Per the requirements of the Town of South Windsor Zoning Regulations, you are hereby
being notified that an application is pending before the Planning & Zoning Commission

a proposed zone change from DC (Design Commercial) to GD (Gateway Development)
of the properties_currently designated as 22 Wheeler Road, R002 Smith Street, & R007
Smith Street. This application is TENTATIVELY scheduled to be heard by the Planning

The attached Word document is an updated abutter's list for the zone
change application for the Simon parcels. Changes in ownership for two
lots were brought to our attention, we had inadvertantly left off the
Evergreen Walk parcel from the list, &we added a lot in Manchester that
we noticed is just barely clipped by the 500'offset line. New
notification letters to these 3 property owners are already on their way
out of our office via certified mail. The 4 changes were as follows:
1. On page 8, Map 17, Block 7, property listed as 260 Smith St., is now
owned by HCTSS, LLC, 110 North Wacker Dr., Chicago, IL, 60606.
2. On page 23, Map 18, Block 11, property listed as 395 Smith St., is
now owned by Evergreen Walk, LLC, 1109 Rose Ln., Virginia Beach, VA,
23451.
3. On page 25, we have added Map 27, Block 15, property listed as 151
Buckland Road, owned by Evergreen Walk, LLC, 231 Central Ave., White
Plains, NY, 10606.
4. On page 26,we have added Map 69, Block 1450, Lot 134, property
listed as 134 Croft Drive, Manchester, CT, 06040, owned by Eric M. &
Mary Ann Santos(mailing address same as property address).
With regard to notifying Evergreen Walk, LLC, we have sent one letter to
the Viriginia Beach address, since according to FLB Architecture &
Planning, the White Plains office of Evergreen Walk, LLC no longer
exists.
I have also received a copy of your memo to Geoff Fitzgerald, dated
today, regarding requested changes to the plans we submitted. We are
currently working on those changes&expect to deliver updated plans to
you prior to the Friday August 8th deadline. I will also modify the
plans to show that 395 Smith St. is now being included in the separate
application for zone change that was submitted by Design Professionals,
Inc. This information was conveyed to my by Peter DeMallie of DPI.

3. Downeast may submit to the Commission for approval one or
more applications for approval of Site Development Plans pursuant
to Section VIII of the Zoning Regulations for all areas of the
Project.
4. The Commission acknowledges that Downeast intends to develop
the Project in the Phases and that the timing and sequence of the
Phases is uncertain at this time. Therefore, Downeast may submit
Site Development Plans to the Commission for one or more Phases
of the Project, as Downeast may elect in its sole and absolute
discretion. The approvals granted herein for the various Phases
shall terminate if Downeast has not taken the following actions
within the following time periods:
a. Retail Center (South Windsor) : application for approval
of the Site Development Plan within two years after the date of
the approval of this Stipulation by the Court; commencement of
construction within three years after approval of the Site
Development Plan by the Commission; and completion of
construction within five years after commencement of
construction;
b. Retail/Restaurant (South Windsor) , Village Green, and
Flex-Tech Area: application for approval of the Site Development
Plan within ten years after the date of the approval of this

Stipulation by the Court; commencement of construction within
three years after approval of the Site Development Plan by the
Commission; and completion of construction within five years
after commencement of construction.
5. If submitted to the Commission within the time periods
hereinabove stated, the Commission will approve any Site
Development Plan submitted by Downeast pursuant to Section 5.4.7
and Section VIII of the Zoning Regulations, provided that (i) the
Phase depicted on the particular Site Development Plan conforms
substantially to such area of the Project as shown on the
Modified Project Plans and, to the extent there are modifications
from the Modified Project Plans or additional details not shown
on the Modified Project Plans, the improvements so depicted are
in compliance with (x) the terms hereof, (y) the Site Standards,
and (z) the Town's Zoning Regulations to the extent not varied by
this Stipulation, and (ii) evidence is available that all
necessary utilities are available to service the improvements
contained in the Site Development Plan.
6. The Commission will not require that a public hearing be held
on any Site Development Plan, having concluded in accordance with
Section 8.1.8.4 of the Zoning Regulations, that the specific
circumstances of such applications do not require such action.

We have completed an initial review of the materials submitted for the attached application and offer
the following review comments.
1. It is difficult to see the underlying information through the diagonal pattern used to designate the
zone change area. Can the diagonal pattern be lightened (or a more transparent pattern
substituted)and the background information darkened so that it can be more easily viewed?
2. Please include the total acreage of all properties for which a zone change is sought.
3. Per Section 18.2.3 of the Zoning Regulations, the acreage of that portion of properties that are
partially included in the 500' offset area must be calculated and included on the map, not the
acreage of the entire property including area outside of the 500' offset. (This is necessary in the
event that a petition in opposition to the zone change is submitted and we need to determine
whether the Commission needs a supermajority to approve the application.)
Please make the necessary revisions and submit 8 sets of maps by Friday, August 8. If you have any
