RE: Application #90-23P, Fairway Estates
DOCUMENTS REVIEWED: Application form and Fairway Estates
Subdivision Plans for lot one.
COMMENTS:
1 . This application is for subdivision approval to create lot one
which is a 1 . 15 acres lot with an existing house. On lot one
there is .04 acre of wetland. The application also includes the
removal of the existing barn and miscellaneous debris which exists
adjacent to the wetland area.
2. Other applications on this property include application #88-113P,
Pin Oak Estates (denied 3/13/89 ) and #89-54P, Pin Oak Estates
(denied 10/30/89 ) . Application #89-54P is currently in litigation
but this should have no bearing on the applicant's desire to cut
out lot one to sell the existing house.
3. Note 10 states, "Inland Wetlands boundaries were field located by
Northeast Soils, Inc. on December 3, 10, 11, 1986" . A copy of the
report should be submitted for this application.
4 . There are two structures which are "to be removed" . The material
from the two structures should be removed from the site and
disposed of in a proper manner. On March 29, 1990 a permit was
issued to disassemble the barn for salvage. They were advised to
do no earth work or removal of the foundations until this
application was heard by the Commission.
5 . Some minor grading should take place in the areas where the debris
and structures are to be removed. A note should be added to state
that grading is limited to that which is necessary to blend into
existing grades .
6 . A permanent means of vegetative stabilization should be identified
for the areas adjacent to the wetlands .

RE: Application #90-23P, 523 Clark Street
Dear Mr. MaCahill:
Attached please find three complete revised copies of the
subdivision plan for property located at 523 Clark Street and
owned by Fairway Estates. The attached plans have been revised
in accordance with the comments made by yourself, the Planning
Department and the Engineering Department. The revisions are
specifically noted as follows:
1. The northerly setback line has been changed from a
201S.Y. to a 501B.L. as the subdivision has been designed to
accommodate a potential future road along this proposed lot
line (see sheets 1 & 2) .
2 . A ,note has been added regarding the "FUTURE UTILITY
EASEMENT" (see sheet 1) .
3 . NQ widening of Clark street is proposed as part of this
subdivision given there is no change with the access to the
existing house.
4 . Three notes have been added to sheet 2 regarding:
A. disposal off site of material from the structures to
be removed.
B. limits of grading.
C. permanent vegetative cover.
Also attached is a copy of the soils report dated December 11,
1986 prepared by Northeast Soils, Inc. , for the subject
property. If you have questions or need additional information
on the revisions, or any other item regarding this application,
please call me at the number above.

Re: Application by Fairway Estates Partners
523 Clark Street, South Windsor
Dear John:
Either myself or Robert Isner will appear on behalf of the applicant
this evening. Both of us, however, have conflicts with matters that
commence prior to 7: 30 PM. We would ask that the above application
be moved as far back on the agenda as possible since it is likely
that neither of us will be able to arrive until 8: 30 PM.
In the event that the application is reached on the agenda prior to
either of our arrivals, I would ask that the application be discussed
by the Commission. The applicant is seeking to have the existing
house sold and it is necessary to obtain subdivision approval in
order to do so because of conveyances by the prior owner out of the
original parcel.
Mr. and Mrs. Robert Mongeon, - of South Windsor, want to purchase the
house for the purpose of completely renovating the premises as a
residence for a family member. In accordance with the notes on the
map enclosed, all existing outbuildings are proposed for removal, as
well as debris on the premises. No improvements to Clark Street are
proposed since no additional lots are included in this application.
Improvements to Clark Street are proposed as part of the development
of the remainder of the property owned by Fairway Estates partners.

No work is proposed within wetlands. Approval is requested for
activities to be conducted within the buffer zone associated with
removal of the outbuildings and debris. Because of the straight
forward nature of the application, and the desire on the part of Mr.
and Mrs. Mongeon to commence renovations, I would ask that the
Commission review and consider this proposal without delay. If there
are questions that need to be answered by either myself or Mr. Isner,
then please table or postpone the matter as necessary.
Thank you for your consideration.

At the regular meeting of the Inland Wetlands Agency/Conservation
Commission held on April 23, 1990 application #90-23P, Fairway

involves land which was a part of Application #89-54P, Pin Oaks

Commission requests your advice as to whether or not we can hear and

Dear Jim:
Based upon the documents provided with your memorandum,
my. conversation with John McCahill who believes the two
applications can stand on their own separate from each other,
and that it is a new and different application, it is my
opinion that you can hear and act upon application #90-23P

Further , pending litigation does not preclude hearing
and acting upon a new and different application even if it
concerns the same premises .
Accordingly, you are free to proceed with application

Re: 523 Clark Street, placement of fill
It has come to my attention that several loads (approximately 250 -
300 cubic yards) of fill have been placed on the property referenced
above. This activity may require a permit from the Planning & Zoning
Commission and/or the Inland Wetlands Agency/Conservation Commission
(if wetlands will be impacted) . In some situations the Town Engineer
has the ability to allow regrading of a residential lot, providing he
inspects and approves the operation before and after regrading takes
place.
Activity on the site should cease immediately until such permits or
approvals are obtained. In addition, you should ensure that the
material that has been placed on the property is stabilized to
prevent future erosion problems .
In addition, the IWA/CC permit (#90-23P) granted for this site for
the removal of the existing barn and miscellaneous debris along the
slope will expire on May 21, 1991 .
Please contact me as soon as possible and we will schedule a meeting
to resolve these issues .
