Folger—Environmental Planner/Conservation Officer Date: July 12, 2005 Re: Appl#05-27W,Review of the proposed Beechwood Farms Lot#28. Plans dated 6/152/04. The current parcel is comprised of 0.35 acres. The project is to construct a residential dwelling. Regulated activities involve the clearing and grading and construction of a house within the 80-foot upland review area. The house would be located approximately 26-feet from the wetland at its closest, and proposed clearing to occur within 10 feet of the wetland boundary. Estimated disturbance is approximately 4,868 sgft within the URA. Site: The site is located in the Quarry Brook sub-watershed of the Podunk River watershed. Currently the site is a mixed forest with white pine dominating the overstory, and successional shrubs in the understory. The parcel slopes moderately to the north. Wetlands on the site are located on the northern 1/3 of the site. The wetlands would be characterized as a forested wetland with a small perennial watercourse running through it. This wetland is connected to a larger wetland system that runs through a densely populated residential housing development. The wetland system forms a wooded corridor that meanders through the development that is largely undisturbed except for several road crossings. The wetland boundary shown on the plans appears to be accurate. Major functions of this wetland area would be flood storage, stormwater conveyance, groundwater recharge, wildlife habitat, nutrient and sediment trapping and assimilation, and aesthetics. Wildlife habitat values for the wetlands would be moderate based on the relative size and connection to other wetland areas in the vacinity. Residential homes surround the wetlands on the parcel, so ecological integrity is limited, however the relative undisturbed linear orientation of the wetland is a significant plus. The initial application of Beechwood Farms Phase I eliminated eleven wetland area totaling 71,400 sgft. Phase II eliminated ten wetland areas totaling 55,000 sgft. This development significantly reduced the ecological integrity, wildlife habitat to aquatic organisms (vernal pool elimination), flood storage and groundwater recharge capability of the wetlands in the area. Impacts: The limit of clearing is localized to accommodate the house and_a_rear yar_d_area. Th_is — ___ — configuration provides a very small yard area for residential use. The close proximity of the house and lawn area to the wetland and watercourse(20 feet at the closest point)has the potential of impacting water quality and wetland function by the generation of pollution in the form of nutrients from lawn fertilizers, pesticides, sediments from construction activities, and increased water temperatures by the removal of overstory vegetation. Soils on the site are listed as Elmwood Sandy Loam (EnA) 0-3% slopes by the Hartford County Soil Survey. This soil type has an erosion potential listed as low to medium. Standard perimeter erosion controls should be adequate to contain sediment onsite provided that the controls are properly maintained and not disturbed by construction activities. The close proximity of the disturbed area to the wetlands and watercourse makes this problematic.. MICHAEL F. GRAGNOLATI 45 North Street P.O.Box 3127 Z0 1- Windsor Locks,Connecticut 06096-3127 Tel/Fax 860-623-2588 July 15, 2005 Kevin Johnson Close,Jensen &Miller 1137 Silas Deane Highway Wethersfield, Connecticut 06109-4201 RE: Wetland Delineation Lots 11, 12, &28 Quarry Brook Drive South Windsor, Connecticut Dear Mr. Johnson: This letter is to confirm that in the summer of 2002 I visited the above reference site to verify the wetland boundary delineated by others. My investigations were conducted utilizing a spade and auger. I am of the opinion that the wetland boundary as delineated is accurate. Lots 11 and 12 are contiguous and across the street from lot 28. The three lots have houses adjacent to them on Quarry Brook Drive. The wetland on all three sites consist of an intermittent stream that flows through a culvert under Quarry Brook Road from lots 11 & 12 to lot 28. This intermittent stream is more clearly defined on lot 28. Vegetation within the wetland on lots 11 and 12 consists of skunk cabbage, northern arrowwood, winterberry holly, red maple and green ash. Soils within the wetland are predominately Walpole fine sandy loams. Walpole soils are very deep (>65 inches)poorly drained soils that form in water sorted glacial outwash and stratified drift. They have an apparent water table that is at or near the surface much of the year. Permeability of the Walpole soils is moderately rapid in the surface layer and subsoil and rapid or very rapid in the substratum. As stated previously the channel of the intermittent stream is more clearly defined on lot 28 so that the boundary of the resource area is at the top of bank. Upland vegetation on all three sites consists of white pine, red oak, cottonwood, and red maple. ff-you-shoul&have-any-qu-estions,-please call_this office_at your convenience. I feel this letter will contain historical background essential for the Commission as it determines the merits of these applications. The history of these lots spans a period of 20 years during which time I feel our company has made every effort to work in concert with your Commission in the spirit of your regulations. To that end, I hereby respect- fully submit the following sequence of events and comments: SEQUENCE OF EVENTS AND COMMENTS BEECHWOOD FARMS APPROVALS During 1980 we began the approval process for