Permit is for a two (2) year maximum period. 2. The operation is not permitted to expand as far as no additional mechanical equipment or additional buildings. This action is effective April 27, 1996. The permit will expire in two (2) years, April 27, 1998. Very truly yours, PL ING & ZONING COMMISSION sell G. Levac , Chairman RGL/pmm cc: Zoning/Wetlands Enforcement Officer Chief Building Official f BAHLER BROTHERS T & C PERMIT RENEWAL PH 4/9196 1. Request for renewal of a temporary and conditional permit for a landscaping business at 1030 Ellington Road. ZBA first granted a T & C permit for this use at this location in 1990; it has since been renewed twice by ZBA, in 1992 and 1994. It will expire in July 1996. According to the original ZBA application, Bahler Brothers had been operating the landscaping business from this location since about 1985. 2. ZBA granted the original approval with the condition that the operation was not permitted to expand beyond what was seen on the premises when visited by the ZBA on June 13, 1990, as far as no additional mechanical equipment or additional buildings. According to the ZBA minutes from June 5, 1990, Bahler Brothers had two small dump trucks and four pickup trucks, some of which were their own personal vehicles. At that time, there was no business office on the property, and Bahler Brothers indicated that they employed a maximum of 4-5 employees during the peak months. The applicant indicated that they arrive on the site in the morning to pick up equipment and return in the evening to return the equipment. The hours of business originally were 6-7 am to 6-7 pm. Materials were delivered to the site approximately once a month, and on occasion leftover materials from jobs were dropped off for storage. Minor equipment repairs were also included with the original ZBA application, plus washing of vehicles. No chemicals were stored on site, since that type of work was contracted out. The Bahler Brothers applied for the original ZBA permit in response to a complaint to the Town about the business. We do have photos of the site from the 1990 ZBA approval. The Commission may wish to have the applicant discuss how the current business compares with these previously-existing conditions. 3. The applicant applied to this Commission in 1995 for a zoning amendment to allow landscaping businesses in the A-20 zone. The Commission's primary concern was that the proposed amendment was a special interest amendment for one property owner and would not benefit the community as a whole. 4. In all of the ZBA approval letters, there was a statement that, "This permit will expire in two years...and will have to be renewed at that time." 5. The wording of the T & C permit regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may be given after a Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." Landscaping is not specifically listed as a permitted use in any zone. It is likely that a landscaping business would qualify under the similar uses provision of the General Commercial zone, and also possible that such a business would qualify under the similar uses provision of the Industrial zone. 6. Commissioners may want to visit the site prior to the work session on this application. The work session is currently scheduled for April 23.
