Stone 772 Ellington Road South Windsor, CT 06074 RE: Investigatory Letter Wetlands violation on property located at 772 Ellington Road (Assessor's map 48/Parcel 90) . Dear Mr. Stone: It has come to my attention that a small tractor has been operating on your property on Ellington Road. Fill material; including stumps, logs, and brush have been placed on the slope adjacent to the watercourse. Section 22a-42a of the Connecticut General Statutes and Section 5.1 of the South Windsor Wetlands Regulations requires that a permit be obtained prior to making alterations to wetlands and/or watercourses. Section 2. 1j of the South Windsor Wetlands Regulations defines regulated areas to include any area within 80 feet of a watercourse. The Agency has no record of a permit being issued for this work on your property. As such, the work that has already been done in the regulated area is in violation of the law and the Agency regulations Therefore, Iyou are instructed to cease any further work in the regulated area. To assist the Inland Wetlands Agency/Conservation Commission in determining the property course of action please respond, in writing to the following questions by May 12, 1989. This will be discussed at the IWA/CC meeting scheduled for May 15, 1989 . 1 . Who did the work, filling, grading, etc. ? 2. When was this work done? Over what period of time? Please provide a diagram showing how this relates to the work already done and the wetlands and watercourses on the property. 5 . Where is the current edge of fill in relation to your property boundary? Please diagram. 6. What is the reason an inland wetlands and watercourses permit was not sought prior to doing the work in the wetlands and watercourses? Based on your response. and based upon existing conditions of the site, the Commmission will determine if the wetlands and/or watercourse must be restored* to their prior unaltered condition or if an application should be processed. If you fail to. respond to this letter by May 12, 1989 we will be forced to take an enforcement action, including but not limited to the issuance of a cease and desist order or transferal of the matter to the Town Attorney for court action. Questions on this matter should be directed to John McCahill, Zoning/Wetlands Enforcement Officer, at 644-2511. Sincerely, John E. (GZA) have observed conditions at your property at 772 Ellington Road in South Windsor, Connecticut. GZA was retained to provide a preliminary assessment of the fill placed over a steep escarpment behind your house in close proximity to an Inland Wetland and Watercourse. GZA's knowledge of the history of this filling is based . on your verbal descriptions and a review of correspondence from the Town of South Windsor. BACKGROUND INFORMATION ' The fill material primarily consists of wood chip mulch and wood logs. According to your information, this material was placed during an eighteen (18) month period _ending May 1989. We understand approximately twelve (12) truckloads of material were placed in an attempt to stabilize an eroding slope. ` The filling was discontinued upon your receipt of a letter, dated May 3," 1989, from the Town of South Windsor, noting concerns for the Inland Wetlands on your site. The Soil Conservation Service Soil Map- (#26) of Hartford County indicates your home is situated on a terrace of Windsor soils (WvA) consisting of well drained to excessively drained sands. The remaining portions are mapper-a—s --Terrace Escarpments (Tc) consisting of fine sands, some silts and clay which have a high erosion hazard. Portions of the fill material are in close proximity to a shallow perennial stream which flows through your property. Upstream of the site this stream is piped through a series of culverts and receives storm drainage from portions of the surrounding watershed. The inland wetland boundary appears to be distinct and marked by . 