Beechwood Farms. In late 1985 or early 1986 the Town Planning & Zoning Commission approved the sub- division for Beechwood Farms including lots 11, 12, and 28 above-referenced. At that time we also had an application pending before the Wetlands Commission. The process before the Wetlands Commission continued from at least January 27, 1986 to November 17, 1986, when we received the approval for all of the lots on the subdivision except lots 11, 12, and 28 (refer to the attached minutes of the Wetlands Commission for this period of time). Those minutes reflect numerous issues regarding the project, but relative to the matter before the Commission today, I will focus on specific points in that process. In retrospect I have come to -- -- -- - realize that the process at that time suffered from a lack of clarity-that was sub- sequently remedied in later years. THE SYMBOL OF HOME BUILDING EXCELLENCE ..... Town of South Windsor July 20, 2005 Page Two On March 10, 1986, 1 had appeared before the Wetlands Commission for what I anticipated to be the final approval for our wetlands permit for the project. Although a motion was made to approve the application, the third condition of that approval stated that "no lots would be approved at this time". I have never come across such an approval, which seemed to not be an approval at all. But since the Town was very interested at that time in having Quarry Brook Drive connected, our company decided to proceed with the road improvements to the extent that we could, without financing, in order to show our good intentions to the Town. From April 1986 through July 1986, we began engineering, clearing and some earth work, but then delayed construction until we could secure financing. However, since we had no approvals for the lots, the property could not be presented to a bank as collateral for the necessary financing to continue the project. Therefore, in July 1986 1 requested a meeting with Town staff to review our application for the building lots. They set up a meeting to discuss the application. However at the meeting, no members from the Town staff were present. Instead, the meeting was with Mr. John Moran, the Chairman of the Wetlands Commission. He explained to me his concerns about the project and items of the infrastructure he had wanted completed before lots were approved. I explained to him my dilemma regarding the need for the lot approvals in order to obtain financing to complete the infrastructure items. On October 27, 1986, the application was back on the agenda, at which time discussion was held but no action was taken. Finally, at the November 17, 1986 meeting, all of the lots were approved except lots 11, 12 and 28. At that time, this came as no surprise since Mr. Moran had previously mentioned to me that he would hold back those three lots until the roadway crossing adjacent to those lots had been completed in an environmentally sound manner and was stabilized. At that time there was no doubt in my mind, based on my discussions with both Mr. Moran and members of the Town staff, that, at the appropriate time, I could reapply for permits for these three lots. There are several objective reasons that support my perception. First, these lots were all approved building lots by the Town Planning & Zoning Commission. Second, we were never asked or required by the Town to combine any of these lots to the adjacent lots or to the Open Space. Thirdly, we were involved in numerous meetings with Town staff before and after the approval for purposes of discussing the exact location of the Con- servation-Easements on theselots. This wasthe-same process we-were-required -to follow on other approved lots that had wetlands issues. Fourthly, we were required by the Town to install laterals and/or stubs to these three lots for water service, sewer service, gas service and electric service. r Town of South Windsor July 20, 2005 Page Three Finally, in our contract disclosure to all of our customers in Beechwood Farms we had disclosed, among other things, that homes would be constructed on these three lots at some future time. Had we had any indication at the time that it was unlikely that wetlands permits for these three lots would be forthcoming, we could have combined them with adjacent lots to create bonus lots. We have created these bonus lots in other towns when requested. Had we created those bonus lots at that time, we could have saved the expense of the utility connections, which we were required to install for these three lots, as well as the taxes that we were required to pay on these three lots throughout the years. By combining these lots, we could have built larger, more expensive homes, that would have been more beneficial to us than building on the three lots today. However, the bonus lot option is no longer available to us. These three lots represent the last lots, and a very minor portion of the Beechwood Farms project. My professionals will be making a presentation to you this evening in which they have spent a great deal of time producing a plan for the construction of the homes on each of these three lots which will result in minimal impact on the wetlands. Further, my Architect has designed exteriors that not only fit the footprint but also provides privacy to the neighbors. I have provided the preceding statement of facts and comments so that the Commission will have a clearer context within which to balance the historical equity issues with the wetlands issues. Thank you for your attention in this matter. Respectfully submitted, Joseph P.
