SECTION III--DA TES AND SIGNATURES I hereby declare that the data&information contained herein is accurate to the best of my knowledge. Dated this 13'h d f April 2006. Applicant: ( gna e*411 /L OWNER: ,' (Si ture) SECTION IV—ACTION OF THE BOARD Approved: Denied: Narrative Statement Variance Application K.D.Nutmeg Properties, LLC 260 Nutmeg Road South South Windsor, Connecticut April 13, 2006 K.D.Nutmeg Properties, LLC has entered into an agreement to purchase 260 Nutmeg Road South, a 1.38 acre building lot in the Constitution Landing Industrial Park. Subsequent to the execution of the agreement, the applicant retained Design Professionals, Inc. to complete land surveys (A-2 boundary and topographic), soils testing, as well as to prepare a concept layout, and eventually an engineered site plan for their proposed industrial building. The tenant will be AME Plumbing and Heating, LLC,which proposes to relocate to this new building from East Granby. The applicant has intended to build a structure which will meet their initial requirements for 1,200 square feet of offices and 3,000 square feet of warehouse space, but also their future space needs, i.e, an additional 1,200 square feet of offices and 3,000 square feet of warehouse space. Until that space is needed, the building will be designed to have two tenant spaces, one for the headquarters and operational center for AME Plumbing and the other for a tenant. The economics of construction dictate that it would be far less expensive to build the entire 8,400 square feet building now rather than to do it in phases. The applicant believes that there is enough demand in the marketplace to fill the tenant space until that space is needed for their own requirements. The variance being requested is to Section 10.2 to allow a 10 feet rear yard instead of a 25 feet rear yard (i.e., a 15 feet rear yard variance). The peculiar circumstances and hardships that directly relate to this variance application are: 1. The applicant has projected their current and future space requirements and has concluded that they will eventually need an 8,400 square feet building, as depicted on the ZBA plan, dated April 4, 2006. 2. In consideration of construction efficiencies and costs, the building should be of a generally rectangular shape. Such a building is depicted on the ZBA plan. 3. The applicant has consulted with numerous builders and design professionals in order to arrive at a building shape which meets their current and future space needs. 4. Although the parcel is 1.38 acres in size, its true buildable area(i.e., area available for constructing a building which is outside of required yard setbacks and wetlands),prior to the requested variance, is only 24,183 square feet or just over %2 acre. That constitutes approximately 40%of the site. We therefore conclude that the buildable area is relatively small for a parcel of this size. 5. The buildable area on this particular lot is substantially reduced given the presence of regulated inland wetlands. The wetlands comprises approximately 1/3 of the site(.45 acre),which restricts the buildable area to the front of the property. 6. In the northerly portion of the lot the buildable area is only 75 feet in width between the front yard setback line and the wetlands. This, of course, does not reflect that a strong objective would be to keep any building development out of wetlands, if at all possible. We were unable to design a concept layout in the with the building in the northerly portion of the site which remotely meets the client's requirements for building floor area, building shape and parking. 7. The only location on the site which supports a building meeting the present and future space requirements of AME Plumbing and Heating is in the southwesterly corner, as depicted on the ZBA plan. This particular scenario does not work without the requested variance, due to the need for circulation, parking(including parking for other potential tenancies/uses in the warehouse area),building access, and the relationship of the building to required yards, especially the front yard setback at the northwesterly corner of tenant office space A. Nutmeg Properties, L.L.C. for 260 Nutmeg Road South Ladies and Gentlemen: On behalf of the Economic Development Commission, I would like to convey the unanimous support of that body regarding the above application. At its April 26, 2006 meeting, the EDC was briefed on the project and was favorably impressed with both the economic opportunity presented and appropriate use of the land. This is a uniquely situated lot. The location of its frontage, rear and side yards in combination with wetland area clearly creates a hardship. The configuration presented is the best of many alternatives considered. Significant thought and planning has obviously been given this matter and the applicant is putting forward a scenario that maintains the intent and objectives of our zoning regulations and development plan. The concept ensures quality and the best development of the lot. In the opinion of the EDC and myself we believe the Town's best interests will be served in the approval of this application. We find the applicant agreeable and cooperative. In the event there are any issues of concern, we are confident that the applicant can work with you and your staff to address them. Please do all possible within your defined role to assist the realization of this worthy project. Thank you for your attention to this very important matter. The Board concluded the hardship to be the odd shape of the lot, reduced building area, large amount of wetlands, and the need for a swale make it difficult to place a building anywhere else on the property. Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction.
