Re: Appl: #2444-99—Patricia Conrad, 864 Strong Road, RR zone.
Dear Ms. Conrad:
At the meeting of the South Windsor Zoning Board of Appeals held on October 7, 1999, the Board denied
your request for a variance to section 4.1.4 e, to allow a structure housing a goat closer than 150' to the
nearest residential structure at 864 Strong Road, RR zone.
The Board concluded that there was no hardship demonstrated that would allow them to approve this
application.
Very truly yours,

Re: Chronology of the Conrad application #2444-99.
At the request of Marcia Banach, Direction of Planning I will attempt to review the events
that led up to the zoning violation being issued, resulting in application #2444-99.
In late July, 1998 1 responded to a complaint by Mrs.. Conrad of a potential wetland violation
and activities occurring within a conservation easement. At the time I noticed that Mrs
Conrad kept a goat, pen, and enclosure on the property. We discussed the proximity of the
enclosure to the property line and I mentioned to her that I interpreted the regulation
regarding structures housing animals to pertain to livestock and not to pets. At the time
there was no complaint about the goat by the neighbor, Mrs. Mattis.
In March, 1999 1 received a complaint by Mrs. Mattis concerning offensive odors coming
from the goat enclosure. I sent Mrs. Mattis a copy of the section of the regulations specific
to animals and a complaint form. I told her that I had not considered pets to be applicable
to the regulation but if she lodged a written complaint I would have to confer with the
Planning and Zoning Commission for an interpretation of the regulation. I received a written
complaint from Mrs. Mattis and sent a memo to the PZC for an interpretation of the
regulation (enclosed). The Commission stated that the regulation would only pertain to
animals that were housed in the structure overnight.
Based on this interpretation, the Conrad structure was in violation of the regulation and I
issued a violation notice to the Conrads. In early April, 1999 1 talked to Attorney Otis on an
unrelated issue and mentioned the issue of the goat house and that the Conrads had not
responded to the violation notice. He stated that he would talk to his client and if they were
in violation, then they would have to comply.
By May, 1999 the Conrads had not complied with the violation notice and I had received
further complaints from the Mattises so I issued a cease and desist order to the Conrads.
Mrs. Conrad has submitted the ZBA application to address the violation.

Re: Section 4.1.4e
I would like to get some clarification on section 4.1.4e of the zoning regulations. This
section pertains to the placement of buildings housing animals or poultry.
Does this section include all animals or strictly livestock? My interpretation is that this
applies to livestock and not pets. If it includes pets then dog houses, rabbit hutches, etc,
would have to conform to the setback distances. These distances cannot be met on
smaller lots '(A-20 zone). If it does not include pets then can a pig or a goat be considered
a pet if it is not used commercially?
Definition from Webster's Ninth:
Pet— a domesticated animal kept for pleasure rather than utility.
