Town Clark, New Britain at Hartford on December 3, 1985, comes Peter 00recki , of 1070 .South Grand Street, East Granby, Connecticut 06026, appealing from a decision of the South Windsor Inland Wetland and Water Course Commission and complains and sayst i 1 . The plaintiff made application of the' South Wine r planning and Zoning Commission for a aone -ch.a a that would permit the plaintiff to erect and operate a Public golf course on a parcel of land located on the westerly side of Foster Road in the Town of the South Windsor. 2. The said parcel is an inland wetland. 3 . The said Planningand Zoning Commission 6 approved the one change on February 14, 1984 , but the said commission referred- the application to the South Windsor Inland. Wetland and Water Course Commission (the Wetland Commission ) for further approval . 4 . By decision dated October 25, 1985, and delivered to the Plaintiff on November 8, 1985, the Wetland Commission denied the plaintiff permission to erect the proposed golf course. 5. During the pendency of the application, the Wetland Commission was unable on two occasions to assemble a quorum of its members to consider the plaintiff' s application, and, as a result of members ' resignations during the pendency of then applicatio , so many of the commissioners were newly installed on October 25 , 1985, and were so unfamiliar with the laws and procedures governing the Wetland Commission as to preclude the the Wetland Commission from making a sound and reasonable decision on the plaintiff' s application. 6. The plaintiff submitted detailed plans and maps showing that the proposed golf course would not disturb the natural and indigenous character of the wetland by removal or deposition of material , alteration or obstruction of water flow or pollution of the wetland. - r 7. The Wetland Commission should have permitted the proposed golf course as a nonregulated use pursuant to Chapter 4400 Section 22a-40(b) (2) of the Connecticut General Statutes. 8. The decision of the Wetland Commission was based, in part, on a finding that the proposed use would have caused water to flow from the plaintiff' s land onto a neighbor's land, and such a finding is not proper grounds for the denial of an application pursuant to Chapter 440 of the Connecticut General Statutes, nor was there adequate evidence upon which to base such a finding. 9 . The decision denying permission to erect the proposed golf course was illegal , abritrary and contrary to the evidence on the record. Wherefore the plaintiff appeals from the denial of permission to erect the golf course and prays the court to direct the Wetland Commission to grant the application and for such other relief as is proper. Proposed grading or any earth movement anticipated g A plan is defined in PA 83-388 of 1983 as follows: Sec. 3 (5) "Soil erosion and sediment control plan" means a scheme that minimizes soil erosion and sedimentation and includes but is not limited to a map and narrative. The map shall show topography, cleared and graded areas , proposed area alterations and the location of and detailed information concerning erosion and sediment measures and facilities. The narrative shall describe the project, the schedule of major activities on the land, the application of conser- vation practices , design criteria , construction. details and the maintenance program for any erosion and sediment control facilities that are installed;" B. PLAN FORMAT The soil erosion and sediment control plan should be an integral part of the overall site plan. However, it needs to be consolidated, so it can be separated from the site plan for review and certification. To facilitate plan review, certification and implementation, and the construction inspection process , the `ollowing format is suggested: 1. The information needed for construction should be on the construction drawings and not in the design calculations or background information. 2. The construction drawings should all be the same size sheets. 3. The soil erosion and sediment control measure construction drawings should be a part of the overall construction drawings for the project. 4. The construction details for measures should be shown on a separate sheet from the plan view sheets. 5. The stages of development, sequence of major operations on the land and maintenance program during construction are in the narrative portion of the plan but also should be on the construction drawings. 6. General information about the project and design calculations should be in the narrative portion with the exception of a small simple e plan. 7. The design calculation should be in the narrative separate from the construction drawings. essign calculations are normally not needed for inspection, but design calculations need to be available in case revisions are necessary during, construction. 