RE: Proposed Open Space Subdivision, Abbe Road
The Planning and Zoning Commission had a preliminary
discussion on March 23 with a potential applicant for a small open
space subdivision on Abbe Road. The applicant proposes to deed to
the Town a parcel of land with the following dimensions :
Area: 19 ,400 ± square feet
Width: 37 - 60 ± feet (varies)
Depth: 400 ' ±
The proposed open space is a portion of property identified
as assessors map #126 , lot 25 (see attached portion of assessor's
map) . It is contiguous to a series of existing Town open space
properties from various subdivisions (see attached portion of Town
owned land map) .
Attached also are the goals and recommendations from the Open
Space Element of PZC' s Town Plan of Development. The Commission
indicated at their preliminary discussion with the applicant that the
proposed open space is generally in conformance with the Town Plan.
The Commission would like to receive input from the Council
as soon as feasible so that this information can be provided to the
applicant in advance of preparation of a formal application.
Please call me if you have any questions .

AHEARN RESUDIVISION- ABBE ROAD
1 . Application for a 4 lot resubdivision on approx. 5 . 2 acres
located on the westerly side of Abbe Road, northerly of Wood Pond
Drive, RR zone. There is an existing house on the property and
the applicant is proposing to develop three additional lots under
the RR open space subdivision regulation.
With an open space subdivision the applicant is required to
donate a minimum of 10 acres to the Town unless the proposed open
space abuts up to existing open space. That is the case with
this subdivision. It is contiguous to a series of existing Town
open space properties from previously developed subdivisions .
The Town Council has reviewed this proposed open space as
required in the subdivision regulations . In a letter dated
7/7/93 to the PZC the Town Council indicates their support for
the acceptance of the open space shown on the map. (submit
letter for the record. )
2 . Minimum lot size allowed is 20,000 square feet. Lot sizes
for this subdivision are in excess of 40, 000 square feet. Lot
frontages range from 100 ft to 155 ft. All lots appear to
conform to our zoning regulations .
3 . Water and sewer are available. The house on Lot #3 is
approx. 237 ft from the road and is serviced by an existing
septic system and well . The applicant is not proposing to
connectito the water and sewer at this time.
a
WPCA approval is required. Fred Shaw, Sup't of Water
Pollution Control has indicated that he requires more detailed
information on the low pressure sewer system. There should be a
provision for the future connection of Lot #3 to the sewer.
There should also be a more direct connection of the building
sewer to the main sewer (force main) for lots 1 and 2 . The main
force main should be centered in the right-of-way.
4 . There are no regulated wetlands on the site nor 100 year
floodplain. Conservation plan approval is required.
5 . There are no new roads proposed with this subdivision. All
lots will have their access from Abbe Road. There is a
turnaround driveway shown on lot #2 . The planning department
recommends a turnaround driveway for lots 1 and 4 as well .
Also, the police department (traffic authority) has
reviewed these plans and have the following comment: "Driveways
to each lot may have a site line problem as they will exist on
the incline of the hill on Abbe Road. Site lines should be
addressed. "
If this application is approved, the planning department requests
t "
the following modifications:
- All references to subdivision should be changed to
resubdivision.
- Lots that are to be created and -open space area is unclear
because of existing lot lines shown on the map. For clarity, the
existing lines should be eliminated and only new lot lines should
be shown. (This is true for all sheets . )
Plot Plan/Togo Plan
- Surrounding property owners must be identified on these sheets .
- Site triangles must be shown at driveway entrances
The "buildable squares" must be shown or a note added that the
lots meet this requirement.
- Town open space property corners must be monumented.
- Proposed tree line should be shown on the topo plan.

RE: Application #94-08P, Mary I . Ahearn Subdivision
DOCUMENTS REVIEWED: Application form and plan prepared for Property
of Mary I . Ahearn (dated 2/10/94 )
COMMENTS :
1 . This application is for conservation plan approval . Note #7 of
the Conservation Plan Narrative, on sheet 3 of 3, states "site
does not contain any designated Inland Wetland Soils " ; there are
no wetlands/watercourses shown on the Town map and no apparent
signs of wetlands/watercourses in the field. (The Podunk River is
just northerly of this site. )
2 . The plans, as submitted, include sheets 1 & 3 of 3 . Sheet 2 has
not been included. Does it exist or should the plans be a total
of two sheets?
3 . The legend should include the symbol for the existing tree line.
The proposed tree line should be shown on the plans and the
symbol for the proposed tree line should also be included in the
legend. A note should be included on the plans stating the
limits of clearing shall be flagged in the field and approved by
Town Staff prior to clearing.
4 . Stump deposition should be addressed on the plans . Stumps should
be chipped or removed from the site. They should not be buried.
5 . A note on the plans, sheet 3 of 3, states "existing drive to be
abandoned" . If a portion of the driveway is to be removed the
plans should state asphalt is to be property disposed of off
site.
6 . Item M, of the application form, does not include the total land
area of the project. The plans do not give a total for the
acreage nor is the size of each of the lots (and open space)
provided. This information should be included on the application
form and plans .
Elizabeth A. Warren Page Two May 4 , 1994
7 . The regulated area ( 80 foot setback from the Podunk River) should
be shown on the plans . They are not proposing any activity in
this area.
8 . Revised plans, and additional information, should be submitted to
Town Staff for review prior to presentation of the application to
the Commission.

