Dear Sir/Madam: This is to notify you that the two year temporary and conditional permit approved by the Zoning Board of Appeals will expire in March, 1996 . Tctporary and conditional permits are no longer under the jurisdiction of the Zoning Board of Appeals . Effective 11/18/95 there are under the authority of the Planning and Zoning Commission. If you wish to continue this use it will be necessary for you to contact the Planning Department at the South Windsor Town Hall, 644-2511, ext. 253, regarding changes in the application procedure. Thank you. Very truly yours, Deborah W. Reid Recording Secretary Zoning Board of Appeals cc: Zoning Enforcement Officer s WHIRLYBALL TEMPORARY AND CONDITIONAL PERMIT- 3/26/96 1. Request for renewal of a temporary and conditional permit for the operation of "Whirlyball" a bumper car sports arena in an industrial building at 1265 John Fitch Boulevard. ZBA first granted approval to this request in October 1991 and again in March 1994. The permit did expire in March 1996. 2. There were 3 conditions placed on this approval: • Approval is for a"Whirly Ball" sports arena, which will be supervised by a referee for competition, with rules and regulations to be followed for such sport; • No other arcade games will be allowed; and • Hours of operation to be permitted will be from 10 a.m. to 12:00 P.M. 3. In all of the ZBA approval letters, there was a statement that"This permit will expire in two years... and will have to be renewed at that time of this use is to be continued." 4. The wording of the T & C regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may given after Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially or permanently injured and traffic and other hazards will not result from such use." 5. The I zone does not allow for recreational enterprises, however, under the permitted uses in the GC zone there is a provision for amusement enterprises but expressly excluding mechanical rides. Therefore, the T & C regulations provision, "for a use which is not specified elsewhere in these regulations," is not met for this application. 6. There is another similar recreational use which is currently existing through a T & C permit in the industrial zone. One, or both of these facilities, may want to pursue a zoning amendment allowing selected recreational uses in the industrial zone. If an amendment is going to be pursued, it should be done well in advance of the expiration date if the Commission chooses to renew this T & C permit. 7. Because of the length of time this use has existed with ZBA approval ,the Commission may want to explore alternatives for the future with the applicant, such as the zoning amendment, in combination with a permit renewal for a limited time frame. 0-NN se.4 // co C T111WVn O-P S-0a a m ?40&2t 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CONN. 06074 SOR•CO AREA CODE 860/644-2511 April 15, 1996 BGI/Whirlyball Arthur W.
