I have been on the site a number of times over the past , and have no problem as to what has been shown . It is in the Bancroft Brookwater Shed . This proposal is essentially in two phases . The roads and utilities , and then the individual site plans . Having seen the site , topsoil for restoration could become their greatest hardship . The stockpile location isn ' t shown. From a public works maintenance viewpoint , access , like in a driveway , should -be shown for the culvert at 5+60±- with some thought as to how Lots 2 & 12 will be developed . Water has already been installed through the site and with about 2 ,000 L .F. of roadway and sanitary sewers their proposal , it would seem that it could be approved if the Commission concurred with the following conditions . 1 . Completion and stabilization of the roadway slopes with a 4" minimum of top soil as per the "guidelines" . 2 . Suitable access for town vehicles to the culvert at Lots 2 & 12 . 3 . Modify the plans to show stockpile locations . 4. Modify the plans to include appropriate seed for that site . Submit the soil sample results . 5 . Indicate on the plans , proposed clearing or working limits and appropriate protection measures proposed . 6. If approval were to be considered , a bond of $10 ,000 to assure compliance with their plans might be appropriate . Very truly yours , // A . I make this request because as a homeowner residing on Old Parish Drive I have considerable concern for the feasibility of this project but will be out of state and unable to express my concern at said scheduled meeting. Having used the firm of Palmberg and Russo for my own business on 31 Edwin Road and having same firm error on our water runoff which created a problem on our own property and which we had to correct, I am most concerned that we all use due diligence in our efforts to insure the proposed site development as applied for through Inland Wetlands for the Charbonneau subdivision be vigorously inspected by the Commission and all parties heard prior to vote. Should the Commission be unable to postpone hearing this application on the 8th, then I request that I and any other concerned residents be allowed to comment at your June 22nd meeting prior to the Commission acting on this application. Thank you for your kind attention to this matter. Sincerely, (Mrs. ) Barbara Barbour Resident 5 Old Parish Drive South Windsor, CT 06074 P.S. This wetland has not become larger or wetter, just some flooding on non-wetland soil surrounding the Walpole sandy loam. Duration of wetness is short, A simple drain could eliminate this situation without disturbing the natural wetland. Lewis W. The texture of 'the surface soil varies from a fine sandy loam to a loose loamy course sand. The major soil type is the well drained Agawam sandy loam. Upon this soil type is a deposit of unvegetated soil that is a loose sand that has beed disturbed. This wind deposited soil is called Windsor sand and is very droughty. Some sand. has been taken from this site. Along the southern boundary is Bancroft Brook with some small intermittent drainages coming off this property. These three drainages are the wetlands designated as such. To the northaast boundary is a wetland area. This wetlanJ soil is Walpole sandy loam, poorly drained. Around this wetland there has been some filling that could have blocked the natural flow of water during a wet season. ,l'here is evidence that water has accumulated on non-wetland soil. My client' s property either abuts or is in the close vicinity of property located on Route 5 , South Windsor, owned by Andre Charbonneau. On October 19 , 1987 you granted an inland wetlands permit for work done on the subject property. As you are probably aware, that permit is the subject of an appeal by my clients to the Superior Court . Although this appeal is still pending and my clients realize that there is no present stay of the permit which was granted, there are some violations of the Inland Wetlands Act and Regulations which must be addressed. Prior to the granting of the permit, it is our information that Mr. Charbonneau, or someone acting on his behalf, drained a one to three acre pond that was located on the property. Although this pond was brought to your attention on June 22 , 1987 , Mr. Charbonneau was apparently never given any permission to drain the pond. As far as the minutes of the Inland Wetlands hearing was concerned, it appears that the only permission he was given was to remove the berm that was artificially increasing the size of the pond on his property. My clients do not feel that Mr. Charbonneau was ever given permission to drain the pond completely or otherwise eliminate its presence. We also understand that Mr. Charbonneau has not complied with con- ditions 5 and 6 of the Inland Wetlands permit, and that he has com- menced work beyond the boundaries specified in his plans and the limitations set forth in the Inland Wetlands permit. We would like to have a hearing on this as soon as possible and for the Commission to take appropriate action to enforce both its regula- tions and the Connecticut Inland Wetlands Act . The Agency agreed to invite Mr. Beck and Mr . Charbonneau to a future IWA/CC meeting to discuss this matter in a fact—finding hearing . The items that would involve the inspection or review by town staff include the pond and approval conditions five and six of the Inland Wetlands permit. The pond is contained within the area of the roadway construction as shown on the approved plans; therefore its existence would be eliminated. The approved plan shows that the pond will be drained as well as drainage of the wet area. The plan also calls for an earth excavation of over two feet in the pond area. With respect to approval condition #5, the soil sampling will be required immediately prior to stablization of the site; there is a note on the modified plans (sheets 2 & 10 of 11 ) indicating this will be done. The clearing or working limits (approval condition #6 ) has also been shown on sheets 8 & 9 of the modified plans . The plans were revised through 11/18/87 to include the Inland Wetlands comments and were submitted to the Town on 12/11/87 consistent with item 7 in the Inland Wetlands Agency/Conservation Commission letter of approval of 10/30/87 . On January 8, 1988, town staff met on-site with Douglas Cooper of DEP's Inland Wetlands Unit, at his request. At the conclusion of the site inspection, Mr. Cooper indicated that he did not see any reason for DEP to become involved. Beck: At our March 14, 1988 Inland Wetlands Agency/Conservation Commission meeting we discussed alleged permit violations on this site . It was the view of the Agency that at this time no violations were believed to be evident which would require action by the Agency. Furthermore , it is our understanding that a letter will be forthcoming from the Army Corps of Engineers regarding the possible necessity for individual permits . Apparently, the Corps will allow no filling or excavation on any of the individual lots having wetlands . Meanwhile the Agency will continue to monitor closely all activities on the site . South Windsor, CT 06074 Dear Mr. Charbonneau: This is in response to your request for a Department of the Army permit to fill approximately 0.70 acres in conjunction with the construction of an access road to the proposed Andre Charbonneau Industrial Park on Rt. 5 in South Windsor, Connecticut. That work is permitted under Title 33 Code of Federal Regulations, Part 330.5 (a) (26) and (14) Nationwide Permits, as published in the November 13, 1986 Federal Register, and does not require further processing. This authorization is made in accordance with the plans attached hereto entitled, "Resubdivision Property of Andre Charbonneau South Windsor, Connecticut" in 3 sheets dated "2/88" and subject to the attached conditions. Any additional fill placed in the waterway or wetlands to facilitate construction of this activity and development of lots will require an individual permit. This verification that the work is permitted by a Nationwide permit is valid only for a period of two (2) years from the date of this letter. If work is not commenced or under contract by that date you must request a new verification to determine whether this Nationwide permit has been modified, suspended or revoked. Note that these conditions require the use of other practical alternatives to avoid or minimize the discharge of dredged or fill material into waters and wetlands of the United States. S Before you begin work, you are required to obtain any necessary State and/or local permits, and other necessary Federal permits. Should you have any questions concerning this matter, please contact Stephen DiLorenzo at 617-647-8152 or use our toll-free number 1-800-343-4789 or 1-800-362-4367 if calling within Massachusetts.
