Attorney Lawrence Bates representing Mr . Choi was present . He said
five years ago Mr . Choi signed a lease contract with Mr . Samsel to
occupy the premises for his dry cleaning and tailoring business
located at 465 Buckland Road . Some how it got by the attorneys and
the town that this business was not a permitted use in a RC Zone .
In December of 1989 Mr . Choi needed more space for a drop off and
pick up center . They inquired about renting space from Mr . Burrill
for the location located at 263 Oakland Rd . for a dry cleaning drop
off and pick up center and found out at that time that even a drop
off and pick up center was not a permitted use in a RC Zone . He
said they have since obtained a legal opinion from PZC as to whether
or not a drop off center was within the spirit of the law of what
the RC Zone permitted . A letter has been obtained from

Anp .#1529-90 - Duk Choi continued
PZC permitting a drop off and pick up center only at the Oakland Rd .
location . They were then made aware that the dry cleaners (which
had been at 465 Buckland for 5 years) was not a permitted use and
was in violation as that type of business is not allowed in a RC
Zone . Mr . Bates said a lot of money has gone into Mr . Choi 's
business over those years in the lease, the equipment, along with
hiring of a company to bolt the equipment to the floor to make it
permanent . They had done this all in good faith thinking that it
was permitted . He said they were never notified officially by the
Town until December, 1989 . Mr . Bates said Mr . Choi signed a 10 year
lease contract in December prior to being notified by the town . If
the lease is broken Mr . Samsel can sue them.
Mr . Bates said an environmental impact study was done and the only
thing of concern was the 10 gallon containers that the chemicals
used by a dry cleaners come in . He noted that Mr . Choi runs a very
clean operation and has never had a spill . He stores his empty
container at the rear of the building on a cement slab . These
containers are picked up by a licensed contractor . It was suggested
that the empty chemical containers be moved to a more protected
area. A storage area has been installed abutting the back of the
building with a lock .
Mr . Bates stated their hardship being that they're locked into a 10
year lease with Mr . Samsel and also because of the amount of money
that has been put into this business over the past five years . Mr .
Bates submitted for the record (Exhibit A) a petition with over 500
names, just from customers who have used the cleaners over the past
30 . days .
Mr . Bates said the town has made no move against Mr . Choi, however
they would like to clear this matter up and receive a variance for
this use in that zone .
Mr . Warren asked if anyone in the audience wanted to speak in favor
of this appeal .
Mr . John Samsel, 99 Ridge Road, and owner of record of the property
at 465 Buckland Road, spoke in favor of this appeal . Mr . Samsel
said he has known Mr . & Mrs . Choi for six years now. He said they
are very humble, polite, and hardworking people . He 's not sure why
or how a cleaning establishment ever got into the restricted
commercial zone . He speculated t-hat since there has only been one
or two cleaning establishments in town, when another one appeared
no one questioned it . He felt this business provides a necessary
service to the community and hoped the board would act favorably
towards their appeal .

Mr . Jim Chase, 848 Strong Road, spoke in favor . He is the owner of
Buckland Pharmacy located two doors down from the cleaners . Mr .
Chase said he has worked next to cleaning establishments in the past
and has never seen as clean an operation as the one run by Mr . Choi .
He said they never smell odors or never have seen any chemical
spills . He felt it would be an extreme hardship for the Choi 's not
to be permitted to continue at this location . He said the pharmacy
and the cleaners compliment each other as they depend on each others
traffic to bring in business . He had hoped that the board would act
favorably towards this appeal .
Mr . Robert Burrill, 52 Tallwood Drive, owner of the Oakland Road
location for the drop off center, spoke in favor . Mr . Burrill said
he felt Mr . Choi is providing a very valuable service to the town
and had hoped the board would act favorably on this appeal .
No one in the audience spoke in opposition to this appeal .
Mr . Carino asked what came first - the signing of the 10 year leasee
or notification that they were in violation? Mr . Bates said the
lease was signed at the beginning of December without any knowledge
at that time that they were in violation . Mr .' Carino asked if they
had approached PZC to include this type of business in the
regulations instead of having to obtain a variance? Mr . Bates said
they didn 't . They were not encouraged to do that .
With no further questions, the public hearing was closed .