RE: AHEARN SUBDIVISION - 94-08P
We have reviewed the revised drawings dated 4-15-94 for the proposed
Ahearn Subdivision and have the following comments :
1 . Plot Plan - new monuments must be numbered and the
coordinates listed.
2 . Topographic Plan
a. The proposed sanitary sewer force main must be approved
by WPCA.
b. Cleanouts are required in the sanitary force main.
C . The proposed 242 contour on lot 4 intersects the
existing 244 contour with no reworking of the 244
contour. This must be corrected.
d. Grading between lots 3 & 4 should have a swale between
them to keep the stormwater between the lots .
e. Profile of proposed force main should be shown.
3 . Sheet 4 - Permanent pavement patch detail is required.

Mr. John E. McCahill RE: Proposed;subdivsion of Mary
Zoning & Wetlands Enforcement I. Ahearn, Abbey Road
Town of South Windsor
1540 Sullivan Ave.
South Windsor, CT 06074
J fv\
Dear Mr. McCahill,
The proposed land contour modification and subsequent construction of
homes on the property of Mary I. Ahearn should be PROHIBITED. The following
reasons are offered as justification for this prohibition.:
1) The area of Wood Pond Rd. and Rockledge Dr. was zoned as a minimum of
0.5 acres per home. Allowing the proposed lots smaller than this would
significantly adversely affect the aesthetics of the area and decrease
the property values on ajoining land. The zoning has been effect for
over 12 years.
2) The area in question is the channel for draining 8 existing homes/yards
(ie over 6 acres) . By constructing homes on the proposed locations, the
natural flow patterns of this water into the Podunk River would be
negatively affected. This change in the feed system may be in violation
of Federal laws and regulations and may require the Corps of Engineers
approval. An enviromental impact study following the EPA and/or Corps
protocols should be required before granting construction permits.
3) By modifying the area, a swamp would be created, thereby allowing
insects to breed and creating an odor source. The adverse impact on
the homes and lifestyle would be significant. The swamp would also be
a hazard to the small childern living on ajoining and nearby properties.
If pipes are planned to try to drain the area, the amount of trees and
debris would clog them and routine clean out would be highly
questionable.
4) Standing water creates breeding grounds for disease carrying insects.
There has already been a case of Lyme disease on Rockledge Dr. . The homes
along the lower portion of Wood Pond that have the ponds behind them have
significant problems with insects which adversely affects their lives
and property values. Creating a pond in our backyard irreparably
damages the value of our homes and negatively impact our lives.
5) The area has a certain amount of wildlife that would be deprived of
habitat and hunting area. The following fauna have been observed in
this area: fox, deer, hawk, snapping and other turtles, snakes,
salamanders, woodpeckers and bats.
Please deny the application for construction.
Sincerely yours,
"MaAaA

Town of South Windsor
1540 Sullivan Ave.
South Windsor, CT 06074
Dear Mayor Ryan,
I wish to relate to you and the Town Council the obnoxious and
arrogant behavior of the Chairman of the Planning & Zoning Commission.
The issue was a proposed division of property ajoining mine from
Abbey Road. When I first discovered this proposal and I went to speak at the
Commission meeting on May 10, 1994. After waiting for an hour to speak, I
Politely addressed the Commission to ask if I could make comments. I was
rudely told that the public hearing was last month. However, there was no
notice posted (I travel that road daily) . The only notice seen was for
the Wetlands meeting but that was posted far into the woods and had curled
and faded and could not be seen from public access areas. When I quietly
raise this issue about proper notice, I was told I was out of line and
the comment period was over and to go away.
This lack of proper notice sustains a powerful local attorney and
developer who, as it appears, tried to clandestinely obtain variances.
The dictatorial actions of the Chairperson and obvious efforts to silence
concerned and adversly affect residents smacks of favortism and possible
illegal benefit to him.
Would your office please investigate possible collusion between
the Chairperson and the landowner. Also the survey maps at the meeting
had errors on them that I was not allowed to point out to the
Commission. After months of work protesting the nuclear dump near my
property, I am now being victimized by the town who is allowing a swamp to
be created on or near my property.

