Estate of Frances Collins Resubdivision
Public Hearing 7-13-04
1. Request for approval of a resubdivision to create 1 lot with no new
construction, RR zone.
2. Minimum lot size required in the RR zone is 40,000 sf. The proposed lot
proposed is 4 acres. Minimum frontage required is 175 feet, 455 feet
provided.
3. The Post Road Stages portion of this property, which abuts the proposed new
lot, was recently divided out from the remainder property and is now under
separate ownership. The commission recently approved a site plan on that new
lot. At that time, staff requested cross-travel easements between the two
properties, which the Commission chose not to require. This current
subdivision will result in the business being further divided into three separate
ownerships, with driveways and parking shared among them, with no cross-
travel easements among any of them; so staff repeat the recommendation that
cross-travel easements be established. The Commission has no other way of
ensuring that the business can continue to operate among these three
separately-owned lots if there are any unforeseen or unexpected changes in
family circumstances (such as family disputes).
4. There are regulated wetlands on the property, but IWA/CC has ruled that they
do not want to hear applications where no construction is proposed.
5. One of the purposes of subdivision regulations is to make sure that newly
created lots can stand on their own and are self-sustaining, no matter how
good or bad relations are between families or neighbors. This new lot is
serviced by private well and septic system. The septic system is across Strong
Road, under a different ownership. Staff recommended an easement allowing
or the continuation of the septic system; -the applicant has responded with an
access and maintenance easement. We note that the access and maintenance
agreement does not address the right to continue to have and use the septic
system. The new lot can hook up to Town sewers if the system fails or a
family dispute renders the system inaccessible. However, in either situation, it
could rightfully be argued that the Planning and Zoning Commission allowed
an incomplete lot to be created, a lot that was contingent upon good relations
between independent owners, rather than ensuring that sewer service are
1
x
•
available both now and into the future. The solution to this is to require
genuine easements for sewage disposal.
6. Staff have requested that the applicant establish a street line along Strong
Road for all of the property included within the subdivision application,
because all of that property is within the control of the applicant. Setting of
the street line generally clarifies that the Town owns 25' from the centerline
of a street. This is done by having the applicant quit-claim the land between
the applicant's property boundary and the center of the street to the Town, and
is required by the subdivision regulations (section 4.C.3.a.(6). In this case, the
applicant owns about 1000' of frontage on Strong Road, so the entire 1000'
should have a street line set in accordance with subdivision regulations. This
is the usual way to get those street lines established, because we can't
guarantee that there will be other applications dividing up the remainder of the
frontage into lots from which we can then collect street lines. Thus, staff
strongly urge the Commission to enforce the subdivision regulations and
require that the street line be established.
If this application is approved, Town staff requests no additional approval
conditions except as already noted.

From: Michele Lipe,Assistant Director of Planning
Date: 6/29/2004
Re: Collins, Estate of Frances Review Comments 04-44P
Following are review comments from the Planning Department. Please make appropriate
revisions and submit seven complete sets to the Planning Department at least 10 days prior
to the scheduled public hearing (scheduled for July 13t'). Engineering comments will be
forthcoming. If you have any questions, please call.
1. This application is a proposal to cut out one lot—the remaining land should be labeled as
a parcel(not lot#1).
2. Street line should be established for all road frontages(25'from the center).
3. Is there any reason that a small piece of property (to the east) is being left along the
Strong Road frontage rather than incorporated as a part of this lot?
4. Connecticut Water notification of this application must be provided.
5. Bob Deptula, Town Sanitarian should be consulted regarding the off-site septic system
(and whether any easements are necessary).
6. A Cross travel easement should be provided between this property and Post Road
tages.
7. What uses (other than residential) occur out of the existing home? How do these uses
conform to our zoning requirements?

Re: Frances S. Collins Resubivision
Dear Marcia,
We have enclosed 9 sets of revised plans for the above referenced project. The plans have been revised to address
comments made by Michele Lipe dated 6/29/04. Our responses to Michele's comments are as follows:
1. The remaining land has been relabeled as requested.
2. A quit claim deed will be written to establish a 25-foot Town Right of Way along Strong Road on the
proposed lot.Existing conditions show that the Town has at least 25 feet from the centerline of Strong
Road to the property line of the proposed lot.The centerline of Pierce Road has previously been
established and is noted on the Reconstruction Plans currently on file with the Town Clerk. Other
properties along Strong Road are not within our control and thus it is not our responsibility to establish
Town Right of Way along those property frontages. There is currently no proposed development on the
proposed lot.If the client chooses to apply for future development and/or future subdivisions of the
proposed lot or of their remaining parcel, additional quit claim deeds will be written accordingly.
3. The lot configuration is such in order to satisfy the wording of the will to Priscilla Snow from the Estate of
Frances S. Collins, which states that she is entitled to 4.0+/-acres(see attached copy)and to reflect the
configuration of the previously approved Post Road Stages lot(deed on file).
4. Connecticut Water has been notified of this Re-Subdivision Plan/Application—see attached copy of
transmittal letter and completed notification form.
5. n regard o the o site septic system,a Right o ss ain liasbeen-noted on the Plot P an which
will be filed upon approval.
6. We are not proposing any cross travel easements. Both properties in question are owned by members of
the family owned business presently, and are utilized by the business. In the event that one of the
properties is sold off in the future,it may not be in the interest of the owners to allow cross travel. Please
note that both properties have access to the public road, and cross travel easements are not required for
either property to operate separately. Additionally, each lot can stand on its own with respect to parking

requirements. The existing house/office requires 9 spaces per Town parking regulations.Existing spaces
meet this requirement.
7. A section of the existing home is used as a business office for Post Road Stages,Inc. The property is
located in the RR Zone. On January 7, 1965,the Zoning Board of Appeals granted application#418 to
Harold J. A. Collins,Frances S. Collins and Post Road Stages,Inc.for a special exception(Section 4.1.25)
to allow the operation of a business involving the storage, repair, and running of buses and bus lines as
public carriers or carriers of school children or chartered parties at 1105 Strong Road in the R-40 Zone.
This note was on the Post Road Stages Site Plan and is now included on the cover sheet of the Estate of
Frances S. Collins Resubdivision plan with the Zoning Data Block.

RE: App 04-44P—Estate of Francis Collins ReSubdivision
I have reviewed the resubdivision plans for the Estate of Francis Collins property on
Strong Road. I have the following comments about these plans:
1. The Town needs to have a quit claim deed for property between the center of Strong
Road and the property being subdivided (at least 25 feet wide). This applies along
the entire frontage of the property being subdivided, the Estate of Francis S. Collins.
2. Does the existing well immediately behind the house at 1105 Strong Road also
service the Post Road Stages facility? This is still not shown on the most recent
plans for Post Road Stages. If so an easement needs to be established between
these two parcels regarding the shared use and maintenance of this well for both
properties to be assured of future use of the well. Public water is not available on
Strong Road near this property.
3. An easement needs to be filed for the septic system servicing the house at 1105
Strong Road to be located on property across the street. This is in addition to (or
should include) the right to access and maintain the existing septic field. There is a
sanitary sewer main in Strong Road that the existing building can connect to as an
alternative.
4. 1 recommend cross travel easements be filed between the property being subdivided
at 1105 Strong Road and the Post Road Stages parcel so they can continue to
access the driveways and parking they now use.
Please call me if you have any questions.
