I will be away until approximately July 10 on a brief vacation with my children; in my absence please contact Ken Petersen of GARDNER & PETERSEN, engineers in Tolland with any questions you may-have concerning this subdivision or the plan. Mr. Petersen can be reached at 871-0808. As you know, the only meeting of the South Windsor Inland/Wetlands and Conservation Commission during the month of July will be on July 15 and we would appreciate being able to pick up the approval and any recommendations on or about July 11. Once an approval letter is ready, please call Mr. Petersen and he will arrange to have it picked up and_ in his absence you may call my office and speak to one of the secretaries and they will arrange to pick up the approval letters and deliver them not only to the Town of South Windsor, but also to the developer. A detailed grading plan indicating the proposed house, driveway, utilities and associated grading should be submitted for lot 31 . Assessment of impacts to wetlands and feasibility as a suitable house lot can be determined more accurately with this additional information. Extra precautions will need to be taken in development on those soils which are highly erosive (see accompanying limitations chart). Existing woodland should be preserved wherever possible. Parker District Manager CC: Wayne Gerit CC: Al Kupchunos CONSERVATION — DEVELOPMENT — SELF-GOVERNMENT •'"• United States 8011 340 Broad Street Department of Conservation Agriculture Service Windsor CT 06095 Phone 688-7725 JUNE 20, 1985 SITE REVIEW FOR: RAINBOW HILLS - ELLINGTON RD, SOUTH WINDSOR CT PREPARED BY: J. ERIC SCHERER, RESOURCE CONSERVATIONIST U.S.D.A. SOiL CONSERVATION SERVICE On June 17, 1985, a site review was conducted for the proposed subdivision "Rainbow Hills" on Ellington Road in South Windsor, CT. In attendance were Mr. Al Kupchunos and myself. FINDINGS: This proposed subdivision includes the development of approximately 37 acres into 33 single family lots. Over one mile of road Is proposed as well as associated storm drains and pipes. The area will be serviced by sanitary sewers. The Soil Survey of Hartford County l.ndicates that ten soil types exist on this site. These ten soil types include: Cheshire fine sandy loam (CsB2); Enfield silt loam (EsA); Enfield silt loam-eroded (EsB2); Manchester gravelly sandy loam (MgC); Melrose very fine sandy loam (MnA); Narragansett silt foam-eroded (NaB2); Narragansett silt loam-eroded (NaC2); Narragansett stony silt loam (NgC); Saco silt loam (SbA); Terrace Escarpments-sand and gravel (Tg). CT Public Act 155 list SbA as an Inland Wetland Soil . It appears that some past filling has taken place since the Soil Survey was completed in 1962. A watercourse does exist In this area and under PA 155 is considered an inland wetland. Approximately 70 percent of the site is classified as either Prime Farmland or Statewide Important Farmland. The land is presently in a small grain cover. The proposed soil erosion and sediment control measures appear adequate on. the site plans. Additional measures may be needed to ensure adequate protection on-site and reduce any off-site hazard. These additional measures are discussed In the Reccomendation/Comments section of this report. RECOMMENDATIONS/COMMENTS - A 50 foot buffer strip should be established and maintained on either side of the existing watercourse on lot 31. Some additional channel protection may be needed along the streambanks (i.e. rock riprap) if increased velocities are expected. Some consideration might be given to piping some of this channel as it exits Ellington Road. - A sequence of construction activities and erosion and sediment control measures should be established. The first activity to begin at the site is the construction and stabilization of the proposed retention structure in Parcel A. This should be done prior to any other earth moving activity. 0 The soil Conservation Service Is an agency of the vUnited States Department of Agriculture ' ,, d us.Government Printing office:1988-420.939/1878 FOR: A. Bowen Davies, South Windsor 6/20/85 RE: Rainbow Hills, Ellington Rd, South Windsor page -2- - The retention structure could serve a dual purpose and be used as a sediment basin also. The placement of a filter around the opening of the outlet for the structure would aid in reducing the chance of sediments leaving the site. It is evident that there is already a current sediment problem in the existing channel . Town officials should be made aware of this to find the cause and seek a solution. A synthetic fabric filter may also prove to be more effective at the proposed outlet of the retention structure. - Additional soil erosion and sediment control measures that should be considered include: construction entrance pad; hay bales around catch basins; protecting stockpiled material by perimeter hay bales or seeding piles; list of temporary seeding mixture and measures; permanent seeding mixtures and dates of application. The "CT Guidelines for Soil Erosion and Sediment Control" lists both standards and specifications for these practices and many more. Reference should be made to this publication in planning and designing adequate control measures. Plans dated 5/31/85 (revised to 6/28/85) would, for the most part, meet the requirements of Public Act 83-388. The following additions should be incorporated into final plans: Sheet 4 Add hay bales or silt fencing at tow of slope along western side of Windy Hill Drive. Revised plans indicate a steeper. cut- to this road than original plans. If a less steep grade can be achieved for the road and sideslopes, sediment and erosion control can be achieved' easier. Sheet 5 Continuous hay bales along both sides of Windy Hill Drive should be on plans. Sheet 6 More detailed cross section for inlet/outlet structures