8. The background information should be in the narrative separate from the construction drawings. j. Additional inf ormation as may be required by the Agency. 7.2 if the Agency finds on the basis of the evidence before it that a proposed use or activity will not involve any regulated activity asdefined in Section 2.1h.. permission to proceed shall be granted forthwith, subject to limitation or revocation, if it is later shown that a or arises from that use. regulated activity is involved in. SWEENEY, P.E. vonsulting Civil Engineer 36 Sylvan Street Avon, CT 06001 (203) 673-0814 September ll, . 1985 Mr. John Moran, Chairman • Inland Wetland and Water Courses Commission Town Hall 1540 Sullivan Avenue South Windsor, Connecticut 06074 Re : Application #280, Gorecki Golf Course Dear Mr . Moran: Since I will be out of state on September 16 and will again not be able to attend your Commission' s meeting, I will attempt to address the wetland and drainage concerns of the above applica-, tion once again. This letter is in addition to all the documents previously submitted which considered the questions of hydrologic' impact, drainage, sedimentation and erosion control, etc . Section. 22a-40 of the State Statutes permits golf courses and other forms of outdoor. recreation as non-regulated uses in wetlands and water courses , provided they do not disturb the indige-sous character of the wetland or water course by removal or deposition of material, alteration orobstruction of flow or pollution ofthe wetland or water course . Since there are no designated water courses on the site, I will attempt to discuss the above three concerns in relation to wetland soil types . Approximately 90% of .the golf course site is comprised of two wet-land- soil types 1 . Walpole (WdA) which is a poorly drained soil and has " a high water table that is 0 to 6 inc:ne.s_ below. the soil surface during t_he - wettest part of the year . The high water table usually persists into the early sum- mer and may reappear after prolonged or heavy summer rains _. ** 2 . Scarboro (SeA) which is a very poorly drained soil and has "water ponded on the surface for significant periods in winter and early spring . The high water table gen- erally remains within 3 feet of the surface throughout the year" . %; Know_Your Land, Connecticut Cooperative Extension Service . Application #280, Gorecki Golf Course 9/11/85 page 2 Additionally, most of the soils surrounding the property are also wetland types, again primarily Walpole and Scarboro . As a matter of fact , the -only-area -of : major non-wetland---soil - near the property is the Foster Road right of way and the front portions of the lots along Foster Road . For the-- most part the rear portions of those lots are wetland soils ; Mr . Ellison' s lot is approximately 75% wetland soil (see attached sketch) . The proposed material deposition and removal regarding the golf course is particularly addressed in the "Narrative" which was previously submitted. The 900 cubic yards of additional material required is not- significant_ and consists primarily of crushed stone (parking lot and drive) and free-draining fill material . The volumes of stone and fill are practically equal at 900/2 cubic yards each. This proposed filling will not sign-i-fi_cantly increase the peak runoff because it will be at least as permeable as existing site conditions . Although, the plans call for the placement of a berm along the drive and parking area, I don' t 'chink you will see a marked increase in depth or width of flow simply because the proposed finished grade is essentially the same as the existing grade, and the parking lot surface will be porous . This similarity in grades is quite evident on the sanitary sewer profile' (Site Plan - Clubhouse) . The golf course does not change any natural drainage patterns and the direction of drainage after development will be the same as presently exists . The clubhouse area will drain to the south while the remaining site will drain to the west, in quite the same patterns as you see now. By constructing the ponds a natural wet- land function will be enhanced (groundwater recharge) and addi- tional wildlife habitats will be created. Pollution of the site, in the form of sedimentation and erosion, should not be significant since the site is practically level and material transport water velocities will not be reached (see Narrative) . Sewage pollution will not exist as the site is served b,r sanitary ser•Ters . Reg_axding the hydrologic impact of the- proposed golf course, I still contend that the increase in peak flow will be essentially zero . Since I submitted the hydrologic analysis 2 months ago and have not received any comments from your Town staff, I can only assume that they are of the same opinion. Sincerely yours , enclosure Edward J. Sweeney, P. E. cc : P. Gorecki H . C . Cotton, L. S . A. B . Davies , Deputy Town Engineer Application #280, Gorecki Golf Course page 2 You will also note, if