. The most significant individual wetland at the- site is the P 1 um Gu 1 1 ey Brook corridor . The plans has been- laid out -n- a manner compatible with the ent.ire site, so that future intrusion . into this Brook- area during Phases 1 and 2 and regradi-ng on the adjacent, steep TE s-ai-Is has been effectively minimized.. The only direct impact i_s crossing of a -12- cha:nrreliz ed intermittent watercourse with minor functional significance. This will have a negligible impact on the ov_erall wetland values at the site, based on the assumption of. pro-pe-r inst:allat.ion and maintenance of erosion controls , and , drp season const.ru.ct f-on in wet 1 ands.