indicating depth, size and length of rip-rap should be on notes and detail: sheet. Plunge pool/energy dissipater for outlet of culvert from detention basin by stream should be added to plans. Inlet for the culvert at northwest side of basin needs rip rap or equivalent sediment control measures on plans. Sheet 7 Permanent seeding should be implemented on any disturbed areas where final grading will be delayed more than 60 days. A sediment control structure should be considered at outlet to retention basin in addition to setting the base of the basin below outlet grade during construction. CONSERVATION — DEVELOPMENT— SELF-GOVERNMENT TO: Mr. Wayne C. Gerlt -2- RE: Rainbow Hills Subdivision (Cont'd) 7/10/85 Sheet 7 (cont'd) The remainder of the notes and detail sheet has been well prepared. The above comments are in reference to only the minimum requirements of Public Act 83-388. It is understood that South Windsor does not have individual regulations in place to date, and that the town's regulations, when adopted, may be more stringent than the requirements of the state statute. You and I are just wearing paper out with absolute minimal effort towards compliance. Item 11 of the grading and seeding notes on sheet 7 states - "all graded areas shall be permanently stabilized inm-ediately following finished grading. If final grading is to be delayed for more than 30 days after land disturbance activities cease, temporary soil stabilization measures shall be applied immediately." I would hope that we are both clever enough to beat this insignificant obstical but the intention was to leave a minimum of area exposed to the weather at one time. This would include the foundation excavations also. Each time a foundation is dug, you will E&S the stock pile. It is safe to assume, I hope, that you will follow the instructions, on sheet 7 of your plans with respect to seed bed preparation, etc. Sheets 4,5 &6 designate a few hundred feet of hay bales. I consider it inappropriate to be waiting for the next harvest to install them. This is the rainy erosion season. Your avoid- ance in installing them per your own plans is duly noted. It would be my recommendation to the Agency that this permit extension not be auto- matically extended for lack of canpliance with the E&S requirements. Very truly yours, A. B. RENNIE* t ALSO ADMITTED IN NEW YORK July 15, 1986 John Moran Chairman, Inland Wetlands/Conservation Commission 1540 Sullivan Avenue South Windsor, CT 06074 Re: Rainbow Hills, Application #336 Dear Mr. Moran:. This morning I learned that your commission voted to deny a request for extension of the referenced permit at the meeting last night. While you may agree an extension is not needed since all the work has been com- pleted with the exception of planting some trees, seeding the road shoulders and laying the gravel on the driveway to the open space (none of which re- quires a Wetland permit) , I thought your cornni.ssion wished to continue the permit until those items were completed. I learned from Mr. Davies in the early afternoon of July 15th, that he is concerned that the builder (U & R) is not co plying with the conser- vation plan. Clearly, that matter is more appropriately addressed directly with the builder. As I write this letter, I have learned from your secretary that a letter was addressed to you by Mr. Davies on July llth with a copy to be sent to me (as of 1:40 p.m. 7-15-86, it has not arrived) indicating that he would not recnd the extension. Clearly, any advance notice of that information would have prated me to attend your meeting. I shall make every effort to be present on Monday, the 21st. In any event, I request that your commission act upon a motion to reconsider any request for the extension and either grant same or release the Wetlands bond. The conservation plan, as approved by your commission, is being met. I shall continue to meet the conditions of approvals from all town agencies, boards and commissions. Your plans call for a 16" siltation basin. Your last method of spreading the slop around like one would icing on a cake removes the storage capability of the detention basin and encourages a straight pass through of the dirty water into Plum Gulley Brook. Fantastic. Doesn't someone there think about what they are working for? Very truly yours, A. B. Based on the opinion rendered by Acting Town Attorney, Harold Cummings, on August 8 , 1986 in which he separates the lots from the sub- division, as between developers and the builders. Each and every lot in a similar situation shall have an approved erosion and sediment control plan. This plan will not be approved for a number of reasons which include : 1 . Item 13 on the approved plan, 'non-conforming structures located on Lot #22 shall be removed prior to filing final plans unless a variance is granted by the ZBA' . The structures still exist -- I don' t believe two houses can be on one lot. 2 . An erosion and sediment control plan shall be required per public act 03-388 and the South Windsor Zoning reg- ulations . 3. The proposed top of wall elevation of 165 and the top of berm at the pond at 182 or a difference of 17 feet bothers me . The backyard grading doesn't do much for a new home. In the past few months, a potential buyer of this lot was inquiring about the pond removal. The presentation by the developer did indi- cate his intention was to maintain the pond as a viable part of the subdivision. With the installation of the road improvements, it appears that the pond has lost its water supply and could become just an unpleasant receptical. I would hope that the builder and the de- veloper could produce a plot plan with the pond removed and provide the homeowner with a more usable lot. I could support a proposal along these lines if the builder so desired. Very truly yours, A. B.
