Memo
To: Peter J.Sangermano,Village Retirement Communities
From: Marcia A. Banach, Director of Planning
CC: Kevin McCann,Chairman, Planning and Zoning Commission
Date: 05/31/02
Re: Village at Buckland Court—Physician's Office
received your letter dated May 16, 2002, regarding your request for approval for the physician's office
to serve the general public as well as the residents of your retirement community. The Planning and
Zoning Commission Chairman, Kevin McCann, and I reviewed the pertinent zoning regulations for
Assisted Living Facilities. Section 4.20.2, Permitted Uses, provides that"The only permitted uses shall
be assisted living, as well as accessory uses which are intended and designed for the maintenance
and/or operation of the Assisted Living Facility and/or the use of its residents." The Chairman has
requested additional information so that the Commission can make a determination that the physician's
office is indeed an accessory use to the assisted living facility. The additional detail should include the
floor plan of the facility, with the physician's office space identified, office hours, amount of time devoted
to residents of the assisted living facility, and any other details that can aid the Commission in
determining that the main purpose of the physician's office is to provide service to the assisted living
facility.
As soon as we receive this additional information, we will schedule the request for a Planning and
Zoning Commission meeting for action.

Dear Ms. Banach:
I am responding to your letter dated April 24, 2002 to the Glaser Financial Group,
regarding the physician's office.
The physician's office is a typical accessory part of an assisted living community. The
office is designed to work within the community and we will typically affiliate with a
local physician to practice out of this office, which is a great convenience to our
residents. We do not lease or charge any fees for the physician's use of this office.
I have enclosed a parking analysis for your review. I did not discount any physician
required spaces even though 50% of our residents are patients of the physician since it
appears we have sufficient amount of parking spaces.
I appreciate your cooperation in this matter. Please call me at(401) 949-4901 x 100 if
you need any further information.
Sincerely,

Re: Zoning Amendment Application for 432 Buckland Road
Dear Marcia:
We are writing to express our support for the proposed ar-endment to Section
4.20.2 of the South Windsor Zoning Regulations submitted by the owners of Village
at Buckland Court ("the Village").
We presently run the South Windsor Family Practice ("Family Practice"), a medical
practice located at the Village. We affiliated with the Village, an assisted living
facility, last fall. The Village was seeking to establish an on-site primary care
physician practice for its residents. The Family Practice was seeking to relocate its
practice to South Windsor and build a practice in the South Windsor area.
Therefore, the Family Practice and the Village entered into an agreement last fall for
the Family Practice to locate at the Village and offer medical services to its
residents.
Currently, the majority of patient visits to the Family Practice are from Village
residents. However, our plan has always been to grow the Family Practice to
service, additionally, South Windsor area residents who are not residing at the
Village. The proposed Amendment will allow us to continue to offer to medical
services to Village residents while growing the practice to also include non-Village
residents. The proposed Amendment is necessary to allow the Family Practice
stability to practice in South Windsor area and to continue to offer medical services
to Village residents.
For these reasons, we ask you for your support in approving the amendments.
Please contact us if you have any questions.
Sincerely,
Michael J. Clements, MD Tracey M. Clements

Appl#02-33P,Village at Buckland Court Zoning Amendment
Public Hearing 7-23-02
Planning Department Report
1. Request for amendment to Section 4.20 of the zoning regulations to allow medical services
that serve the public in addition to the residents of the assisted living facility. The current
regulations allow accessory uses intended and designed for the maintenance and/or operation
of the facility and/or the use of its residents. Since assisted living facilities are permitted in
both residential and commercial zones, the proposed amendment specifies that medical
services would be available to the public only in assisted living facilities located in
commercial zones.
2. All of our existing commercial zones allow medical offices as a permitted use, which means
that if an existing Assisted Living Facility located in a commercial zone presented a site plan
application for an additional building for medical offices, that would be a permitted use. Thus
the inclusion of medical offices in an Assisted Living Facility is consistent with underlying
zoning.
3. The Town Plan of Conservation and Development does not include any information that
assists in determining the consistency of this amendment with the Plan.
4. The main impact and consideration of this amendment would be for on-site parking. If this
amendment is adopted, an assisted living facility would need to demonstrate adequate on-site
parking in compliance with the existing parking requirements for medical offices.
5. CRCOG review: ****READ REPORT****
6. Effective June 3, the Commission now has express statutory authority to modify zone change
and zoning amendment applications, thus if the Commission has any modifications that
would make a zoning amendment more acceptable, you may apply those modifications.
7. If this zoning amendment is approved, staff have no requested modifications.
