Dated this a of e y 't Year 110 Applicant: ,.., (Signature) OWNER: Z - (Signature) Approved: Denied: Revised 12/04/98 Application Narrative 935 Main Street Purpose Applicant requires a variance for the requirement for a 20' side yard in order to place a pre-built shed on the property. This application is similar to another application submitted for a side yard variance for a garage in the fall of 2003. The hardships are the same, however, the building need is different. Background 935 Main Street was one contiguous property. When sold in 2003, it was split into two parcels. The access for parcel B —the rear parcel — is a 25 foot right of way along the south side of parcel A, the portion containing the house. This 25' right of way takes up the portion of the property that was allocated to side yard. Hardship 1. The peculiar nature of the split property precludes any location to the south without a variance. If the original parcel had not been split, the shed placement would conform to regulations. 2. An attempt was made to place the shed in the upland area near Newberry Brook. This is permitted and an application was sought to do so. However, when we attempted to actually install the base for the shed, the surrounding area is too wet. Therefore, we decided that, while permitting allows it, the actual circumstance of this property precludes installing the shed in the 100 year flood plain. 3. A location in the center of the property would conform, but would prevent access to the rear of the property from the driveway. Other Circumstances 1. There is no impact on the neighborhood, as the shed cannot be seen from the road. 2. There is no impact on neighborhood character, as there is a large tobacco barn 0' from the current side property line that blocks the view of the shed and dwarfs the shed in size. 3. The 25' right of way is not impacted. 4. The shed is movable should it become an inconvenience due to an unforeseen circumstance.
