RE: WETLAND DELINEATION
CLARK STREET - PLEASANT VALLEY ROAD
SOUTH WINDSOR, CT
Dear Jerry:
Enclosed is a description of the wetlands for the above-
referenced project. Additionally, I have included the Army Corps
Data Sheets for the Clark Street site. I have reviewed the plans
prepared by your office and have found the representation of the
field delineated wetlands to be substantially correct. A
description of the wetlands is as follows.
CLARK STREET
The inland wetland boundaries in the area of the Clark
Street bridge were field delineated on January 16, 1998. Flags
#1 through #8 denote the wetland limits on the west side of the
road and flags #9 through #16 denote the eastern wetlands. The
wetlands consist of Whaples Brook and associated poorly drained
soils. The upland areas to the south of Whaples Brook are
comprised of a mature mixed hardwood forest with Sugar Maple and
a variety of Oaks being dominant. The southern bank of the brook
is very steep and the brook generally flows along the toe of
slope. The brook and associated wetland soils are within a steep
sided channel. On the north side of the brook, poorly drained
soils of the Rippowam Series and very poorly drained soils of the
Saco Series were noted. These soils are classified as alluvial
soils and overlay deposits of sand and gravel. The wetlands
along the north side of the brook are dominated by shrub and
herbaceous species that include, but are not limited to
Elderberry, Silky Dogwood and a variety of brambles that include
Raspberry, Blackberry and Multiflora Rose.
The uplands to the northwest of the brook include abandoned
field growth dominated by Goldenrod species. The upland area is
below an existing transmission power line and is occasionally
mowed. The upland areas to the northeast of the wetland consist
of an existing agricultural field.
The upland soils to the south and north of the wetlands were
identified as well drained soils of the Agawam Series.

PAGE TWO
MR. JERRY IAZZETTA
JULY 6, 1998
The wetland boundaries for both' the north and south side are
generally well defined and follow the top of the bank for the
channel.
PLEASANT VALLEY ROAD
The only regulated wetlands within the project area were
delineated by flags #17 through #22. This regulated area was
defined based on the watercourse definition of wetlands. The
area consists of a man-made rip-rap lined drainage channel. The
area outside of the defined channel is maintained as turf by the
condominium association. The flow within the channel is
supported by ground water during high ground water periods. Most
of the flow within the watercourse is supported by stormwater
runoff.
If you have any questions, or require additional
information, please contact me at 742-5868.
Very truly yours,

Alternatives Assessment
Pleasant Valley Rd and Clark St Reconstruction
97-811 ConnDOT 132-125
The pipe culvert and storm drainage replacement has been designed to provide the least
environmentally damaging alternative for fulfilling the basic objectives for this work.
The existing hydraulic facility which carries Whaples Brook (a.k.a. Quarry Brook) ,under Clark Street
consists of twin 1300mm x 760mm (42"X30") C.C.M. pipe culverts.
In order to meet ConnDOT Highway Design requirements, it is necessary to raise the grade of Clark
Street in this area 1.7m (5.6').
Due to this proposed work, the existing culverts are corregated metal and DOT requires that the
culvert be able to pass 100yr storm event without overtopping the road a replacement hydraulic
structure will be required.
A hydraulic analysis for the crossing has been performed in order to determine the proper sizing of
the proposed hydraulic structure to accommodate flows following ConnDOT standards and CTDEP
requirements.
Reconstruction of roadway storm drainage system requires that existing storm drainage outlet pipe
to be removed and proposed roadway storm drainage system will outlet at culvert endwall.
To lessen the impacts to the wetland areas
• The roadway berm (shoulder) has been reduced from the standard 3.05m (1Oft) to 1.22m (4ft)
on each side therefore shortening the length of the culverts and disturbance by 3.66m (12ft).
• In addition the side slopes of the roadway have been increased from a 4:1 to a 2:1 grade to
lessen to impacts of the wetland area and to minimize fill placed within wetland areas.
• A new hydraulic analysis was performed and the minimum effective size culvert was selected.
The culvert size was reduces from twin 3'x8' boxes to twin 3'x6' boxes reducing the width of
impact by 4'.
• Temporary work areas have been reduced to lessen impacts to wetlands and buffer areas.
• Last 2 catch basins built with 4' sumps. Do to the presence of ledge, the placement of a
sedimentation structure at this point was not chosen.
The project design has incorporated recommendations made by Brain Murphy, Senior Fisheries
Biologist in a letter dated May 8, 2000.
• Currently there is an 8" drop at the outlet of the culverts allowing for fish passage only during
high water events.
1. The twin 910mm x 1829mm concrete box is to be installed 0.305m(12") below stream grade
to provide for upstream fish passage.
2. The surface layer of natural streambed substrates shall be scraped from existing streambed. A
geotextile fabric (separation) shall be laid. A 0.150m (6") layer of granular fill and a 0.305m
(12") layer of modified rip-rap shall be placed. Then a layer of natural streambed substrates
150-300mm (6"-12") thick shall be placed on top of rip-rap as a streambed armament.
3. All unconfined instream work shall be restricted to the period from June 1 to September 30,
inclusive for the following reasons:
- timeframe will serve to protect the spawning, egg incubation and fry development of resident
fishes
- timeframe does not interfere with seasonal migratory behaviors
- timeframe coincides with historic low rainfall levels in Connecticut a period in which instream
construction activities such as dewatering, excavation, trenching and cofferdam placement are
most effective.
A temporary drainage diversion, consisting of a pipe culvert with rip rap swales and stone
cofferdams will be constructed prior to the existing culvert removals and shall remain in place until
the proposed culverts, endwalls, riprap, and substates are in place and can accept the flow from the
watercourse. The temporary drainage and swales shall be removed and all disturbed areas regraded
and established.

