ADDITIONAL LAND ON KENNEDY ROAD FOR ROADWAY SERVICES ' I have conducted an on-site soils investigation of the property located on Kennedy Road in South Windsor, Connecticut. This is additional land for Roadway Services. The principal purpose of this soils investigation was to locate and flag in the field ' all poorly drained and very poorly drained soils or ,wetlands" as defined under the Inlands Wetlands Act. In this soil$ investigation and report, the classifications of the soils, soil textures, descriptive terms, and drainage classifications follow the ' guidelines and criteria of the National Cooperative Soil Survey.. ' FINDINGS---- Ilie only area of natural soils occurs just south of the building next to the open field owned by Roadway Services. 'ilia soils were moderately well drained and ' consist of tho Sudbury fine sandy loam. These soils }lave a sand profile throughout. Only two holes were dug because the area of natural soils is very limited. bJos.t of the land south of the existing building consists of a packed gravel parking ' lot. Ilia gravel is approximately .1 foot above the surrounding soils off the proporty. It is very compact and is obviously dry and useable for parking of all types of vehicles. The building itself with a paved area in the front occupies a large section of the ' property. The land north of the building is completely filled and paved and is sur- rounded by a chairilink fence.to the very edge of the property line. ' Tile roadway property had been checked and there were no obvious wetlands nor indication of wetlands off the property to the north. It appears that most of the filling was done to create a level area and provide a good base for the pavement. Therc arc no wetland soils or wetlands on the property. TO: Mr. Stephen E. Cote ' Acting District Conservationist USDA-SCS - 627 River St ' Windsor CT 06095 Dear Steve: ' On March 19, 1990 I performed an on-site investigation of the soils on the 1.18 acre Roadway Services, Inc. property off Kennedy Road in the Town of South Windsor. I was requested by the Town Inland Wetlands Agency to review ' the finding of Henry T. Moeller, Soil Scientist; that there were no wetlands on the parcel. ' A large portion of the site consists of Urban Land; non-soil areas covered with a building and parking lot. Areas of- soil -(south of the building) on the 1.18 acre site were examined with spade and auger and, found to be ' dominately moderately well drained. Thus I agree with Mr: Meller's report dated Decenber 7, 1989; there are no inland wetland soils or watercourses on this small parcel. ' Sincerely, ' Kipen J. Boston, Project Manager (dated May 21, 1990) and documents submitted bound together (tabs A- G and A-H) . COMMENTS: 1. The plans submitted include the total land area of 39 .10 acres. In the letter from Richard L. Boston, Project Manager (dated May 21, 1990) as part of this application they are requesting a reaffirmation of the property subject to application #89-79P (approved April 16, 1990) and are submitting the new Inland Wetlands Agency/Conservation Commission application for delineation of wetlands on the 1 . 18 acres parcel (motion to approve failed May 18, 1990) . 2. This application is for an amendment to the Town of South Windsor Inland Wetlands and Watercourses Map (dated 1984) for property on Tax Assessor's Parcel Number 63-22, east side of Kennedy Road (46 Kennedy Road) and reaffirmation of the decision on Parcels 63-21, 73-1, 73-2, 73-15 and 73-4 (partial) along northerly side of Sullivan Avenue. This request is based on the findings of Henry T. Moeller, Soil Scientist. His letters and boring logs have been submitted. Henry T. Moeller's findings on the 1 .18 acres piece (parcel 63-22) have been corroborated by Ripen J. Kolesinskas, Soil Scientist, S.C.S. i 20, 1990. n a letter Sated March 3• The 1 . 18 acres piece (parcel 63-22) is fairly extensively developed and there are no obvious indicators -of wetlands on the site. Lombardi, Chairman Town of South Windsor Inland Wetlands Agency / Conservation Commission 1540 Sullivan Avenue South Windsor, CT 06074 RE: Services Development Corporation Applications 90-34P, 90-45K Dear Mr. Lombardi: As you know, I represent John J. Woodcock, Jr. in connection with the Services Development Corporation matters pending before the Inland Wetlands Commission. Recently my client received two letters from Fuss & O'Neill, representatives for Services Development Corporation, concerning the hearings on two applications that have recently been filed. The Fuss & O'Neill letters providethat the applications will be heard on June 11, 1990. One application is for a map change and the other for an Inland Wetlands permit. The map change application by statute must be heard at a legally advertised public hearing before your Commission has the authority to take action on same. In that this application has not