The site is located on the west side of Ellington Road, approximately 200 LF south of the intersection with Beldon Road. Under present conditions, the eastern portion of the site is an open field with three existing small structures. The Podunk River flows southwest within the site. Wetlands were located within the low lying areas of the site near the Podunk River. The proposed improvements to the site involve the construction of an auxiliary parking lot for the Mill on the River Restaurant. The construction of the proposed parking lot involves the removal of the existing bam, landscaping, and the construction of the proposed storm management system, including a sedimentation structure and biochannel. 48-63 DRAINAGE EASEMENT 48-28 48-64 \. _ DRAINAGE EASEMENT 4 48-55 8-65 CONSERVA ON EASEMENT 48-29 48-66 - 2 . .S'A - ---. The site contains wetlands within the low lying areas near the Podunk River. The Podunk River flows southwest and meanders from the northeastern comer through the center of the site to the southwestern edge of the site. The eastern upland area of the site is primarily open field with a small portion of wooded area in the southeastern corner_ The three existing structures are located within the eastern upland area_ Gravel drives are located within the eastern upland area around the existing structures. The western upland area is primarily wooded area. Sanitary sewer easements run through site connecting Hilton Drive and Ellington Road. An auxiliary parking lot is proposed for the Mill on the River Restaurant within the eastern upland area. The proposed parking lot requires the removal of the existing barn. A stormwater management system is proposed to mitigate the adverse effects of the proposed parking lot. Overland flow will be captured within catchbasins and collected within a sedimentation structure. The sedimentation structure, as well as, the 2' sumps within the catchbasins, will collect sediment to prevent transfer of sediment within the stormwater management system. The sedimentation structure will also aid in the removal of oils from the stormwater_ The flow discharge from the sedimentation structure to a manhole which will help dissipate the velocity and energy of the flow. The discharge will eventually flow into a biochannel where vegetation will aid in the removal of pollutants and sediments. The stormwater will permeate through the stone barrier along the western edge of the vegetative channel and eventually discharge into the Podunk River. The biochannel was designed and sized to treat water during the first flush, or first inch of precipitation. The runoff of storms with precipitation greater than one inch will discharge unrestrained to the Podunk River. Detention of the increased runoff as a result of the increase in impervious coverage is not desirable due to the site's downstream location within the watershed. --------- ... Attn: Karen Isherwood 165 South Satellite Road South Windsor, CT 06074 Re: Appl. #03-67P - Mill on the River, 989 Ellington Road, RR, Residential zone Dear Ms. Isherwood: We regret to inform you that the Inland Wetland/Conservation Commission, at its November 5, 2003, meeting denied your request for an application to create an auxiliary parking lot across the street from the restaurant. RR, Residential zone. The Commission stated their reason for denial was that the applicant failed to properly install and maintain erosion control measures on the site causing undue impact to adjacent wetlands. This was done despite repeated warnings from Town Staff and the Commission. Sincerely, Elizabeth A. Warren, Chairperson EAW/d r CEASE AND DESIST CERTIFIED MAIL AND HAND DELIVERED Helmar Wolf&Arturo Guerra November 14,2003 125 Edwin Road South Windsor, CT 06074 Dear Mr. Wolf and Mr. Guerra: Re: Wetland violation. 970 Ellington Road By this letter you are hereby ordered to cease any further filling and grading activities, install and maintain erosion controls according to the approved plan. You are so ordered based on the following facts: 1. The Inland Wetlands Agency/Conservation Commission has the authority and the responsibility to regulate inland wetlands and watercourses in the Town of South Windsor under sections 22a-36 through 22a-45 of the Connecticut General Statutes (CGS) and the South Windsor Inland Wetland,Watercourses, and Conservation Regulations. 2. Erosion controls on the site have not been properly repaired and maintained on the site. This has caused fill material from the site to migrate to the adjacent wetland. Repeated verbal communications by Town Staff and The Inland Wetland Commission to properly repair the erosion control were not complied with. 3. These activities have occurred in violation of the approved site plan(Section 22a-44, CGS and Section XV of the Inland Wetlands, Watercourses, and Conservation Regulations) and constitute a violation of the law; contrary to public policy set forth in Section 22a-36 CGS. This notice of violation is issued in accordance with Section 22a-44, CGS and Section XV of the South Windsor Inland Wetlands, Watercourses, and Conservation Regulations. I am requiring you cease any further clearing, grading, or excavation unless it is directly related to the installation of erosion controls. A show cause hearing will be held at the Inland Wetland/Conservation Commission meeting of November 19, 2003 to provide you an opportunity to show why this order should not remain in effect. Failure to comply with the provisions of this notice by December 14, 2003 will result in legal action by the Town Attorney. Questions on this matter can be addressed to this office at(860) 644-2511 X229. Sincerely Jeffrey H.
