SECTION HI-DA TES AND SIGNATURES I hereby declare that the data&information contained herein is accurate to the best of my knowledge. Dated this 15th day of Se tember Year 2005 Applic (Si tore .OWNE gQ 2 ( ature) SECTION IV-ACTION OF THE BOARD Approved: o Denied: Narrative Statement RECEIVED Variance Application Berman, Russo & Sulick NOV 1 2005 819 Clark Street South Windsor, Connecticut SOUTH WINDSOR PLANNING DEPT. September 15, 2005 Revised October 31, 2005 Berman, Russo& Sulick previously converted the former Gustaves Grant homestead, circa 1818 (which is one of the few remaining from that period in Wapping), to their law offices. In order to accomplish the project, the process included securing a zone change to the Restricted Commercial zone in January of 1990, the granting of variances in November, 1989 and February, 1990, approval by the Town Council of restricted covenants(which are now on file in the office of the Town Clerk), and finally, site plan approval from the Planning&Zoning Commission on June 26, 1990. The subject of this application is to modify the February 1990 ZBA variance approval to allow a two-story office addition on the south side of the building containing up to 1,600 square feet plus a full basement and a 112 square feet enclosed porch entrance. This addition(800± sq. ft. building footprint and 112±sq. ft. enclosed porch)will be historically and architecturally compatible with the existing 187 year old structure. The addition will be no closer then 50±feet from the front property line along Clark Street, requiring a variance to Section 10.2 (15 feet variance). The second reason for the application is to modify the original approval condition, which stated that"no further buildings will be put on the property". In reviewing this language and the minutes of the February 1990 ZBA meeting, the Town Attorney and Director of Planning concluded that the applicant should return to the ZBA to seek approval for a building addition, although it does not constitute a new building. The peculiar circumstances and hardships which support this application are: 1. The ZBA previously granted variances to allow the existing building within 19.7 feet off Clark Street(November, 1989) and an addition within 28 feet of Clark Street(February, 1990). At this time, the applicants wish to secure approval to erect an office addition further back from Clark Street, however, 15±feet short of the 65 feet front yard. The addition which was the subject of the 1990 variance was never constructed. 2. The applicants successfully converted the historic Grant homestead in the early 1990's for office use. It is arguably an asset to the Wapping center as a fine example of early 19t'century architecture. 3. The proposed addition will blend into the architectural style of the existing structure, with a gable roof and brick/clapboard matching materials. 4. The applicants have secured the services of architects in order to determine the most appropriate location for a building addition, taking into consideration the historic integrity of the building, function, and building aesthetics (interior and exterior). 5. Subsequent to approval of the office conversion project, Clark Street and Deming Street were reconstructed and realigned to provide a seamless interconnection between the widened Buckland Road and Route 30. r 6. A traffic light was recently installed only one lot away from the subject property, due to the appreciable increase in traffic volumes on this section of Clark Street. 7. Also subsequent to this office conversion, the property directly across Clark Street from the subject property was developed as the primary South Windsor Post Office facility, including a major postal vehicle parking lot directly across from Berman, Russo& Sulick. This underscores the dramatic change in the area since this project was first proposed. 8. The area in and including the Town Center has also been more fully developed, including the three-story Rockville Bank headquarters, the three-story Sommerville Assisted Living Facility, the Tolland Bank plaza and the new Stop & Shop. 9. Evergreen Walk has since been developed nearby, with a new large ECHN medical arts building on Deming Street, as well as the new L.A. Fitness, Old Navy, a new Highland Park supermarket, and the expansive Lifestyles Center. The subject law office is no longer the lone commercial building in the area. 10. We believe this proposed addition and related improvements will have no adverse impact on any residential development. The greatest effort toward protection of abutters should and will focus on the Waldron Farm property to the north, which contains a sorting shed and farm building contiguous to the subject property and a three-apartment residence at the intersection of Clark Street and Ellington Road (southwest corner), and the future residence of Tom and Sara Fraize to the west. Given that the addition will be on the south side of the office building, it should not have adverse impact on the Waldron or Fraize properties. 11. There is no other reasonable location for this office addition, given numerous architectural considerations(interior function/user circulation, historical integrity, architectural style, aesthetics, structural considerations and traffic circulation). 12. While the proposed addition does not constitute a new building, the concern at the time of prior approval was sufficient to warrant submission of this application. 13. The restrictive covenants agreement between the Town Council and the applicants requires that this building remain an office use only in perpetuity. 14. The office addition is necessary to accommodate personnel and for improved operations at this respected law firm. 15. Supplemental landscape treatments can be added to the site, as appropriate, as well as additional parking and related improvements. 16. Prior to development, PZC site plan modification approval is required. We appreciate your consideration of this application and of the factors related to it. Thank you. The following conditions will apply. This approval is based upon the understanding & interpretation of the land deed presented and filed in the Town Hall placing a restriction of office use only on the property, that no further buildings will be put on the property excluding the alterations proposed. The board noted the hardship being the site constraints due to the small lot size; the house being constructed prior to zoning regulations; the property is adjacent to a tobacco farm on the north; and 25 feet buffer was formerly the zoning standard.
