McCahill, Zoning Enforcement Officer RE: Application 88-69W - Byrnes, Flynn, Makucin - IWA/CC permit to fill a conservation easement in the rear of 66, 52 and 36 Sally Drive, (southerly side) A20 zone. DOCUMENTS REVIEWED: Application Form, site plan for Lots 56, 57 and 58 Sally Drive and Pleasant Valley Homes II subdivision plans on file. R, COMMENTS AND RECOMMENDATIONS: 1 . This proposal will supersede activities that will take place in this area as part of the subdivision approval. Both the original approval and this proposal would result in the filling of wetlands and the loss of trees in the area. Consideration of this application should involve a comparison of the two in terms of which would have the least negative impact on the area. Y - `=a 2 . In either situation trees will be taken down and others will be effected by the activities . 3 . The plan that is part of the incoming application is crowded and difficult to read. 4 . If erosion of banks is a concern, there are many means of stabilization such as vegetation, rip-rap or landscaping timbers . The banks are fairly stable at this time. SUGGESTED APPROVAL CONDITIONS: 1 . Stump disposition should-be-addr-essed as part of the plan. 2 . A silt fence or hay bales should be installed to protect remaining wetlands . 3 . A contact person should be identified directly on the plan in the event that site problems arise. 4 . A bond would need to be in place for this specific project. You may re-apply at any time taking into consideration the concerns expressed by the Agency, incorporating substantive changes into revised plans . The denial was based on plans prepared by Reino E. Changes seemed to reflect personal preferences of the applicants rather than engineering and/or drainage shortcomings (RE: approved subdivision plans of the developer) . Very truly yours, , John M. We are the owners of the property at 66 Sally Drive and are annoyed by the project results. Several issues need to be brought to your attention: 1. Prior to Mike's initial seeding (in August), the massive rain washed much of the top soil into the swamp. This soil was never replaced or leveled and as a result, the land is very uneven with.major holes and ruts throughout the bank. 2. When Mike finally did seed, a poor job was done, as there are numerous bare spots. 3. The land is like quick sand. Even prior to all this recent rain, we were never able to step foot on it as we- would sink up to our ankles. This includes the three week dry spell in September. The land was like a muddy ---substanee; -therefore we-fie--been--unable to-correct the s tuation.- - - -- - ---- - - - - - 4. In the event of rain, the drain becomes clogged and is not functioning as planned. As mentioned above, we are unable to clean the drain due to the soft soil. 5. The silk fence and hay bales still remain on the property and obviously Mike is aware that he is unable to move them because of the situation. We do not feel the project is completed as approved by the Inland/ Wetland Commission; therefore the bond should not be returned until project completion. This has been a long, drawn out project, starting the second week of July and now approaching the end of September, with still no end in sight. We would appreciate any further steps you might be able to take to complete the work and request that before returning the bond money, notify all owners as to their satisfaction. According to the approved plans, to the rear of lot #56 there is a proposed spot elevation of 72 .5 and the area was to be graded to drain into the proposed "C-L" catch basin. It does not appear as though this area drains properly. I would suggest you do the minimum grading and/or fill necessary to comply with the approved plans as soon as possible.
