SECTION IV—ACTION OF THE BOARD
Approved: ® r Denied:
Revised 12/04/98
August 14, 2002
We are filing a request for a variance of the zoning regulation which establishes a 20' setback from the
property line for structures. In this case, we are contemplating an above-ground circular or oval pool.
Previously, we had applied for and been granted an identical variance for a tool shed located on the
some side of the property. Not being sure if this has relevance to our new application, a copy of that
ZBA decision is attached (Exhibit A)
To help you better understand this new application, please refer to the attached map, (Exhibit 8),
which has been drawn to scale showing all existing structures and plantings. Also attached are copies
of two surveys (Exhibits D).
Our proposed location in the northeast corner is the most consistent with the character of the
neighborhood and provides the most hidden sight lines for each of our neighbors. To illustrate this and
identify hardships, consider the following:
Consistency with the character of the neighborhood
❑ The view from the both our westerly neighbors' (29 Wedgewood and 15 Wedgewood) and Cambridge
Rd. will be blocked by 1) a thick row of dogwoods on our property; 2) heavy vegetation at 15
Wedgewood; 3) a 4' wooden fence at 29 Wedgewood; and 4) an existing shed at 29 Wedgewood.
(That shed was also granted a variance and is approximately 7' inside their fence.)
❑ On the east side, there is a tall, thick row of mature pine trees which would effectively block
completely the view from our easterly neighbors at 39 Abbe Rd as well as westerly from Cambridge
Rd (several hundred feet away). Please further note that there are also two sheds and a large
firewood storage bin that are the property of our neighbors on 39 Abbe Rd and are located close to
the tree line as well, further blocking their view. There is also a very old, abandoned and somewhat
broken down wooden pump house on the rear corner of 138 Cambridge Road, further blocking the
view (Approx. size 10' X 20').
o On the south side, the house at 51 Abbe Rd would be approximately 200' away from the proposed
pool location and would not have a clear view. There are no other neighbors to the east.
❑ Viewed from the street (i.e. from the west, facing east), the pool would be partially obscured
behind an existing shed and stand of pine trees on the north side of our yard.
Proximity to existing structures
o The nearest residence structure to this location would be our own house located approximately 90'
from the proposed pool. The next closest is 29 Wedgewood la at 110', 39 Abbe at 162' and 51
Wedgewood at 200'. After that, all houses are at least 400' away.
❑ The proposed location is entirely consistent with existing out-structures (sheds) in our neighbors'
yards and ours. These are five wooden sheds located, in order of closeness, at 29 Wedgewood (next
door neighbors), 43 Wedgewood (ours), 39 Abbe (two) and 138 Cambridge (Pump house). Of
these five existing sheds, three of are also closer to the property lines than the 20-foot
requirement. (Two of those three had variances granted and one, the old pump house at 138
Cambridge, pre-dated the development.) All Ale structures are located closer to the proposed pool
location than any residence.
Proposed location of the pool vs. hardships of other locations
With respect to the placement of the pool on our property, there is only one suitable location. The
hardships caused by the other locations are related to existing vegetation, an existing shed, or drainage.
❑ We cannot move the pool further south because of drainage run-off from slope at rear of 39 Abbe
onto the middle rear (east) and southeast corner of our back yard.
❑ We cannot move the pool further east because of the existing stand of pine trees that overhang our
property from our 39 Abbe.
❑ We cannot move the pool farther west because of an existing row of 15-year-old dogwoods and our
shed, previously described.
o We cannot move the pool further north because of an existing fence at 29 Wedgewood.
❑ We also cannot move the pool to another corner of our property. The northwest and southwest
corners have established mature trees, at least one foot in diameter. The southeast corner has a
slope and drainage from the neighbor's yard to the side and behind us.
This leaves the last option of moving the pool diagonally southwest to the center of our yard. There are
three reasons we do not want to move it here.
o The first is that our yard, over the years, has become 'the place' for all of the neighborhood kids to
play and there are frequent games of soccer, touch football, tag, croquet, volleyball in the center of
our yard, almost every day, and we do not want to remove a well-used and long-established play area
for the neighborhood children.
a The second reason is that placing the pool in the center would negatively alter the drainage from the
east and southeast corner of our yard. When our house was built in 1987, we had drainage issues in
our back and side yards because of the gradual slope. ( i.e. it does not drain well.) We did have
much earth moved in help the drainage, but the middle of yard still retains unnatural amounts of
water. Please refer to the original report from Pudeler Engineering, Exhibit E, which describes the
drainage issue.
o We believe that moving the pool to the center of the yard would actually be contrary and
inconsistent with the character of the neighborhood as this location would be the most visible, and
loudest, to our neighbors. It would also actually be closer to both of our side neighbors than the
proposed location.
In conclusion we hope the ZBA will agree that our proposed location not only alleviates the hardships of
other locations, but also is ideal in that it provides for the best use and most blocked view, and is the
farthest distance from virtually all of our neighbors.
Thank you in advance for your consideration.
Sincerely,
Thomas and Deborah lines