been formally submitted to your agenda, it is obvious that it cannot be heard on June 11, 1990. Therefore, the Fuss & O'Neill letter, a copy of which I enclose, is obviously in error as to the public hearing being held on June 11, 1990. A more serious note is the question of the legality of these matters being included on the June 11, 1990 agenda. I have been advised by Town Staff that the two applications were received on the afternoon of May 21, 1990. I direct you to Section 6.5 of your Commission's regulations which requires that all applications must be submitted no later "than 12 o'clock noon at least 14 working days prior to the first regular monthly meeting in order for the application to qualify for inclusion on the agenda". These two applications cannot be placed on the June 11, 1990 agenda for two reasons: fIIL CCNSIZETING SERVICE.. r HENRY A. rit/ { s pal, I OF KUtt.S NIu. RITTRNBAND ATTORNEY AT LAW 17 5 0 1734 ELLIN(iTON ROAD SOUTH WINDSOR,CONNECTICUT 06074 (203)644-2456 JUN 6 1990 South Windsor INLAND WETLANDS AGENCY/ CONSERVATION_COMMtSS 0 June 5 , 1990 Mr. James Lombardi, Chairman Inland Wetlands Agency/Conservation Commission Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Re: Services Development Corporation; Applications filed on May 21 , 1990 Dear Jim: I am in receipt of a copy of a letter to you dated May 25 , 1990 from Attorney John Woodcock concerning the above, and since I have , therefore , become aware of the legal issues involved, I believe it is necessary for me to provide you with a legal opinion concerning such issues . It is my understanding that the applications were physically received at the Town Hall subsequent to 12 noon on May 21 , 1990. Section 6. 5 of the Regulations clearly requires submission "no later than 12 o' clock noon" , that day. Therefore , May 21 , 1990 cannot be included in the 14 working days mentioned in the regu- lation. Further, for several. reasons, l the date of the meeting , June 11, 1990, cannot be included. Accordingly, the applications do not meet the requirement of Sec. 6 . 5 to be submitted "no later than 12 o' clock noon at least 14 working days prior to the first regular monthly meeting in order for the application to qualify for inclusion on the agenda" . The application, under the above circumstances, was submitted 13 , not 14 , working days prior to the first regular monthly meeting . ltoo lengthy to elaborate upon here , but suffice it to say that the majority body of law does not allow the date of the meeting etc . to be included; and further, working days exclude Saturdays , Sundays and legal holidays , but the day of the meeting is a working day right through the meeting itself and cannot be considered one of the 14 prior to the meeting. r - page 2 - June 5 , 1990 This lack of compliance with Sec . 6 . 5 applies to both appli- cations . The application for boundary or map change or exemption is governed by Sec. 3. 1 through Sec. 3 . 4 . However , Sec . 3 . 1 refers to the Application Procedure starting with Section VI (6) or Exemption Procedure Section 3 . 3 . Sec . 3 . 3 is silent on the issue of timing for submission and Sec . 22a-42a (b) of the General Statutes , which I cited in my May 18; 1990 opinion concerning the 90 day extension, is silent on the issue of timing for submission . There- fore, 3 . 1 refers to Section 6., including Section 6 . 5 , as to this issue; and, therefore, the aforementioned 14 day requirement applies to the boundary/map change/exemption. The requirement of 1`4 working days prior to the first regular monthly meeting has not been met for the month of June . It has been met for the first regular monthly meeting of July. Accordingly, it is the agenda of the first regular monthly meeting of July, 1990 on which these applications should first appear. Very truly yours , Richard M. The point I wish to make for the record is that 90-45W should have appeared on your June 11, 1990 agenda and a public hearing scheduled on that date for later in the month of June. I realize that said application was deleted from your preliminary agenda by your attorney, Mr. Rittenband, for whom I have the highest regard. Unfortunately, in this case, I disagree with his interpretation of your regulations and I want to be certain that the record reflects no acquiescence on the part of the applicant. Our request or suggestion is as follows. Given that Applications 90-45W and 90-34P will first appear on your agenda on July 9, 1990, and given that you commonly recess for the month of August, it is possible that no decision will be reached in either case before September or perhaps October , 1990. That brings us to a full year since my clients first came before your Commission. It probably also means tht my clients will miss this building season so it is really a delay until spring of 1991. I believe that the circumstances of the past months which have led to this result are not the fault of Services Development Corporation and make such a result extremely unfair. Gft- $imbaum PC. This is to request that you complete your work on 90-45W and 90-34P during the month of July. It can be done as follows: July 9, 1990 : 90-45W appears on agenda; Commission sets public hearing and special meeting for July 30, 1990. 