There can't be a conveyance without any consideration mentioned in the instrument. The appropriate consideration in this case should be "for good and valuable consideration. " 2. The conveyance is not "under" the State of Connecticut, it should read unto the State of Connecticut. 3. The conveyance should not grant a "right to drain" , it should be a drainage right of way easement. 4 . The last portion of the first paragraph after the semicolon should be removed. "said right being more specifically. . . " This will be addressed in item 6 of this review. 5. The first line of the description would be clearer if the reference were to the northeasterly highway line. 6. Town Attorney Town of South Windsor Brady, Willard and Alexander 330 Roberts Street East Hartford, CT 06108 Re: Drainage Easement - Porter' s Share Dear Ralph: Enclosed please find a copy of a letter dated August 22nd which I just received from Robert Ike at the State of Connecticut Depart- ment of Transportation. Enclosed please find a revised Drainage Right of Way incorporating the comments made by Mr. Ike . I also enclose a copy of the "marked-up" Drainage Right of Way document which I previously sent to you to assist you in your review of the revised document. While Robert Ike ' s comments were , of course , appropriate , I believe the requested revisions were more of form than sub- stance . Therefore, I do not believe another resolution of the Town Council should be required. I believe the enclosed document is still within the limits of the execution authority given to Liana Kuras by the Town Council at its July 31st meeting. At the same time that I am sending the enclosed copy to you, I am also sending the original and a copy of the enclosed to Lee Kuras and Jerry Iazzetta. As noted, Robert Ike had requested that the executed documents be delivered to him, My understanding is that Peter DeMallie will be delivering the signed Mylar to Robert Ike . At the same time, it is also my understanding that a request has been made by the South Windsor Town Hall staff that the executed Drainage Right of Way be delivered to you to be held in escrow and to be delivered to the Town when the mylars are delivered for recording. I would appreciate, therefore, your arranging to have the Drainage Right of Way agreement executed and then, forward to Robert Ike, a copy of the executed Drainage Right of Way agree- ment with a cover letter confirming that the executed agreement will be released from your escrow and delivered to the Town Hall for recording upon the filing of the mylar map. Please give me a call if you have any questions with regards to the above procedure. Your cooperation is greatly appreciated. As indicated in the enclosed letter, I have asked Attorney Alexander to confirm with you when he is holding the executed easement agreement in escrow for recording upon delivery of the mylar map.