Re : Revised grading and landscaping of your yard
Dear Sir:
It was a pleasure to meet you Saturday (March 26, 1988) and
walk your yard. Seeing your yard first hand and hearing you
describe your proposed landscaping was a big help. As I
mentioned, I would advise against putting a planting island
in your front lawn on the south side unless it was extremely
close to the south property line. This area is necessary
for drainage.
You have a drainage problem starting at the rear of the
house near the cellar hatchway and extending either down the
south side of your house to the sidewalk or across the rear
and around the driveway to the sidewalk. Presently there is
no pitch to allow the water in the rear to run out. To fill
the rear would be of some benefit, but the cellar hatchway
prevents the addition of more than a few inches of fill. If
the cellar hatchway could be raised 6 to 8 inches, then a
decent amount of pitch could be achieved to move the water
to the street.
The ponding of water in this corner and along the rear of
the house has produced some uneven settlement and the area
needs to be re-graded and smoothed. All swales or low areas
need to be made 20 to 40 feet wide so as not to appear as an
ankle-twisting ditch in your lawn.
Of prime importance is that the new home being constructed
to your south side be graded so as not to add any overland
water flow to your back yard. The large hole under your
deck should be filled and graded to prevent the possible
ponding of water in this area against your foundation. Your
roof gutters should have appropriate elbows and concrete
Mr. Tom Lines -2- March 28, 1988
splash pads so as to direct the water away from your house
and in the proper direction to reach the street (should the
back corner gutter be directed to the side of your house? ) .
All grading work on a lot this critical should be done accor-
ding to grade stakes set and checked with a builder' s level.
I would appreciate reviewing all the builder ' s or his engi-
neer ' s grading notes and reviewing the layout before re-
grading starts.
With all the ground settlement nearly complete, this re-
grading and re-shaping- will be the final layout of your yard
and while good grass growth will cut down on the rain runoff,
it will not prevent runoff. The runoff needs to be directed
somehow from your rear yard to the street.
Please keep me informed of the progress in resolving this
problem.
Very truly yours,
Kenneth J. Pudeler, P.E. , L.S.

Subject: Opposition to Request for Variances by Thomas Lines and Deborah Lines
Property - 43 Wedgewood Lane
Dear Members of the Board:
We the undersigned, William J. Beaudreau and Linda Beaudreau, are the owners of 7
Abbe Road, South Windsor, Connecticut. Our property abuts the easterly line of the
property of the applicants, Thomas Lines and Deborah Lines. Our land is shown as"Lot
B" on the plot plan submitted by the applicants. We purchased the land from Helen
Krutul in 2001.
We are opposed to the variance requests seeking a reduction of the 20' side-yard and 50'
rear-yard as required by Section 10.2 of the South Windsor Zoning Regulations.
There is nothing unusual or extraordinary about the Lines' property. There is no
condition especially affecting their land which does not otherwise apply generally to all
of the other properties in the neighborhood.
The 20' side-yard and 50' rear-yard required by the South Windsor Zoning Regulations
are to ensure the continuation of the established character and preserve the nature of the
area.
Pursuant to South Windsor Zoning Regulations(Section 18.4.1 (c))the applicants must
show, with respect to their parcel, that there are"...conditions especially affecting such
parcel but not affecting generally the district in which it is situated, a literal enforcement
of such zoning laws and regulations would result in exceptional difficulty or unusual
hardship." No such special conditions exist on the Lines' property.
The applicants did not state any legally justifiable reason for their placing their pool
within the area prohibited by the side-yard and rear-yard regulations for a property in an
AA-30 Zone.
In addition, the applicants also appear to have misstated the South Windsor Zonings
Regulations. The applicants are seeking a 15'variance to the side-yard and rear-yard.
The rear-yard requirement in an AA-30 Zone is 50', not 20'.
For the above reasons, therefore, we respectfully request that the Zoning Board of
Appeals deny the application of Thomas Lines and Deborah Lines for side-yard and rear-
yard variances.
Sincerely yours,
illiam I audreau

RE: Drainage concerns regarding placement of above ground pool
Dear Tom:
In response to your request,I conducted a site visit to your property on Wednesday August 21.,2002 to
observe the topography of your backyard with respect to the placement of an above ground pool and have
reviewed a copy of the plot plan which you supplied that is on file in the South Windsor Town Hall.
My observation is that your yard is quite level, possibly more level than depicted on your plot plan. We
also discussed the fact that significant regrading had to he done to reduce standing water in your backyard
when your house was originally built. It is apparent that most of the runoff to your property comes from the
slope on the property directly to your east, with a lesser amount from the southeast. The storm water runoff
flows very gradually west-northwest,then northerly around your house.
Based upon these observations, it is my opinion that the placement of the pool must be carefully planned in
order to avoid significant water damming, thereby exacaserbating any drainage problems you have already
tried to remedy. The more north and east that you are able to place the pool, die least impact it will have on
storm water runoff.
It is my understanding that you are considering a pool approximately 25'-30' in diameter and that you wish
to place the outer edge 5'from your north and east property lines. Under this scenario, the inner most edge
of the pool will be 30'-35'from your property line. It is my opinion that this is the maximum distance you
can place the pool to avoid creation of drainage problems as stated above. Due to the flatness of your yard,
moving the pool to a more interior location on the property may result in substantial, if not impossible,
regrading of your yard.
Please call if you have any questions.
Sincerely,
Leonard J.Norton,P.E.

Re: Appl. #2552-02—Thomas &Deborah Lines,43 Wedgewood Lane, AA-3-zone
Dear Mr. & Mrs. Lines:
At the meeting of the South Windsor Zoning Board of Appeals held on September 5, 2002, the Board
approved your request for two variances to section 10.2: 1) a 10' variance to allow an above ground pool
10' from the rear property line (20' required); and 2) a 15' variance to allow an above ground pool 5' from
the side property line (20' required) at 43 Wedgewood Lane, AA-30 zone.
The Board concluded the hardship to be that due to water issues documented by two professional
engineers on the site, there is an inability to place the pool in a conforming location.
Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of
construction.
These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own
expense.
Very truly yours,
Marjor e Anthony, Vice Chai an -
