Dated this day ofj4P,7,j e/ Year 00 0 Applicant: (Signature) OWNER: (Signature) Approved: Denied: Revised 12/04/98 Item 13 —Hardship This property previously received a variance to allow two lots with less than the required frontage and square footage (appeal no. 504, Feb. 5, 1966). Specific lot frontages of 95 ft. and 100 ft. were proposed at the previous hearing and approved. Using the previously approved frontages would result in a non-conforming side yard setback for house no. 293 Long Hill Road. Therefore, revised frontages of 8 1.11 ft. and 113.90 ft. are being proposed so that the two lots will conform to the present side yard requirements of zone RR. The Board concluded the hardship to be as follows: 1. The size and shape of the lot creates difficulty in constructing a structure in a conforming area. 2. The placement of the septic and well creates difficulty in constructing a structure in a conforming location. The Board placed the following conditions on this application: 1. Approval is contingent on subdivision approval by the Planning&Zoning Commission. Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense. Boisseau 283 Long Hill Road South Windsor, CT 06074 Re: Appl. #2629-04— Roger M. Boisseau, 293 Long Hill Road, RR zone Dear Mr. Boisseau: At the meeting of the South Windsor Zoning Board of Appeals held on October 7, 2004, the Board approved your request for two variances to section 10.2 (a modification to an existing variance granted in 1966): 1) a 61' variance to allow a house with frontage of 114' (175' required); and 2) a 93' variance to allow a house with frontage of 82' (175' required), at 293 Long Hill Road, RR zone The Board concluded the hardships on the property to be as follows: 1) The Board cited the original hardship from 1966, which states, "It is the feeling of the Board that not to permit this variance would cause a hardship in not allowing development of the property in conformance with the general area". 2) The Board also recognized that the variance would eliminate the potential for a nonconforming side yard. Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense.