'T2 7 Newton, MA Bridgeport, CT Vernon, CT Livonia, MI, Manchester, NH Buffalo, NY Bala Cynwyd, PA Providence, R1 An Equal Opportunity Emplover M/F WH -` Mr. David Stone - September 11 1989 - File No. W-40413 - Page 2 the eroded watercourse channel along the foot of the slope. We observed no encroachment into the watercourse at this time due to the placement of the wood mulch or logs. However, there is evidence of a disturbance to a small area of wetland soil 'as a result of the filling. DISCUSSION The Town of South Windsor Inland Wetland Regulations provide for ' a regulated buffer zone of 80 feet to all watercourses and 60 feet 2- to inland wetlands (as defined by soil type) . GZA also understands the regulations (or policy) provides for a twenty (20) foot buffer of "non disturbance" for all watercourses and wetlands. Recognizing that your property and many others in this area are non-conforming, having existed prior to the adoption of the current regulations, it does not appear feasible for you to satisfy all of the current regulations. However, primary concerns are that the watercourse be protected from encroachment and impairment of wetlands be minimized. The filled area shows signs of settlement. Further settlement is likely ud e-'o both compression of the fill mass and decomposition of the wood. However, GZA believes that__gross instability of the filled slope which would cause slidinginto the watercourse is not likely provided the toe of the slope is protected from undercutting and,-stee er p - p por ous of the slope a are _flattened to no steeper ffian 2 hori .ontal.tg._1 vertical. The expected sett_leme_ nt of the fill mass renderev_it____unsuitable for support of structures. j concentrated loads. or RECOMMENDATIONS GZA recommends the following in order to mitigate potential impairment of the wetlands and watercourse, promote stability of the fill and complete landscaping of the site. ✓ 1. ,All wood mulch, logs and other debris within at least fifteen (15) feet and preferably twenty (20) feet of the stream ,channel should be removed:------___ _ 2. The reduction of the slope to no steeper than 2 horizontal to 1 vertical and the regrading of the filled area to smooth the contours. The excess mulch could be placed at the north end of the site above and away from the watercourse on non-wetland soils to complete landscaping effects and provide smooth grading in that portion of the site. Mr. David Stone - September 11 1989 - File No W 40413 Page 3 3. One row of rock-filled gabions (3 ft. high by 3 ft..; deep) equivalent mass of dumped rip-rap P) or p p-rap should be placed along the toe of the filled slope to: a. Buttress the slope and promote stability; 1 b. Protect against .undercutting of the fill; and C. Filter any mulch materials which may wash down the slope. 4. Soil should not be placed over the wood mulch because of the high likelihood of erosion of the soil capping and sediment discharge to the watercourse. The landscape finish should be y limited to wood chips or ground cover vegetation which can be established in the wood chips. 5. No structures or concentrated loads (including vehicles or material stockpiles) should be placed over the filled areas. We suggest you consider these recommendations and discuss them with the Conservation Commission. You are responsible to obtain all necessary local, state and federal permits which may be required to perforTa work in wetlands or regulated buffer zones. Stone indicating location of fill, and site assessment and recommendations by Goldberg, Zoino and Associates, Inc. , dated September 11, 1989 .. COMMENTS: 1 . This application is in response to the Commission's decision regarding the Investigatory Letter sent to David E. Stone, dated' May 3, 1989 and the assessment submitted by Goldberg, Zoino and Associates, Inc. , dated September 11, 1989 . The applicant was directed to submit an application to the Commission. 2. The assessment and recommendations have been forwarded to the Town Engineer for review, as requested by the Commission. 3. It would appear, based on a site visit, that the materials are fairly stable at this time. The assessment and recommendations do not address temporary erosion and sedimentation control measures . A silt fence is recommended at the toe of the slope. 4. Item #1 under recommendations states "debris within fifteen feet and preferably twenty feet of the stream channel should be removed" . Removal of debris within twenty feet would be in keeping with section 5 . 2 of the Regulations with regard to non- disturbance setbacks . 5. The reduction of slope to no steeper than 2 horizontal to 1 vertical is recommended by Goldberg, Zoino and Associates, Inc . . This will result in the removal of some of the mulch/fill . The material is to be relocated at the north end of the site. 6 . Goldberg, Zoiro and Associates, Inc. , also recommend gabions or rip-rap should be placed along the slope. This should also be kept 20 feet away from the stream channel. r IF APPROVAL IS CONSIDERED, SUGGESTED APPROVAL CONDITIONS INCLUDED: 1 . A silt fence shall be placed at the toe of the slope. 2. Strict adherance to recommendations by Goldberg-Zoino and Associates, Inc. , shall be required.
