Application for a special exception to Article 5.7 and site plan of development for the establishment of a mixed use including a tea room and residence at an existing building located at 1700 Ellington Road, RC zone. 2. Under the mixed use zone classification the uses permitted include those permitted uses of the underlying zone as well as dwelling units in commercial buildings. This type of development is allowed by special exception in the RC, GC, RO and Office Conversion Overlay zone. 3. The design criteria of the mixed use buildings are as follows: - dwelling unit must be located above the commercial uses- no residential use on the first floor; - only one level of dwelling units are allowed - a separate entrance is required for the dwelling unit - two parking spaces per unit are required (applicant may request a waiver if shared parking with commercial activity is adequate) - storage area of 60 s f must be provided in addition to normal storage area of dwelling - pedestrian circulation must be attractively designed - adequate lighting of both pedestrian and parking areas must be provided - sound insulation must be provided between commercial and residential levels - a max. of 25 units allowed; no minimums - where dumpsters are proposed, they must be shown on the site plan-they must be on a concrete pad and screened - all building codes and fire safety requirements must be met 3. The special exception criteria which must be considered include: - there is a balance between neighborhood acceptance and community needs; - the existing/proposed commercial/office uses are not incompatible with residential uses; - the internal traffic circulation pattern is designed to minimize safety hazards - site design adequately reflects that residents' needs are accommodated as an integral part of the site design - the proposed mixed use furthers the purpose stated in 5.7.1 (to increase the supply of affordable[entahousing) - present and proposed utilities, streets, drainage system, and other improvements have adequate to accommodate the proposed use - there is no undue concentration of high-density residential development in any area/neighborhood 4. The applicant is proposing to have a Tea Room setup on the first floor and to live on the second floor. 5. The parking required for this use is based on the parking requirement for a restaurant (1 space for 50sf gfa), because that is the closest use that our parking regulations include. Two additional are spaces required for the proposed residential unit (unless a waiver is granted per Sec.5.7.4.d). The applicant has provided 14 spaces with 32 required per our parking formula. The applicant is requesting a waiver for the balance of the parking required. It is difficult for staff to know what parking will be needed for this type of use as we have no other similar facilities to compare it with. We have asked the applicant to investigate the possibility of adding additional parking spaces in the future. The applicant's engineer has indicated that there is a significant portion of the property that is wetlands and does not see how additional spaces could be added. The police department has reviewed the plan and has expressed no concerns provided that this use does not evolve into a restaurant serving meals. If that should happen, the parking would likely become inadequate. 6. There are regulated wetlands on the site (although they have not been flagged). There is no new activity proposed on the site at this time making it unnecessary for a wetlands or conservation approval. 7. The site is currently serviced by public water and sewer. We have advised the applicant that WPCA approval may be necessary for the combination use. 8. There is no dumpster shown on the plans. Does the applicant propose to add one? If so, it must be shown on a concrete pad and screened. If this application is approved, the planning department requests the following modifications: l. Key map must conform to Sec. 8.1.2.1 of the Zoning Regulations 2. Parking breakdown must be shown - (Restaurant 1 space for each 50 sf of gfa; 2 spaces per single family unit). Note: A waiver to the number of required parking spaces is being requested 3. Building lines must be shown on the plans. 4. Parking in existing gravel area must be delineated ENGINEERING COMMENTS 1. Handicap parking is required 2. Utility connections to the building should be shown (i.e. sanitary/septic, water, etc.) /home/lipe/SnEREVIEWS/vogelsangph i r VOGELSAND TEA ROOM PLANNING CON04ENTS Key Man 1. Key map must conform to Sec. 8.1.2.1 of the Zoning Regulations - Layout of parking must be shown - Lines indicating proposed drainage on the property must be shown - Lines indicating sanitary sewer system with direction arrows must be shown Zoning, Data Table 1. Parking breakdown must be shown - (Restaurant 1 space for each 50 sf of gfa; 2 spaces per single family unit). Note: A waiver to the number of required parking spaces is being requested Topo/Plot Plan 1. Building lines must be shown on the plans. 2. Utilities must be shown on the plans 3. Parking in existing gravel area must be delineated General Comments 1. We would recommend that a reserve parking area be shown on the plans (possibly on the westerly side of the site). If the Commission requires this parking area, wetlands will need to be flagged on the site to examine the feasibility of expanding the parking area in the future. 2. The applicant should be prepared to address the special exception criteria listed in Section 5.7.5 the zoning regulations 3. WPCA approval may be required. ENGINEERING CON 4ENTS 1. Handicap parking is required 2. Utility connections to the building should be showm (i.e. sanitary/septic, water, etc.) 3. Will there be any grading or clearing in the gravel parking.area?
