Road access to the existing barn is ok.Work with Jeff Folger on wetlands issues. The new driveway location would need to be shown on your plan, and a driveway permit from our Engineering Dept. would be required. Re: survey work for the existing barn--we will not require you to provide a new survey to use the existing barn or the existing garage. The computer mapping program we have is not meant to substitute for actual surveys; there is no guarantee that the boundaries that show up on our computer mapping are accurate. (They are for tax purposes.) If you start building new things, like a new barn, you WILL need a survey along with any engineering plans that need to be done. This is necessary to demonstrate that the new structures are both on your property and meet the required setbacks. OK? I will then develop plans for a new barn under a separate application. Jeff and I met last Thursday and I left with a few questions after our meeting and was wondering if you have had a chance to discuss them. 1. Use of existing barn for stabling horses-Jeff, you indicated my application was the wrong type and you were going to inquire to Marcia about it. 2. Farm access from road to existing barn- Jeff, you were going to drive by to determine what I need to do. If we go with the existing barn this would be desirable. I have talked to a couple of Engineers regarding estimates for survey work associated with a new barn. One said they pulled the property deed record at the town hall and it shows no indication of boundaries for the property. So, they have nothing to go on to survey and are estimating $10,000 because of it. The map you provided me shows the barn crossing a property boundary(as Jeff pointed out). I don't understand how this possible if the deed doesn't identify the boundaries? I don't know were I to go from here? $10k is way too much money for engineering work for a i Marcia Banach Rea lication uestions 215 Main Pa e 2 barn. I would appreciate any suggestions and guidance on next steps you can offer. We will be requiring a zero net fill outside of the stream channel encroachment line. Within that line we require an engineered floodstudy to determine effects and impacts in addition to the zero net fill requirement. I'll be out your way to take a look at the ditch in front of your house for that second driveway cut this week. Regards, Jeff Folger >>><Rebecca_Fusco@HSB.com>09/27/04 02:15PM >>> Marcia, My question is unrelated to my current application for the horses. I recently met with a civil Engineer to discuss a survey and how to determine the appropriate location for an outdoor riding arena and possible future barn. He showed me the insurance flood maps and requirements and reviewed the plot plan I received from the town. He talked allot about determining the "location of the stream channel encroachment lines"and believed that I should be able to construct arena and barn in the area between that line and Main Street without a zero net fill restriction. He suggested that before I invest in the survey, I ask for another meeting with the town to determine if that is true. Would that be possible and who should I set that up with? Request for approval under Section 4.1.9 to keep up to four horses on 3.84 acres located on the westerly side of Main Street, southerly of Chapel Road, A-40 zone. 2. General criteria for keeping horses for personal use include due consideration to the conservation of property values; the general character of the neighborhood, and the general welfare of the Town. In addition, there are specific criteria that apply, however the Commission can waive these requirements when the site does not lend itself to strict conformance. There are a few criteria in which the applicant is requesting a waiver. 3. The criteria include: ♦ A minimum of two acres is required for the first horse and an additional acre for each additional horse. Under current regulations the applicant would be allowed two horses, she is requesting a waiver to allow four horses. ♦ Housing/stabling of horses is restricted to the rear yard of the premises. The accessory buildings used to shelter or feed the horses must be located at least 125 feet from the street, 40 feet from any side or rear property line, and 100 feet from any dwelling located on an adjacent property. There is an existing barn on the southern end of the property that does not meet the 40' setback requirement, but does meet the 100 feet from any dwelling requirement and is approximately 200 feet form the road—therefore the applicant is requesting a waiver to side setback section ♦ A fenced area of at least one acre for each horse must be provided. In lieu of fencing, a riding ring may be substituted. ♦ Manure shall not be allowed to accumulate to cause any health hazard, and shall be subject to inspection by the Health Officer. Fly control measures shall be required; and ♦ There shall be no outside storage of feed or bedding material. 4. The applicant has provided a plan, which shows the area fenced and the location of the existing barn. If the applicant decides to add a second drive on the southern end of the property, it should be subject to the review and approval of the town Engineer. If this application is approved, the Planning Department has no modifications requested.
