Redland Brick, Phases 3 & 4 Earth Removal
PH 2/24/04
1. Request for an earth removal permit under Section 14 to extract clay in phases 3
and 4 on Redland Brick property at 1440 John Fitch Blvd, RR zone. The
applicant received an earth removal permit in February of 2000,aa4-that permit
was vak4*q4i-F 2.
qk-
2. Section 14 allows the Commission to approve removal of earth materials,
including clay, after a Public Hearing, in conformance to certain criteria,
including:
♦ At the conclusion of the operation or any substantial portion thereof, the
whole area where removal takes place must be covered with not less than 4
inches of topsoil and seeded;
♦ Final grades cannot exceed 2:1 slopes;
♦ Except in the Industrial zone, no stone crusher or other machinery not
required for actual removal of material is allowed; and
♦ A restoration bond is required.
General approval criteria that the Commission can consider include the effect
of the removal on surrounding property and the future usefulness of the
premises when the operation is completed.
The plans reflect that there will be 4 inches of topsoil and seeding over all
excavated areas when completed. If the excavated area retains water and takes
on pond characteristics, as has happened in previous pits, then pond
conditions will be maintained and seeding will be done to the edges of the
pond. The plans also reflect finished grades of 2.5 to 1 on all outside edges of
the excavation area. A reclamation bond will need to be established at some
point, but it does appear that there is still a long excavation period remaining.
3. The permit may be granted for a period not exceeding two years, but there is
an extension provision allowing the Commission to grant extensions with or
without a public hearing.
4. The applicant is requesting the permit for phases 3 and 4, with minor work
(filling to establish a new grade line as shown on previously approved plans)
to be done in phases 1 and 2.
5. The site is accessed from Route 5.
6. There are regulated wetlands on the site. The IWA/CC referred this
application to their enforcement officer for approval, which is similar to this
Commission's in-house staff approval process. The wetlands permit expires
on November 1, 2005.
If this application is approved, Planning Dept. has no requested approval
modifications.

Re: Redland Brick Inc.- KF Plant, Earth Removal Permit
Dear Jeff:
Enclosed is our application for the renewal of our Earth Removal Permit. As our
existing permit expires at the end of February, we would prefer to be placed on
the agenda for the first meeting in February.
Our plans are being prepared by Fuss and O'Neil and will be submitted in several
weeks. I will mail the application fee in about a week.
Thank you for your consideration.
Sincerely,
Barry L. Miller

Re: App1. 04-05P Earth Removal Permit for Redland Brick Inc.
Dear Ms. Banach:
We would like to thank the Planning and Zoning Commission for approving our permit
application last night.
During your analysis of our application to the Planning and Zoning Commission, I
believe it was stated that our Wetlands Permit expires November 1, 2005. This is
consistent with the letter that is copied on our prior permit maps. But in my files, I have
a letter dated January 25, 2000, from Elizabeth A Warren, Inland Wetlands
Agency/Conservation Commission Chairperson to our attorney Thomas Cody, that says
our permit expires January 19, 2005. Could you please confirm which date is the
accurate one?
I understand that our permit was approved with the condition that we must submit a
restoration plan with associated timeframes with our next permit renewal. We are not
opposed to submitting a reclamation plan and have already gone on record that when
finished mining, we will put topsoil down and plant appropriate grasses to the water's
edge(assuming the pit fills with water). This statement is listed in our Sequence of
Operations (item 7) on the existing plans and also on our plans submitted in 2000. Since
we are aware that the clay deposits on the property are at least 100 deep, we can conclude
that we have not depleted the clay reserves on any section of our property at this time. So
any attempts to include timeframes of when we will be finished mining in a particular
area will purely be guesses and may be off in terms of decades.
There are also several additional comments I would like to make that hopefully will
clarify our situation in response to the questions and comments raised in our meeting last
night regarding planting and reclamation. When these questions were posed during the
meeting and then comments were made about donating the ponds over to the Township, I
was somewhat confused as I did not think there were any issues on these subjects.
Manufacturer of quality brick products Cushwa KF Harmar Rocky Ridge
We need to extract the clay from the ground in order to manufacture brick. Without the
clay, it would most likely be cost prohibitive to manufacture brick on the site. Therefore,
when we can no longer extract clay on the site we will most likely close the plant. But,
we do have a substantial amount of reserves on the property and we expect to be
manufacturing brick on that site for many, many years; possibly even up to 100 years. In
order to extend the capability of manufacturing at this site to the maximum potential,we
are very protective of that clay for obvious reasons.
In the last 5 years we have planted grasses on various locations of the property to control
erosion and sediment. This was done at the direction and approval of Jeff Folger, and we
reported this, on record, with the Inland Wetland Commission. The Township has not
requested that we plant any additional areas on the property so we have assumed that we
are in compliance. If the Township makes a request that we plant additional areas for
erosion and sediment control, we will give it due consideration. But for reasons
explained in detail below,we are not interested in planting areas now that one may think
is "mined out"if that planting would prevent us from mining that location in the future.
We did set aside a section of property, about 5 acres, in a Conservation Easement. On
this section of property, it was identified that there are several species of rare and
endangered species of sedges. We have a management plan that we follow that will
allow the best chance for these sedges to propagate. This management plan is on record
as well. These sedges are currently being studied by various wetland experts in the area
as well as experts at the University of Connecticut.
We have mined on much of our property without excavation permits under prior
ownership and the Township allowed us to do this as our plant was essentially
"grandfathered" since it is a pre-regulation mine. We know that there is clay on the
property at least 100 feet deep. Our employees have told us that the ponds are only 10 to
20 feet deep so there are still adequate clay reserves underneath the water level. So there
is some acreage on our property that could be mined further in locations where we have
previously mined. We have simply chosen not to mine there at this time for various
reasons.
Two examples of this are the ponds and the area between the ponds that is currently being
leased to East Hartford Sand and Gravel. We stopped mining the clay directly from the
ponds when the current plant was built as a new type of grinding plant was built and this
new plant would not process the wet clay. In the event we were going to run out of clay,
an executive decision would have to be made to determine whether we would install
some other type of equipment that would process wet material, determine whether we
should dewater the ponds with appropriate permitting, or go out of business at this
location. In the area that is leased to East Hartford Sand and Gravel, apparently many
years ago, prior plant management used that area to place their discarded brick. We
could decide to remove the discarded brick and also mine this area at some time in the
future particularly if the alternative was going to be to run out of clay reserves.
r
Therefore, it must be noted that the decisions to mine in the current areas were made
because it makes the most sense to do so at this time but with changes in circumstances it
may make better sense to mine elsewhere on the property. So just because we are not
mining in a particular area at this time does not suggest that we will not mine there in the
future. We do not know of any locations on the property that are void of clay reserves.
Consequently, it is premature to consider the possibility of turning the ponds into a park
or donating the ponds to the Township at this time. This is a decision that future Redland
management will make.
I would be happy to discuss these issues with the Commission or you further if requested.
Sincerely,
Barry L. Miller
