This is a proposed modification on the approved application
for a inhome practice on 9e Nevers Road. The Appl . #97-16P
was approved to see patients during the hours of 12:00 to
2:00 p.m. and 7:00 to 9:00 p.m. and ten ( 10 ) hours on the
weekends.
The proposal which is enclosed has an extension to the back
of the garage. This extension will have two treatment rooms;
one for my wife a licensed massage therapist and one for
myself. There will be an area for hydrotherapy ( jacuzzi ,
sauna ) , and appropriate shower and restroom.
This extension would be the first in South Windsor to have a
therapy center featuring Chiropractic, Massage, and
Hydrotherapy. This type of center is common in West
Hartford, Simbury, and Avon.
The office will be available to see patients by appointments
7 days a week. The hours that the office will be open as to
the approved times mentioned above.
The average number of patients may vary however I would
estimate seeing 3 to 4 patients during the day and the same
number in the evenings_ My wife will see one patient an hour
during the above mentioned times.
Over the weekends - possible 3 to 5 during the course of the
day as by the approved Appl . #97-1¢P ten ( 10) hours allowed
on the weekends_
Enclosed is the application, layout of the entire property,
including the house and the proposed extension. (There are
two proposed drawings for the extension) _

THEROUX MAJOR HOME OCCUPATION PH 4/14/98
1. Request for modification renewal of a major home occupation at 88 Nevers
Road, RR zone. Approval was granted by the Commission in 1997 for a major
home occupation to allow a chiropractor's office within the main structure, and
this approval was expanded in 1998 to include the applicant's wife, Laurie, and
included message therapy and hydrotherapy as a part of the home occupation.
At that time an addition was constructed to accommodate the occupation.
2. A copy of the approval letter outlining the hours/days of operation has been
provided for the Commission. All modifications which were required at that
time have been satisfied.
3. The reasons for requiring PZC approval are to ensure that:
♦ The home occupation is clearly secondary to the use of the building for
dwelling purposes;
♦ The home occupation is compatible with other permitted residential uses in
the residential district;
♦ The residential character of the dwelling and the neighborhood are
preserved; and,
♦ All residents have freedom from excessive noise, excessive traffic,
nuisances, fire hazards, offensive odors and pollutants, and other possible
effects of commercial uses being conducted in residential areas.
4. If this application is approved, the applicant would be required to return to this
Commission upon expiration of the 5-year permit period.

THEROUX MAJOR HOME OCCUPATION PH 4/14/98
1. Request for modification to an existing major home occupation at 88 Nevers
Road, RR zone. There is an existing ranch-style house on the lot. Approval was
granted by the Commission in 1997 for a major home occupation to allow a 144
square-foot chiropractor's office within the main structure.
2. The applicant is now requesting a dification to that existing home occupation
permit to construct an addition of xx square feet behind the garage, and
expand the chiropractor's office to include massage therapy.
3. The Superintendent of Pollution Control has indicated that this proposal may
constitute a small business requiring WPCA approval. The owner must
demonstrate how residential and business-generated refuse and recyclables will
be segregated, and how business-generated refuse and recyclables will be
disposed of. If this application is approved by this Commission, the applicant
should meet with the Superintendent of Pollution Control to review this site. ._
4. The reasons for requiring PZC approval are to ensure that:
♦ The home occupation is clearly secondary to the use of the building for
dwelling purposes;
♦ The home occupation is compatible with other permitted residential uses in
the residential district;
♦ The residential character of the dwelling and the neighborhood are
preserved; and,
♦ All residents have freedom from excessive noise, excessive traffic, F
nuisances, fire hazards, offensive odors and pollutants, and other possible
effects of commercial uses being conducted in residential areas.
v
5. Performance criteria that must be met include: '
♦ Maximum of 25% of the floor area can be used for the occupation; the
proposal does/does not appear to meet this criteria;
♦ Occupation cannot be visible from outside the dwelling unit;
♦ Dwelling must contain the character of a single family dwelling;
<1 k t
j
♦ No entrance or exit may be added solely for the occupation; there is/is no
door proposed solely for the occupation. The building inspector has
indicated that there would be building code issues if this addition for the
home occupation does not have an entrance.
♦ No more than one non-resident employee is allowed;
♦ The occupation cannot create a volume of passenger or commercial traffic
that is inconsistent with the normal level of traffic on the street;
♦ All parking needs must be met on-site; and,
♦ The Commission may require screening of additional parking from the street
and from adjacent residential properties.
6. If this application is approved, the applicant would be required to return to this
Commission upon expiration of the 5-year permit period.