Richard J. Owen

Dear Ms. Ahearn:
Re- EXPIRATION OF PERMIT 94-08P, Ahearn Subdivision
This is a reminder that the permit with the Inland Wetlands Agency/Conservation
Commission, application #94-08P, Ahearn Subdivision will expire on May 10, 1999.
If you plan to extend your project beyond the above expiration date, you must apply
for an extension at least sixty-five (65) days prior to the expiration date. There will be
a thirty-five dollar ($35) fee required for an extension of the permit. This includes a
ten dollar ($10.00) surcharge assessed by the State, to fund the State Environmental
Review Team.
An application for an extension shall be made in accordance with the 'following
subsection of the IWA/CC Regulations:
a. The duration of any amendment or extension shall be for three years unless
otherwise specified in the permit.
b. The application may incorporate by reference the documentation and record of the
original application.
c. The application shall state the reason why the authorized activities were not
initiated or completed within the time specified in the permit.
d. The application shall describe any changes in facts or circumstances involved with
or affecting wetlands or watercourses or the property for which the permit was
issued.
e. In unusual situations the Agency may accept an untimely application to extend the
expiration date of a permit if the authorized activity is ongoing and allow the
continuation of work beyond the expiration date if in its judgement, the permit is
likely to be extended and the public interest or environment will be best served by
not interrupting the activity; the application shall describe the extend of work
completed at the time of filing and the schedule for completing the activities
authorized in the permit.
f. The Agency shall evaluate the application pursuant to these regulations and grant
the application as filed, grant it with any terms of limitations, or deny it; and shall
state upon the record the reason(s) for its decision.
In the event that you are requesting an extension, section 8.1.6 of the Zoning
Regulations establishes the process for monitoring the approved conservation plan.
Per that regulation, a progress report is required from the applicant's engineer
verifying that erosion and sedimentation control measures have been installed and
maintained in accordance with the approved conservation plan. This verification
report shall also be submitted 65 days prior to the expiration date of the permit to
allow time for the Commissioners to evaluate your project controls.
If work has been finished or will be finished by the expiration date, please send a letter
stating work is completed according to the approved plan.

Dear Mr. Ahearn:
RE: 4-LOT SUBDIVISION,ABBE ROAD
The above-referenced subdivision, approved by the Planning and Zoning Commission on May 10, 1994
included installation of a sewer line to serve the three new lots. It has recently been brought to my attention
that the sewer line has not been completely installed; instead, just a portion has been constructed to serve
Lot 1.
CGS §8-26c requires that all work in connection with a subdivision must be completed within five years
after approval. Sewers are specifically listed as one of the items included within the statutory definition of.
"work." This section of the CGS also states that failure to complete all work within such five-year period
shall result in an automatic expiration of the subdivision approval. Therefore, it appears that we have no
alternative but to place this subdivision on the next agenda of the Commission (Tuesday, September 10) for
expiration action.•I anticipate that this action will result in a notice of subdivision expiration filed on the
land records.
Please contact me immediately so that we can discuss this issue. The statutes do have a provision
whereby the Commission may grant an extension of time to complete subdivision work (to a maximum not
to exceed five years beyond the original approval). A new application for subdivision approval could also be
submitted to the Commission for approval. I do note that in either instance the Planning and Zoning
Commission will impose a surety requirement to ensure that the sewer line is constructed in the near future.
I can be reached at 860-644-2511, ext. 253; fax 860-644-7280; e-mail h:u:chrcr;.>.irhincl or by

Re: Abbe Rd Subdivision
Thanks for contacting me so promptly! Per our phone conversation today, enclosed is a copy of the
letter that I sent via overnight to your Arizona address. If I receive your subdivision renewal request in
time for Tuesday's (Sept. 10) PZC meeting, we will take care of the renewal then; otherwise we will
take care of it at the Sept.24 PZC meeting.
John Jacques installed the sewer for Lot 1. You can reach John at 860-432-1823 (office)or 305-1861
(cell). Jeff Doolittle, Town Engineer, estimates that the bond amount will be under$20,000, which will
include the remaining sewer, as-built record drawings of the fully installed sewer, and iron pins at lot
corners(for the two remaining lots).
If you have any questions, please call me at 860-644-2511 ext. 253. Once again, thank you for your