Zone on the north, south and west side . A parking lot is being
proposed on the north side where they are asking for a 40 foot
variance to the 50 foot buffer required . They originally were
asking for a complete waiver of the full 50 foot, however now they
feel they could provide a 10 foot buffer and still have room for the
parking. Mr . DeMallie said without this buffer variance on the
north side, there wouldn ' t be enough room to put in the parking
required by the regulations . He said it is the intent of the
applicant to ask PZC for a waiver of the amount of parking spaces
required as they feel they don ' t need all that is required . They
felt no buffer was needed on the north side because the property was
adjacent to a tobacco farm operation . Mr . DeMallie said the parking
is proposed in this location because they felt if it was placed in
the center of the property it would destroy the character of the
site . They felt the 25 ' buffer on the south and west side was
sufficient and noted that the 25 foot buffer was the former zoning
standards .
Mr . DeMallie stated the hardship is justified due to : 1) site
constraints, especially the small lot size; 2) building is adjacent
to tobacco farm operation on north side therefore no buffer needed;
3) 25 feet buffer is adequate and is former zoning standard; 4) site
is in and opposite RC zone; 5) variance will facilitate preservation
of the building; 6 ) similar to Cummings & Lanza project; 7) wetlands
buffer is present between site and nearest residential ; 8) lot is
surrounded by RR Zone; 9) area is changing to office/commercial
uses .
Mr . DeMallie said the applicant has placed a deed on the property
hereto attached Exhibit A, in favor of the Town restricting the
property to office uses . The applicant will be occupying the
building for his law firm.
Mr . DeMallie presented the board with photos of the property taken
by the applicant showing the view from the south and other
locations . Mr . DeMallie briefly explained the pictures .
The porch will be expanded 6 to 8 feet, approximately 23 . 5 feet
long for an enclosed entrance to the building and will be 28 feet
from the street . Mr . DeMallie said this is the best and most
logical location for the addition . He said the hardship for this
variance is because the house was constructed prior to zoning.
Mr . Warren asked if there was anyone in the audience who wanted to
speak in favor of this appeal .
Mr . John Samsel , 99 Ridge Road, spoke in favor of this appeal . He
said Mr . Berman is presently a tenants of his . He said

he hoped the commission would take a practical approach to this
application based on where this property is located . He noted it 's
very obvious by looking at the parcel from the south and west side
there is probably never going to be any type of building. Mr .
Samsel asked that the commission take favorable action on this
appeal to preserve the integrity of that building. He felt this is
the best use for that building.
The applicant, Mr . Frank Russo, was present and spoke briefly about
his reasoning for taking the pictures of the property. He said the
view from the center of his property looking south and southwest is
beautiful and also noted that the parking in the north would be the
best location for it .
No one spoke in opposition to this appeal .
Mr . Carino asked what the uses of the properties surrounding Mr .
Russo 's property. Mr . DeMallie said as your facing the property to
the left there is a large farm field which goes back and around the
property to the rear . It 's all vacant land to _ the Podunk River
owned by RSK Kellco, residentially zoned . The closest house is
quite a distance down Clark Street . Across from the property is Mr .
Samsel 's property which is in a RC Zone and beyond that four houses
commercially zoned . To the north side is Mr . Waldrons property with
a tobacco shed . He said there 's also a beauty salon located there .
Mrs . Neary asked if there was a sketch of the proposed addition .
Mr . DeMallie said they did not have an architectural drawing. Mr .
Russo said the current porch is 6 1/2 feet wide and 23 1/2 feet
long. They propose to remove the porch and create an enclosed room
14 feet in width with the length being 23 1/2 feet, for a
entrance/waiting room of the office . There will be a special
entrance for handicap .
Mrs . Neary asked why the pool would remain on the property. Mr .
Russo said the office would like to use it, however, it could be
removed .
With no further questions, the public hearing was closed .

