Lipe,Assistant Director of Planning CC: Kevin McCann,Chair, Planning and Zoning Commission Date: 09/03/02 Re: Appl#02-55P, Natitus Major Home Occupation Please be advised that the application submitted does not include sufficient information to allow adequate staff review or Commission action. The performance criteria that must be addressed includes criteria referenced under section 4.8.3 and 4.8.2 (all major home occupation must meet the criteria of a minor home occupation as well). To follow up on our conversation of earlier today, we need information addressing how this criteria is being met (i.e. a narrative statement describing the business, number of non-resident employees, vehicle/equipment storage—please note only one business vehicle is allowed; outdoor storage/parking of the business vehicle is prohibited, see section 4.8.2 d,etc.) The lack of adequate information could delay the public hearing(currently scheduled for September 24) and/or action on this application, or could result in denial of the application. Doolittle, P.E., Town Engineer Date: 10/22/02 Yo RE: App 02-55P, Major Home Occupation Application I have reviewed the Site Plan for a major home occupation at 586 Foster Street, and I have the following comments: 1. The gravel drive leading to the rear of this lot does not have a curb cut. This drive extends beyond the property boundaries of this parcel onto the neighboring Lot 25. This drive is less than 50 feet from the bituminous driveway to the, house and there is n t enough frontage on this lot to separate two driveways by at least 50 feet, in the way the driveys and house are presently configured. Therefore the gravel driveway to the rear of this lot does not conform to the Town Public Improvement Specifications. 2. No permanent structures, trees, shrubs or debris is to be located, planted or stored within the Drainage Easement to the Town of South Windsor on the north side of the lot. Please call me (x 245) if you have any questions. Natitus Major Home Occupation- Public Hearing 9/24/02 1. This is an application for a 5-year major home to run landscaping business, from property located at 586 Foster Street, AA-30 zone. a. The applicant has submitted a narrative defining the scope of the business. He has indicated that there are several trucks and mowers on-site used in the business. The narrative indicates that the only activity on-site is the departure and arrival of the trucks at the beginning and end of the day. 3. The reasons for requiring PZC approval are to ensure that: • the home occupation is clearly secondary to the use of the building for dwelling purposes; • the home occupation is compatible with other permitted residential uses in the residential district; • the residential character of the dwelling and the neighborhood are preserved, and; • all residents have freedom from excessive noise, excessive traffic, nuisances, fire hazards offensive odors and pollutants, and other possible effects of commercial uses being conducted in residential areas. 3. Performance criteria that must be met include: • Maximum of 25% of the floor area can be used for the occupation; • occupation cannot be visible from outside the dwelling unit; • dwelling must contain the character of a single family dwelling; • no entrance or exit may be added solely for the occupation; • no more than one non-resident employee allowed; • the occupation cannot create a volume of passenger or commercial traffic that is inconsistent with the normal level of traffic on the street; • -all parking needs must be met on-site; and • the Commission may require screening of additional parking from the street and from adjacent residential properties. 4. There are several questions that we have about this application and whether it meets the criteria for a home occupation. • Is there an office associated with the business? If so, where is it located and does it meet the maximum 25% of the floor area criteria? s • How many people associated with the business live on site and how many are employees that come on to the site? (The regulations provide for one non-resident employee.) • What is the exact number of vehicles that come and go from the site on a daily basis? (The regulations allow for one business-associated van/pick up truck; outdoor storage/parking of the vehicle is prohibited. The regulation also states that the home occupation cannot create a volume of passenger or commercial traffic that is inconsistent with the normal level of traffic on the street on which the dwelling is located.) • Are these vehicles stored outside as shown in the pictures or are they kept inside the sheds? Also, a site visit revealed there is a significant amount of other types of equipment being stored on site including snow plows, backhoes, several barrels, unregistered vehicles. s. The applicant is allowed a two square foot sign, however is no signage is proposed at this time. 6. If this application is approved, the applicant will complete a home occupation form, which contains acknowledgment that the applicant will abide by criteria contained in the zoning regulations. The applicant would also be required to return to this Commission upon expiration of the 5-year permit period. Also, the Commission might consider adding as approval conditions limitations on number of days and hours of operation, or number of customers per day, in order to ensure that the intent of the home occupation regulations is.adhered to. Staff would recommend that the hearing be held open to allow time for the Commission to visit the site before taking action. ~ 71own 0 . 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CT 06074 ~°sOR.co TELEPHONE (860) 644-2511 May 13, 2002 NOTICE OF VIOLATION Certified Mail Charles Natitus 7001 2 510 0003 19 3 7 - 0 0 9 6 586 Foster Street South Windsor, CT 06074 LOCATION: 586 Foster Street (Zoned AA-30) Dear Mr. Natitus: It appears, as a result of a field review, that a landscaping business is being conducted from the premises without any approvals. The reason for denial was because the Commission felt the application as submitted and presented did not meet the criteria outlined in the major home occupation regulations.
