RE: Samsel Properties Communication to Inland Wetlands Conservation
Commission Dated February 2, 1989
Dear Commissioners:
Please regard this letter as a response to Mr. Samsel's letters to you
outlining 4 items of concern. I enclose copies of three (3) letters to Mr.
Samsel dated November 14, 1988, December 13, 1988, and December 19, 1988,
regarding connector roads between Terry Office Park and the Town Center. I
think you will find evidence that cooperation from me has far exceeded the
point of reasonableness.
If the project now being requested by Mr. Samsel is approved by the Inland
Wetlands Agency / Conservation Commission and Planning and Zoning Commission we
have a bond in place to ensure a road connector. If Clark Corners is approved,
there is a provision on our plans of the Town Center for a connector road. The
roadway I question was neither of these as he asserts but rather the additional
road across land behind the Bank of South Windsor building lot, across private
lots bordering on Deming Street to the proposed roadway from Terry Office Park.
We also suggest the Kuehn property which we own (1665 Ellington Road) should
have a provision to connect to Clark Corners / Town Center roadway if approved.
Whether the cut on Ellington Road is eliminated is another concern to be addressed
by Planning and Zoning Commission.
We Build Our Reputation
His statement asserting no response from me indicating my unwillingness to
cooperate seems somewhat unsubstantiated in relationship to the letters I submit
to you. We had no reason to be part of the application as he suggests because
we had already addressed the issues; it is development on his property, not mine.
Thank you for your time and consideration.
Sincerely,

RE: Preconstruction Agreement - Town Center & 497 Buckland Road
Dear John:
This letter is in reference to the revised construction agreement for
shared costs you presented to me on November 8, 1988. Following are my
reactions and conclusions:
1. You have changed the intent of shared costs without consideration
of the hours and costs incurred in the original agreement completed back in
June 1988. Your answer for refusing to sign that agreement was that you
wanted to wait and make sure you received your approval for your ninety-one
hundred square foot building. . You received that approval; and, again, you
have changed your mind. You came to my office one week prior to this November
8 proposal and had absolutely forgotten that you had been given an agreement
in June prior to the meeting when the Town Center received approval. You were
present at that Planning and Zoning Commission meeting and heard the Commission's
discussion regarding the connector road and the bonding of same.
2. My agreement was to share the cost of the connector road between the
two properties. Also, I agreed to give land for the relocation of some of
your parking spaces as you did not want to put the spaces on your own land
because of the walking distance for tenants. Yet, the distance is the same
regardless of the location of the spaces.
3. Sincerity in looking for an overall concept of planning, and not a
piece-meal approach, is the responsibility of both property owners. I thought
we had addressed this problem and had agreed to work together regarding a
solution. I was left with no alternative but to develop an expensive, separate
drainage system to control drainage that should have gone into the natural
drainage and storage system. This became necessary due to your indecision
regarding compensation from me to you to drain into a system designed for the
We Build Our Reputation
entire watershed.
4. My road system takes your development into consideration at the
insistance of the Town Planner and the Planning and Zoning Commission,
therefore, I feel that all property owners serviced by this road network
should be responsible for all off-site improvements.
5. I don't see Schedules C, D and E to which you make reference in
your revised agreement.
In summary, I wish to re-state my desire to work co-operatively with
you toward concluding this agreement. The entire property we have under
our control should be developed with continuity and with consideration
for any remaining property that would affect good development. This would
mean an agreement with no more rule changes. It is nearly impossible to
finalize planning if prior agreements are not followed.
wI would expect to hear from you in the near future after you consider
all aspects of the agreement in its entirety.
S cerely,
Richard S. Kelley

Dear John:
Betsy Kamerlin of Fuss & O'Neil, has provided me with a conceptual
plan of the proposed connection between our properties as we have
discussed with Marsha Banach of South Windsor. I am writing to indicate
to you that I believe that the proposed connection shown by Betsy is
acceptable to me and will adequately service the Town Shopping Center
needs. " As you know, 1 am under the requirements of a certificate from
the State Traffic Commission and one of those requirements was for the
connection of my center to Buckland Road. In order to be assured that
the proposed driveway, as envisioned in the drawings which I received,
is acceptable for this purpose I will be requesting shortly through
Storch Associates to have this concept reviewed and formal indication
issued by the Department as to the acceptable nature of this proposal.
Subject to the State's review and approval of the concept I wanted
to indicate to you this plan does appear to be acceptable to RSK-Kellco.