Ano .#1532-90 - Anthony Petock continued :
Mr . Petock said his boat is too long to store in his garage and
can 't fit it behind his house because of the location of the septic
system. An alternative was to park the boat in a fenced in area on
the side of the house which they received a permit to do . As they
proceeded to cover the boat with a blue tarpaulin they found it to
be an eyesore to the neighbors and anyone driving by. So they went
ahead and enclosed it in a shed type building attached to the house .
They were then advised by the town that they were in violation of
the zoning regulations without getting approval from ZBA to encroach
into the sideyard . He said they have consulted their immediate
neighbors about this appeal and said there were no objections .
The shed does not have a foundation, only crushed stone on the
flooring. The shed was designed to be removed when no longer
needed .
Mrs . Petock said they can 't feasibly park this boat behind the house
because of the septic system and also because there 's trees on the
side . She noted they also are not allowed to park it in the
driveway.
No one in the audience spoke in opposition to this appeal .
Mr . Carino asked why the boat couldn ' t be parked in the back. Mr .
Petock said he would have to go over his front yard every time he
wanted to park the boat in the rear . Mr . Petock said he stores his
boat here all year and uses it about every weekend during the
boating season . He noted there is also a row of trees which would
have to be removed to do that . Mr . Carino was concerned that
emergency vehicles would not be able to get to the back of the house
with this shed up .
Mr . Warren asked how far the shed is from the property line . Mr .
Petock said there 's two feet left on the side . They are encroaching
8 feet into the sideyard setback.
With no further questions from the board, the public hearing was
closed .

CORRESPONDENCE:
Mr . Warren noted that a letter had been received from Attorney Grace
regarding the Strong Auto Repair Shop located at 394 Graham Road .
The letter noted that a special exception was granted in 1970 for
this business to operate and the owner is transferring the business
to his son . The Motor Vehicle requires a license to be updated
which would require the signature of the Chairman of ZBA. They are
requesting that the public hearing be waived since it is just a
transfer .
The board advised the secretary to advise Attorney Grace that the
Chairman would sign the application for Mr . Strong's license .

Our boat is 24' long and too long to store in our garage. We cannot readily fit it
behind our home because of the septic system. An alternative was to park it in on
the side of the house which was fenced in per your permit. As we proceeded to cover
the boat, we found that the blue tarpaulin went well above the fence. We felt this
appearance was not only a sore sight for our neighbors but for anyone going by the
roadside. We had noted this solution by several others in our neighborhood. By
enclosing the entire area we felt it would be more appealing for everyone concerned. _
We have consulted our immediate neighbors whose property abuts ours and they have no
problems with the aforementioned structure.

RE: Appl. #2176-93 - Renewal of a 2 year temporary and conditional
permit for an enclosed fenced-in area for a
recreation vehicle closer to the property line
than permitted, A-20 Zone.
Dear Mr. Petock:
This is to notify you that the two year temporary and conditional
permit approved by the Zoning Board of Appeals has expired.
Temporary and conditional permits are no longer under the jurisdiction
of the Zoning Board of Appeals . Effective 11/18/95 they are under
the authority of the Planning and Zoning Commission.
If you wish to continue this use, it will be necessary for you to
contact the Planning Department at the South Windsor Town Hall,
644-2511, ext. 253, regarding changes in the application procedure.
Thank you.
Very truly yours,

PETOCK T & C PERMIT RENEWAL - PH 2/13/96
1. Request for renewal of a temporary and conditional permit for storage of a
boat within a shed that is 2-3 feet from the property line in an A-20 zone
(10 feet required). (Note that the parking of boat trailers is permitted only
on that part of the lot that is within the front and side building lines, and
not closer to the rear boundary than 10 feet.) ZBA first granted approval
to this request in February 1990, then renewed it in December 1991 and in
December 1993. The permit did expire in December 1995. In all of the
ZBA approval letters, there was a statement that, "This permit will expire
in two years...and will have to be renewed at that time if the use is to be
continued."
2. The wording of the T & C permit regulation is that, "Temporary and
conditional permits may be granted by the Commission for a use which is
not specified elsewhere in these regulations for a period not to exceed two
years. Such approval may be given after a Public Hearing if, in the
judgment of the Commission, the public convenience and welfare will be
substantially served, and the appropriate use of neighboring property will
not be substantially or permanently injured, and traffic and other hazards
will not result from such use."
3. The A-20 zone allows sheds and accessory structures, but they must be
located within the applicable building setbacks. Therefore, the T & C
regulation provision, "for a use which is not specified elsewhere in these
regulations," is not met.
4. Because of the length of time that this use has existed with ZBA approval,
the Commission may want to explore alternatives for the future with the
applicant, in combination with a permit renewal for a limited time frame.
