Dated this_ ? `' day of Year ?,00 5 Applicant: ( igna ) OWNER: 4;1gna e) Approved: l l ='Denied: Revised 12/04/98 Attachment to application for Zoning Board of Appeals 1169 Ellington Road, South Windsor, CT Response for Question #13: The proposed property has an existing building converted to a small office use since approval by the Town of South Windsor on August 22, 1972, by the previous owner. The current owner wishes to expand the building to allow the building to be his principal dental practice. The current site meets all requirements of the overlay zone except it exceeds the maximum site coverage and the existing rear paving line allows only a 8' to 10' buffer at the property linem when a minimum of 10' is required. The goal of the property owner is to move the current curb cut to Ellington Road to the west end of the property to allow two-way traffic and appropriate highway sight lines. Current paving on the site exceeds that required by the existing building and without the proposed 9 reserved future parking spaces would meet the projected needs of the new practice. The expansion of the building if allowed, would provide the owner the financial means to rebuild existing parking lot, create a new curb cut and fully comply with current city engineering standards for site development. If the applied variances are allowed the owner will be able to redevelop the current existing property as a compliment to the development on the opposite (north side) of Ellington Road and provide a state of the art dental facility in an appropriate location in the Town of South Windsor. The redevlopment will remedy existing conditions relative to site access and drainage of the existing parking lot of 34 spaces. Hardship is created by the fact that existing condition of the site does not allow both effective site redevelopment and conformity in all aspects to the applicable zoning regulations at the same time. This is to notify you that your application to the South Windsor Zoning Board of Appeals, requesting a variance of Section 4»3 to allow conversion of a two-family house to office use on premises known as 1169 Ellington Road, has been granted as follows. The board voted to grant Appeal , 902 for a variance of Section 4.3 to allow the conversion of an existing two- family building into a building for office use as described at the public hearing, the basis for this action being that the character of the neighbor2iood has changed to a degree that now makes the highest and beat use of the subject property much greater than the use it is presently being put to. The building is to be designed as shown and to be used as outlined at the public hearings i.e., the applicant is to be the occupant of approximately one-half of the building. Section 4.11 of the Zoning Regulation shall be adhered to to the satisfaction of the Town Engineering and Building Departments. James H. Throwe requesting taut the Public Hearing on these two applications be postponed until the regular September meeting as he could not be present on August 22, was read into the record. Since there was no objection from the Board or the audien-ce, Mr. Boucher said Applications #900 and ",901 would be heard at the September meeting as requested. APPLIG ATi.ON L02 - Richard Grigorian, c/o Edwin A. Uassr::;an, Ill Pearl. St. ,Hartford, requests a variance of Section 4-3 to allow conversion of a two-family house to office use on premises known as 1169 Ellington Road. A-20 zone Atty. Edwin Lassman represented Pr. Grigorian, owner of the premises in question. It consists of a building and land with 200 feet of - frontage on Ellington Road and 150 feet of depth, directly across from Firehouse #l. Since: the previous appeals to the Board, changes have occurred in the neighborhood. Sanitary sewer construe;ion has been approved by the Sewer Commission to the land on Ellington Road owned by ITT; where an apartment complex is under way. Mr. Lassman said the area includes the firehouse and garage- owned by the town across the road, and to the ease will be several hundred apartment units. The Podunk 14ill restaurant -is a short distance down Ellington lioad. The apartment area will eventually extend and surround this property to the east and south. The applicant is asking for a variance to convert this existing two- family building to professional office use. =V=r. Lassman pointed out that in an A-20 zone, a professional office is allowed in conjunction with a residence. Yr. Grigorian proposes to use both floors as offices. He would reconstruct a portion of the building to improve its appearance ; this would be a general improvement in the neighborhood. He would connect to the water and sewer service. '{ir. Lassman said it did not make sense to spend money on -this building