Dated this loth day of August Year 2000 Applicant: ir/v C 4 (Signature) OWNER: C l Si ure) Approved: ¢ Denied: Revised 12/04/98 `variance and Location Approval Application Route 5 Motor Cars,Inc. August 10, 2000 Route 5 Motor Cars, Inc. respectfully requests location approval at 1429 John Fitch Boulevard for a motor vehicle dealer. As per the attached letter dated June 25, 2000,the Planning and Zoning Commission approved as a permitted use, subject to a subsequent site-plan application approval, this site's use as a motor vehicle storage and wholesale sale's operation(general repair of motor vehicles as accessory use to wholesale sale of motor vehicles). We are also requesting a variance for a modest increase(7%) above the maximum impervious coverage limitation. The enclosed plan portrays an impervious coverage of 72%, with the addition of gravel parking to the rear of the site. Strict adherence to the 65%impervious coverage limitation will cause unusual hardship and exceptional difficulties for the following reasons: 1) The applicant has entered into an agreement to purchase 1429 John Fitch Boulevard from Frank Magnani and Joseph R. Gervais subject to securing approvals from the ZBA and PZC for conducting a wholesale sales/storage operation on this linear property. Given the very narrow(75 feet) and elongated nature of the lot,the only area available for parking cars for sale is to the rear of the building, other than a very limited area on the south side of the building. 2) Limited parking spaces between the building and the street are only available for employee and customer parking. 3) All parking of vehicles for sale will be behind the fence enclosure, i.e., behind the front of the building, and generally out of view of the motoring public. 4) The vast majority of vehicle storage is completely obscured from view as one traverses John Fitch Boulevard, due to the placement of the two-story building and the significant drop in elevation to the west of the building. 5) Given the narrowness of the site, steep slopes and the existing building placement, the parcel has little value unless additional storage capacity is allowed to the rear of the site. 6) Most of the existing parking, which is paved, is within the state highway right- of-way(Route 5). 7) The motoring public only views the small parking lot, building, fence and beginning of the storage area. 8) Existing building is non-conforming to front yard setback due to a taking by the Connecticut DOT in order to accommodate a Route 5 widening, which further reduce the land available on the site for parking/storage or any other use. 9) The parcel is non-conforming to frontage requirements(75' vs. 100'required). 10) Historically the back area of the lot was extensively used by a prior owner-The Meter&Tank Company, and was cleared. Box 161 South Windsor, CT 06074 Re: Appl. #2476-00—Route 5 Motor Cars,Inc., 1429 John Fitch Boulevard,I zone. To Whom It May Concern: At the meeting of the South Windsor Zoning Board of Appeals held on September 21, 2000, the Board approved your request for: 1) a variance to section 10.2 to allow 72% impervious coverage (65% allowed); and 2) a State Hearing under section 14-54 of the General Statutes for location approval of motor vehicle dealer and general repairers license, at 1429 John Fitch Boulevard, I zone. The Board concluded the hardship to be the long narrow lot configuration makes it difficult for any commercial business to have only 65% impervious coverage. The Board placed the following condition on the impervious coverage: Subject to site plan approval by the Planning&Zoning Commission. The Board placed the following conditions on the motor dealer and general repairers license: 1) Subject to site plan approval by the Planning &Zoning Commission. 2) No vehicles to be stored in the front portion of the site. Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction. Route 5 Motor Cars, Inc.