90-34P appears on agenda; Commission tables to special meeting July 30, 1990. July 10, 1990 : Mr. McCahill delivers to Journal Inquirer legal notices (enclosed herewith) to be published first on July 12, 1990 (the Journal Inquirer needs two days lead time) 18 days in advance of the public hearing (statute requires 15-25 days) and second on July 23, 1990 (more than two days after the first notice and more than two days before the public hearing) . July 16, 1990 : Regular meeting of the Commission. Representatives of Services Department Corporation will be present to answer questions, supply information, make a list of concerns to be addressed at the public hearing (since the Commission is quite familiar with these applications I do not anticipate many questions but we will, as before, cooperate with the Commission) . July 19, 1990: Copy of boundary change request filed in Town Clerk 's Office as required by statute. July 30, 1990: Public hearing opened, conducted, and closed on 90-45W. Special meeting held immediately thereafter to decide on 90-45W and 90-34P. Adjournment and vacation for one month with Services Development Corporation action completed. This procedure calls for unusual focus on these two applications during July. However, they are not new. You know them well. Staff knows them well. What is needed is not a major substantive review but rather a procedurally accurate review. I also recognize that a public hearing and special meeting on July 30 is an imposition on members of the Commission whose time is already severely taxed. But I ask it as a matter of fairness on behalf of clients who have come to South Windsor from Akron, Ohio many times since last fall when this process started. -2- Gft $imbaum pC. A final note -- I have full responsibility for this request. Marcia Banach Town Planner Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 - Re : Letter from David B. Losee dated June 12 , 1990 and Intervention Statement from John J . Woodcock, Jr. dated June 18 , 1990. Dear Marcia: This is in reply to your Memorandum received this past Fri- day requesting a legal opinion concerning the above . As to the time frames specified in Attorney Losee ' s letter, I believe they are legal ._and proper. I presume application 90-45W concerns the boundary change. The times suggested for the publication, July 12 , 1990 and July 23 , 1990 are in compliance with the statute, and all of the other time frames are correct . I would suggest , however, that the filing of the copy of the boundary change requested be done by July 17th rather than July 19th so that there is no question as to the time frame . July 19th I believe to be proper , bu.t July 17th would be better. As for application 90-34P , this time frame is also correct . The intervention by John J. Woodcock, Jr. and his Intervention Statement are legally correct in accordance with the applicable General Statutes.. He is , therefore , now an intervening party concerning both applications . The Intervention S tat emen-t--iz:_.a.,writ ten request for notice in compliance with Section 1-21c of the General Statutes . Under said section, he is to be given notice by mail of each re ular meetin at least one week prior to the date set for the meetinZ . The same is true or any special meeting unless special meeting is called less than 7 days prior to the date set for the special meeting in which case the Agency must give such notice as it deems practical . Which means at the earliest possible time . This is in regard to regular and special meetings page 2 - June 26 , 1990 which would include public hearings regarding the above-mentioned applications . Under Section 1-21c , it does not mean notice of 'other doings" . It applies only to the meetings , and I 'm not sure what is meant by "other doings" . Under Sec . 1-21c , however, notice of regular and . ,special meetings and public hearings which is a special meeting must be given to him as aforesaid. As for Sec. 1-15 of the General Statutes , he has applied in writing by the Intervention Statement as required . He is entitled= to plain copies of all applications , correspondence , memoranda , plans, studies and supporting data previously submitted and hereafter submitted or presented to the Commission in connection with the above applications since all of these are public record . It would seem to me that only preliminary notes are exempt from disclosure and then only if the Agency has determined that the public interest in withholding such documents clearly outweighs the public interest in disclosure . In sum, it- appears that all of the above are public record and he is entitled to plain copies of same "promptly". -' Further, under Sec . 