and leave it as it is , a two family residence. I4ir. Grigorian said the present building; is very unsightly. He s; proposes no radical changes to the structure, and this will be an CD r .1340 " asset to the area when completed. With the new apartment conutruc- ti.on and new i'amilies in town, he felt this building could provide t owfice space for necessary services. He would occupy the first: y n. d floor, approximately 1100 square feet for his own business, incur- t arse and investments, and the second floor would he sublet to allied 2 ir-Irs, i.e an attorney, accounting, firm, real estate organizations. Mir. Grigorin said this change would add to the tag: revenue for the town and allow him to locate his office in the town where he lives and in tho area where mucai oT. his business is. He presented an =: l a:rchiteet's rendering of the renovated building. The reconstruction would not involve any addition to the structure, but would consist. of nev, wi.ndows, air conditioning, rev., roof, sandblasting the c exterior and cha:n€i n; the front; parch. The proposed plot plan presented to she hoard shows eight. parking spaces., all to the rear =x of the building. lvir. Lassman said they considered this adequate for the type of business intended. i•'Ir. Grig-orian said he had only x one clerical em-loy ee and himself it his business. "r. Iassman pointed out that there is a. piece of property owned by Savin between Gri-oriants property and the ITT apartments. It has = C been zoned for .apartments, but, site, plan approval has not yet been given . The house on the other side of the property is about 50 t .feet away from the building in question. There was no,one speaking j in f'a.vor of or in opposition to this appeal, v.ro ijoucher asked vmat, .changes had tak-en glace Since the appeal was t denied b-z the Board in 1,,ay 1971, since the -sewers and the apartment complex were planned at that tire. 14 r. ya.ssman said the construction o f 200 ap artruents would. change the character of the nei ghborhooda '_Iy ;I He pointed out that this is not a commercial enterprise, only a limited commercial operation, and these one or two roan offices would .r not change the appearance of the building except to improve .i.t. r, Since the appeal was denied, 1'4r. Gri ;orian has operated the property c . s as a landlord. s E r. G ' :1h • tl exists in town .it;;orian _felt the office; space .i.ch presently . w1i11 be totally inadequate to handle the number of people wno will be moving in. Iv.ueller did not expect trues traffic to use Troy Road as FYe treet would give them direct access to ullivan Avenue and the area highways. Iy r. Lassman said the hardship here is that if the 1,000 foot require- ment is applied, only 1.7 acres of land is available for building, and the type of plastic they are working with is not that anticipated by the restrictions in the Zoning Regulations. I'_r. a1erce moved that, the hoard go into executive session. 'lie motion was seconded by Mr. Neal and unanimously approved. AR12 ;cat ion #20 hard uri;-::orian i iIr. Boucher said requests for this same variance had been denied by j the hoard in April 1970 and Play 1971. LassmLn had said the cis::.-,ges were that the apartment complex is now under way, sanitary, seta;ers have been approve and s'_r. Gri gorian has operated the property as a landlord. 1,.r. J. to Mr. Neal said he agreed it would be an improvv...ent to the property and the neighborhood, but the fact that the same request had been aid denied twice before bothered him. iir. Eriksson felt there had been a sufficient change between the 2+ tir. of the first and second appeals to warrant granting the variance. Letting 14r. Mr. Eriksson said he had gone to see the property* and would not be against granting the variance with the condition that the treed area be left untouched as it makes a_ good barrier. October 6, 2005 Town of South Windsor Re: Application by 1169 Ellington Rd LLC To the Town of South Windsor Zoning Board of Appeals: The Strawbridge Association Inc. is an abutting property owner of 1169 Ellington Rd, LLC. We wish to voice our concern with the planned expansion of the building owned by 1169 Ellington Rd, LLC. The Strawbridge property is buffered with berm, white pines and shrubbery, to shield the view of the building and parking areas. It is our main concern that this buffer not be sacrificed, creating an unacceptable condition for the residents of the Strawbridge community in the direct vision line of the building. Another lesser concern is the noise and pollution correlated to the increase in vehicle and pedestrian traffic expected if the h x the proposed expansion occurs. If the present barrier is maintained as is, it would of course have somewhat of a mitigating effect on the noise.