Dear John:
This is in response to your letter dated February 20, 1989, to Inland
Wetlands/Conservation Commission regarding RSK-Kellco, Inc. 's letter to
them dated February 15, 1989.
1. Item #3
The interior road connecting Terry Office Park, Town Center
and Clark Corners (if approved) is the proposed connector between
the properties. Town Center plans, as approved, address this issue.
My letter to you dated November 14, 1988, again on December 13, 1988,
and a third letter from Storch Associates to the STC indicate I am
in agreement with the connecting roadway system if all approvals meet
State requirements and result in the Town Center being allowed full
occupancy by all agencies. RSK has posted a $100,000 bond with the
Town of South Windsor to ensure cooperation. What more cooperation
is needed? However, as I have indicated to you, nowhere on Town
Center plans is there a roadway around our 65,000 sq. ft. retail
building, across private property of others on Deming Street and
connecting to the Terry Office Park as you now propose. The issue
of any additional roadways must be addressed by several property owners,
including the two of us.
2. Item #4
The former Kuehn property at 1665 Ellington Road should be
connected to the Town Center - Clark Corners roadway if approved. The
elimination of the present driveway on Ellington Road is not at issue
following the same reasoning that allowed you to retain the existing
cuts to your properties on Buckland Road.
I do believe you received our response as evidence above. As the issue
of the roadway you are requesting was addressed in my letters, I feel I had
no reason to become a part of your application.
We Build Our Reputation
We both have much more important things to occupy our time than a
continuation of this type of correspondence. As I have suggested before,
a piece-meal approach is not the answer. I feel I have bent over back-
wards to be cooperative with you.

RE: Application No. 89-10P
Terry Office Park
Dear Mr. Lombardi:
I am forwarding this letter to request an extension of the
IWA/CC permit granted for the above referenced site on April 17,
1989. As you recall, this project comprised the completion of
the Terry Office Park development including the driveway
connection to the Town shopping Center.
I inspected this site on April 5th of this year and found all
exterior construction and site grading and paving to be
completed. All utilities are in place and functioning and
disturbed areas have been graded and seeded. Erosion control
measures are functioning properly and erosion damage appears to
be minimal. The only aspect of this project which remains to be
completed is the establishment of grass in the seeded areas. As
it is still early in the season, grass has not had a chance to
become established and there are considerable areas of bare
soil. While these do not appear at present to pose an erosion
hazard, I suggest erosion control measures remain in place until
the grass is firmly established. Other than this one aspect,
the construction on this site is essentially complete.
With these observations and recommendations in mind, I
respectfully request an extension of the permit granted in 1989
to my client, John Samsel. If you require any further
information, please do not hesitate to contact me.

RE: John Samsel - 469 Buckland Road
Application #89-10P
Dear Ms. Warren:
This letter constitutes the engineering report necessary to
close the above referenced application for the final building
and development of Terry Office Park known as 469 Buckland
( Road. As of the date of my inspection, April 24, 1991, all
'tom pavement, curbing, striping, lighting fixtures and landscape
plantings have been completed on this project. Landscaped areas
in the immediate vicinity of the building have received either a
grovel coverage or woodchip mulch. The exterior of the building
is essentially complete and will require no further disturbance
of any of the site in its immediate vicinity. Disturbed areas
adjacent to the parking are still protected by the silt fence
required on the original plans, though some signs of wear are
now apparent. These disturbed areas have received finished
grading and have been planted with the trees required on the
plans. They are in the process of being prepared for final
loaming and seeding. Essentially, this is the only site work
remaining. There is little or no evidence of erosion or
sedimentation. All riprap areas including the detention basin
are clean and well maintained.
I trope this addresses the concerns of the Commission. We
respectfully request this application to be closed. If you
require any further information or have any questions, please do
not hesitate to contact me.
Yours truly,
Christopher 0. Stone,P.E.
