The applicant has under contract a house to be constructed on Lot 1,which is at the southeast corner of Strong Road&Bancroft Lane. Stone Crest Construction&Development, LLC has ordered a two-story modular house with approximately 3,000 square feet of floor area and a side-load 3-car garage on the left and it is now under construction in a factory. Town staff have indicated that the driveway must come off of the side street, Bancroft Lane, rather than the collector street, Strong Road. This necessitates the house facing Bancroft Lane and a minimal front yard variance on the Strong Road side of the house. It is better for the garage to face Strong Road, given that it is a collector road. The proposed driveway will meet Town standards for distance from the intersection's centerline. In order to ensure privacy for the house's rear yard, landscape architectural treatments will be installed along the Strong Road frontage. The parcel immediately to the east is in the industrial zone, and it already has a landscaped berm(Lavallee Overhead Door Company). The subject parcel is also directly across the street from the industrial zone. Lot No. 1 is narrow, although it does conform to zoning. The subdivision designer apparently did not take into consideration the two front yard setbacks on a corner lot, which is extremely restrictive. In most subdivisions designed by Design Professionals, Inc., corner lots are larger in recognition of this restriction, e.g.,Deming Hill Estates. In conferring with Town staff, it was agreed to favor the house slightly toward Strong Road and seek a front yard variance, rather than favoring the house toward Lot No. 2, which would have required a side yard variance, due to the existence of a residence on Lot No. 2, which is only 10 feet from the common property line. The variance requested is as follows: 1. Variance to Section 10.2 to allow a 47f feet front yard along Strong Road (3±feet variance/50 feet required). The specific hardships or peculiar circumstances that support this application are: 1. The easterly side of the property borders an industrial zone, and therefore, the house should be as far away as practicable from said industrial zone. 2. The northerly side of the property is directly across the street from the industrial zone, and therefore, it is desirable to have the garage, or non-living space end of the house, closest to Strong Road. 3. Town staff have indicated that the driveway should come off of the side street,Bancroft Lane, rather than busy Strong Road(a collector street)which appears feasible with this variance. This requirement was unknown to the applicant nor to the house buyer when the contract was executed and the house was ordered. 4. The house which was ordered for this lot and which is now being built, has a left side, side-load garage. It is not feasible to place the house on the lot facing Strong Road with reasonable driveway access to Bancroft Lane. w 5. Landscape architectural treatments will be employed to screen the lot's backyard from the motoring public on Strong Road. 6. The subdivider and their original design team created Lot No. 1 without the additional area normally given to corner lots, which are observing two front yards. 7. It is more desirable to have the house face Bancroft Lane rather than toward the industrial zone. 8. Although it cannot be achieved, if the house were to face Strong Road, it would afford little or no backyard for the residence. 9. The degree of variance is minimal (only 3± feet out of a 50 feet requirement). 10. The house on Lot No. 2 is at the minimum 10 feet side yard setback, and therefore, it would be inappropriate to secure a side yard variance rather than the front yard variance. Stone Crest Construction&Development, LLC has submitted this application and hereby requests consideration of this variance request. Thank you. Lot One Description. The following hardships were placed on this approval: 1. The subdivision regulations require the driveway to come off from Bancroft Lane (a local road) as opposed to Strong Road (a collector road). 2. The practical difficulty of utilizing the garage as designed if placed in a conforming location with the front of the house facing Strong Road. 3. The requirements specific to a corner lot. Corner lots are subject to two front yard setback requirements. 4. The configuration of the lot in the tapering down of the lot, from the back of the property to the front (Bancroft Lane). Any new building, or alteration/additions to existing buildings, requires a building permit prior to start of construction. These actions are effective upon your filing the enclosed form in the Town Clerk's Office at your own expense. Very truly yours, teph n Wagner, Cha rperson Zoning Board of Appeals SW:dr cc: Building Department I, Stephen Wagner, Chairman of the South Windsor Zoning Board of Appeals hereby certify that on April 1, 2004 the Zoning Board of Appeals granted to: Stone Crest Construction, LLC, a 3' variance to section 10.2 to allow a proposed house 47' from the front property line (50' required), A-40 open space zone. on premises located: 9 Bancroft Lane (lot#1, Forest Village Subdivision) and more particularly bounded and described as follows: Lot One as shown on a map entitled, "Forest Village" for A.G.