you look at the site plan, that all drainage from drives and parking areas is directed to the west with eventual dissipation at the clubhouse building area. By creating a berm and swale at the southern edge of the drive and parking area the effective discharge point for the clubhouse site is now 500+ feetr from Mr. Ellison' s house . ' I suppose if it was absolutely necessary to eliminate the possibility of any surface site water from entering Mr . Ellison' s property, the water could be pumped to the west (into another drainage basin) in conjunction with the golf course irrigation system. I have not approached Mr. Gorecki with this alternative and I do not look upon it very favorably, since it would involve diversion of water from a wetland. Sifc;ere1y yo rs, Edward J. Sw eney, P. Consulting Civil Engineer 36 Sylvan Street Avon, CT 06001 (203) 673-0814 j June 1985 GORECKI GOLF COURSE 3• r FOSTER ROAD, SOUTH WINDSOR, CT NARRATIVE This project involves the construction of a nine-hole golf course and clubhouse on approximately 56 acres of land, to the west of Foster Road . The land is relatively flat with slopes predominantly less than 0 . 4% . Site drainage is generally to the west where it eventually finds its way to Stoughtons Brook, near Route 5 . A portion of the site adjacent to Foster Road drains to the south, into a large, fairly level area. Maps of the area do not delineate any water 44 - courses on the site . Consequently, site drainage consists primarily of overland flow. Topographic maps show a depressed, swampy area near the northern property line, approximately in the center of the property. Site soils are primarily designated wetland soil types (over 90% of the site is wetland soil) consisting of Scarboro (SeA) and Walpole (WdA) ; Ninigret (NnA) and WindFor (WvB) are the non-wetland site soils . Site vegetation is a mixture of grass , bushes and trees with most of the site devoid of large tree growth . The large trees that exist are primarily located at the boundaries . Although, stands of large trees dot the interior. Based on standard hydrologic calculations (SCS-Modified Curve Number Method) the net change in site runoff for the entire site (pre versus post development) is essentially zero . This zero net change is due , in part , to the following : 1 . Minor changes in grade and hydraulic length within the drainage areas of the site . 2 . Insignificant increases in impervious areas . 3 . The construction of three ponds on the site . Due to this zero net change in runoff, there should be no measurable off-site or downstream effects , as a result of the construction of the golf course . GORECKI GOLF COURSE June 1985 NARRATIVE page 2 In constructing the golf course, the following, approximate quantities of material (earth) are involved : A. Golf—Course Site (from estimates by A. Zikorus) 10, 500 C . Y. of cut 9, 900 C . Y. of fill 600 C . Y. of excess material B . Clubhouse Site 1, 500 C . Y. of fill material, including crushed stone for the driveway and parking area, is required. C . Total Site +1 , 500 C . Y. - 600 C . Y. + 900 C . Y. of additional material required Construction of the golf course will take place primarily during the dry months of the year with final seeding and planting occuring before October lst . A detailed construction schedule is contained in the attached "General Plan For Sedimentation And Erosion Control" . Sedimentation and erosion control will consist primarily of haybale filters/silt fences around fills and in areas where concentrated runoff is anticipated. Other areas , such as roughs and fairways will be stabilized with grass cover as soon as grading is completed . Since the site is relatively flat and will remain so during and after construction, surface water velocity should not approach the limits necessary to move sediment or soil . The surface water velocity for a majority of the site, assuming an average slope of 0 . 4%, should be less than 0 . 5 feet/second. In order for water to remove most soil particles and keep them in suspension, the velocity should be greater than 1 . 5 feet/second . Additionally, all site soils are designated by the Soil Conservation Service as low erosion hazard soils . Sediment collected or trapped on the site will be removed from the area of collection and disposed of on-site in areas not subject to erosion. Structural sedimentation control measures shall be maintained in effective condition by the contractor/developer, throughout the construction period . After construction is completed and all areas have been properly stabilized, all non-rotting sedimentation controls shall be removed by the contractor/developer . EDWARD J. SWEENEY, P.E. Cashman, Soil Conservationist - USDA-SCS RE: Proposed Golf Course, Gorecki Property Foster Rd, South Windsor CT Previous SCS Review: June 7, 1984 The following is a list of suggestions regarding the construction program for the proposed golf course. 