Kasheta 1305 Main Street South Windsor, Connecticut DPI Proj. No. 636 December 16, 2004 Variance requested to Section 3.10.3 to allow enlargement of a non-conforming house, and to Section 10.2 to allow an addition within the required front yard(22 feet variance). The applicant,Kelly A.Kasheta, her husband, Donald, and their two year old son, Billy, reside in a small house on the westerly side of Main Street. In 1996,the Zoning Board of Appeals unanimously granted Kelly variances to Section 3.10.3 to allow expansion of a non-conforming structure, and to Section 10.2(40 feet variance)to allow an addition to be 10 feet from the property line. At that time, the historic residence was very small, containing only 896±sq. ft. (1.5 bedrooms, 1.5 baths, kitchen, living room, laundry and no 1"floor closets). In order to accommodate a family room, closet storage, and to convert the living room into a second bedroom for a child(it is now Billy's bedroom),the Kashetas built an attractive 22'xl8' (396 sq. ft.)on the north side of their residence, plus porch, giving them a total floor area of approximately 1,292 square feet which is still non-conforming to the minimum A-40 zone house size. Kelly and Donald now propose to build a 13'x18' (234 sq. ft.)addition in the back of the original house, i.e., off the kitchen, which will enlarge the house to a total of 1,526 sq. ft.,which will now conform to the house size requirements of Section 11.2. This four season room will be approximately 28 feet from the front property line, hence the need for a 22 feet variance. The hardship and particular circumstances in support of this application are: 1. The historic residence, built in the 1800's, pre-dates zoning; it cannot reasonably be moved. 2. The Kashetas have worked for some time with their builder, David A. Patna of South Windsor,to arrive at the best design and location for this addition. 3. The proposed addition is to the rear of the house, behind the main house, and approximately seven feet beyond the 1990's addition. 4. The historic residence is approximately 2 feet from the front property line. 5. With the addition, the house will them conform to the minimum house size requirements of the A-40 zone, as per Section 11.2. 6. The subject lot, at only.37 acre(.92 required), is undersized for the zone. 7. Abutter to north is on the far side of Stoughton's Brook. 8. Historic Main Street has numerous houses which are non-conforming to the front yard setback. Thank you for your consideration of this request. Attn: Peter DeMallie 165 South Satellite Road South Windsor, CT 06074 RE. Application #2637-05—Kelly A. Kasheta, 1305 Main Street, A-40 zone Dear Mr. DeMallie: At the meeting of the South Windsor Zoning Board of Appeals held on January 20, 2005, the Board approved your request for a variance to section 3.10.3 to enlarge a nonconforming house within the front yard setback and a 17' variance to section 10.2 to allow a 33' front yard (50' required) at 1305 Main Street,A-40 zone. The Board concluded the hardship to be as follows: 1. The size of the property creates difficulty placing the house in any other location on the property. 2. The approval will bring the house into conformance with the minimum size requirement for this zone. Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense. Very truly yours, 1 6i fr tephen Wagner, Ch irperson Zoning Board of Appeals SW:dr cc: Building Department I, Stephen Wagner, Chairman of the South Windsor Zoning Board of Appeals hereby certify that on January 20, 2005, the Zoning Board of Appeals granted to: Kelly A.