1-21i of the General Statutes , failure to comply with his request to inspect j or copy such public record within 4 business days is deemed to l be a denial w is , o course , in re erence to the -above records is ille al. As for the mailing of notice, the Agency may establish a reason-- able charge for sending such notice based on the estimated cost of providing such service and as for the fee for copying public records , I refer you to Sec. 1-15 as to the rate schedule . .As to his request to be provided with an opportunity to be heard and participate in all proceedings where applicable , as an intervening party, he is entitled to do so to the extent that the applicant is. Therefore, he may be heard and participate in the public hearings and if there is an opportunity for the appli- cant to be heard at the regular or special meeting other than the public hearing, he should be afforded the same right or opportun.it- It is my understanding that the Agency, in the past , has allowed both of these parties to speak. Brady % South Windsor Inland Wetlands Commission 1540 Sullivan Avenue South Windsor, CT 06074 RE: Services De t Corporation Applicati s 90-4 , 90-34 Dear Ms. Brady: John J. Woodcock, Jr., a party - intervenor in these matters pursuant to Connecticut General Statutes 22A-19, hereby demands that you recuse yourself from any further involvement, action or deliberations with respect to the Services Development Corporation applications, 90-45 and 90-34, now pending before the South Windsor Inland Wetlands Commission. His demand is predicated on your bias, prejudice and predisposition as to him, the undersigned and his daughter-in-law, Carla C. Woodcock. Attached hereto is a copy of a Letter to the Editor of the Journal Inquirer that was sided,by you and published in. that newspaper on July 16, 1988. The letter speaks for itself, but for purposes of this motion, suffice it to say that it expresses extreme animus to Mr. Woodcock, the undersigned and Carla C. Woodcock, none of whom have ever had any contact of any kind with you prior to your publishing this letter. It is further claimed that your continued participation in these applications would be violative of the By-Laws of the South Windsor Inland Wetlands Commission and the South Windsor Code of Ethics. The South Windsor Inland Wetlands Commission By-Laws provide in part that: "No member of the Agency shall participate in the hearing or decision of the Agency-of_:whiob_,he is a member upon any matter ' in which he is directly or indirectly interested in a personal or financial sense. Conflicts of interest not only involve the actual abuse of authority or when, a member acts upon any matter in which he is directly or indirectly involved in a personal or financial sense, but also involves those situations where there is an erosion of the public trust, or a situation Ms. Brady July 2, 1990 Page 2 is created tending to weaken public confidence and to undermine the, sense of security of individual rights. Thence, as to the possibility or potential of conflict of interest, the Agency member must consider whether his participation in this matter is causing or may tend to cause the public to lose confidence that the decision made on the pending matter will be made fairly." (Article 4 By-Laws) The South Windsor Code of Ethics provides in part that: "No Officer, Official or Employee of the Town shall inten- tionally or with reckless disregard for the particular situation in question engage in their official Town capacity in any manner which would create or result in a conflict of interest. The existence of a conflict of interest shall be determined on a case by case basis. The person or persons making such determination shall be bound to apply the general standards of reasonableness (as such standards are customarily applied by the Courts of the State of Connecticut) to the relevant facts in each particular case as they relate to the criteria set forth in this code of ethics hereinafter." The official record of the South Windsor Inland Wetlands Commission shows very clearly that you have time after time been supportive of Services Development Corporation's applications in a most vocal and active manner. Should you not recuse yourself from the pending Services Development Corporation's applications, it is my client's intention to file a formal complaint with the South Windsor Ethics Commission and to pursue whatever legal remedies he has available to him. These applications are scheduled to be introduced to the South Windsor Inland Wetlands Commission on July 91, 1990. Your response to this letter and the demand contained therein by said date, would be much appreciated and most appropriate.