1) A complete sediment and erosion control plan is needed for the plans. The Connecticut Sediment and Erosion Control Handbook can be used for reference. 1 2) Sediment basins should be used to help reduce runoff pollution. 3) Phasing construction by completing one area prior to continuing construction should be implemented in order. to keep exposed surface areas to a minimum. 4) Locations of drainage areas, grassed waterways, subsurface telephone lines and the outlets should be on the plans. 5) Detention of stormwater runoff on site should be addressed. Possible negative impacts to downstream areas should be considered, and sediment and erosion damages should be avoided on the property as well as off site. 6) The proposed pond on the property should be designed carefully to insure its future viability. Sediment and erosion control measures to protect it as well as future maintenace should be addressed. If it will be used as an irrigation source, a Department of Environmental Protection Diversion Permit may be needed (if the watershed is larger than 100 acres, or if anticipated drainage is 50,000 gallons per day or greater) . Gorecki, Foster Rd, South Windsor Application #280 Golf Course As requested, I have reviewed the site plan and field checked the site. Mr. A. Bowen Davies, Deputy Town Engineer, met with me on the site and we discussed some of the Inland Wetland Agency►s concerns. I have the following comments: 1 ) WOODLAND HARV 4T I N[ — I FAR('I ITT I Ir The removal of most of the trees by the owner, from the existing red maple swamp, could have been done in a systematic manner. In general , the clearcut width should be equal to or greater than one tree height at the narrowest point and usually not more than 10 acres in size. Where silvicultural factors do not preclude them, clearcuts usually are oriented with the long axis generally parallel to the land contour to minimize erosion. it would also minimize visual impact. Long, narrow serpentine clearcuts spaced a minimum of 600 feet apart have the greatest wildlife value. Under the present situation the tree removal will provide full sunlight for germination and growth of seedlings. The resulting grasses, forbes, seedlings and sprouts offer a complete high protein diet for wildlife, and berry bushes become particularly abundant. Also, the edges of these young stands are preferred nesting sites for game and non-game birds and mammals. 2) TREE AND STUMP REMOVAL Tree and stump removal will have other effects on the area in addition to the less tangible aesthetic value. These effects are:- a) Stormwater and wetland retention. When woodland is converted to open land, the amount of runoff in cubic feet per second will increase. Also, whenever a wetland is filled in or altered, the amount of runoff will increase because the ponding and swampy areas that have the capacity to retain runoff during storms has been altered. b) Wildlife Habitat. To support a high wildlife population, a site must have a plentiful supply of good food close to cover that furnishes protection from enemies and weather. Ideal habitat for most wildlife can be maintained by having stands of trees of different ages, numerous edge areas and openings created by small clearings, wetlands and cropland. In general , wildlife needs diversity and an Interspersion of different kinds of vegetation types. 0 The Soil Conservation Service `J is an agency of the Department of Agriculture r s 4 page -2- FOR: Constance Eriksson, Chm 6/7/84 Inland Wetland Agency - South Windsor RE: Peter J. Gorecki, Foster Rd, South Windsor Golf Course 3) GOLF COURSE DEVELOPMENT The development of a golf course and associated facilities on this site will require that the wetland be altered and filled In. The wetland habitat will be destroyed and upland habitat will be created. Areas that are not filled will remain wetlands and the existing wildlife may frequent both wetland and upland areas. Once filled or altered the existing wetland will no longer be a valuable resource in the maintenance of groundwater supplies, and in water purification. Altered wetlands will also lose their capacity to store flood waters temporarily. As already mentioned in the paragraph in stormwater retention, runoff from this site will Increase, and a stormwater drainage system may be needed to accommodate increased runoff. An adequate outlet for excess stormwater and drainage must be available. The site plan does not include any erosion and sediment control planning. A plan should be developed that outlines the sequence and staging of the golf course development. It should include all necessary vegetative and mechanical measures needed to control erosion and sediment. Once a sediment and erosion control plan is developed, this office will be glad to review it. If you have any questions or need further assistance, please do not hesitate to contact this office.