As part of the road reconstruction project the Town is planning to replace the

Clark Street between Pleasant Valley Road and Margaret Drive. This
construction will require work within areas classified as wetlands.
The Town is looking to obtain approval from the Inland Wetlands/Watercourse

Re: Application 0148P
420 John Fitch Boulevard
Dear Commission members:
We are extremely concerned about the captioned application for a recycling
processing plant near the intersection of Chapel Road and John Fitch Boulevard.
There are a number of reasons why this is the wrong use for that site, but we will
deal solely with the afkcts on the inland wetlands and nearby groundwater.
The site is just 400 yards away from the Podunk River on two sides, to the north
and the west. There was testimony at the December 19,2001 hearing that the site was
over an area with considerable clay, and that groundwater would flow over that clay.
Presumably, any solvents or other pollutants from the site would flow toward the Podunk
River, and also through the groundwater toward the Chapel Road neighborhood, where
the homes have individual wells. From comments at the hearing, it also appears that
homes on Park View Drive also have individual wells. In addition, sediment from
crushed materials flowing away from the site would likely silt the Podunk River. As you
are probably aware, the Connecticut River Watershed Council and the Department of
Environmental Protection are working on building a fish ladder at the Mill on the River.
It would be unfortunate if their efforts were undermined by pollution and siltation of the
Podunk River.
We are concerned about some comments at the December 19 hearing that seemed
to take a crimped view of your agency's authority. In fact, your agency has broad powers
to protect the wetlands within the town Inland Wetland/Watercourse and Conservation
Regulations, and the Connecticut Supreme Court has repeatedly found that the state
Inland Wetlands and Watercourses Act gives municipal wetlands agencies wide
discretion to exercise similarly`broad powers over activities affecting the wetlands and
water courses, whether or not those activities are actually in the wetlands.
L
In the South Windsor wetland regulations, "Regulated Activity" is defined at
section 2.1(t)) not simply to be limited to the actual wetlands and the 80-foot buffer. That
definition also provides, "Because certain activities have an adverse impact on wetlands,
activities outside these distances are regulated if the Agency determines they are likely to
cause or have the potential to cause adverse impact on a regulated area."
The regulations also require the agency at section 11.2 to take into account "(A)
The environmental impact of the proposed regulated activity on wetlands or
watercourses,"and"(F) Impacts of the proposed regulated activity on wetlands or
watercourse outside the area for which the activity is proposed and future activities
associated with or reasonably related to, the proposed regulated activity which are made
inevitable by the proposed regulated activity and which may have an impact on wetlands
or watercourses."
As recently as a decision released September 25, 2001, the Connecticut Supreme
Court in Queach Corp. v. Inland Wetlands Commission of Branford 1 held,
Section 22a-42a(o [of the Connecticut General Statutes] provides that a wetlands
agency may regulate activities outside of the wetlands areas, "[I]f a municipal
wetlands agency regulates activities within areas around wetlands or
watercourses"and "those activities . . . are likely to impact or affect wetlands or
watercourses."This statutory language effectively codifies our previous statement
in the seminal case of Aaron v. Conservation CommissioW . . . wherein we
emphasized that "[a]n examination of the act reveals that one of its, major
considerations is the environmental impact of proposed activity on wetlands and
water courses, which may, in some instances, come from outside the physical
boundaries of a wetland or water course."In Aaron, we held that activity that
occurs in nonwetland areas, but that affects wetlands areas, falls with the scope of
regulated activity.
The court underscored the broad flexibility inland wetlands agencies have. "The
[state Inland Wetlands] act allows a commission enough flexibility to adapt `to infinitely
variable conditions for the effectuation of the purposes of these statutes."3
The court in the Aaron case quoted a treatise on Connecticut land use law in
noting, "Obviously, one can `cause' pollution(or many of the other regulated activities)
of a Nvetlands by action on parcels adjacent to and perhaps even remote from designated
wetlands.'A
In addition to the Queach Coro. and Aaron decisions, municipal wetland
agencies' authority to regulate activity that occurs in nonwetland areas. but which affects

wetlands. has also been upheld by the Connecticut Supreme Court in Mario v. Town of
Fairfield` and CiofToletti v. Planning & Zonin Commission ofthe Town ofRid efieid`'.
It is apparent that the captioned application will involve activities taking place in
the designated buffer area -- as well as in a nonwetland area -- that will have a very
serious affect on adjacent wetlands, on the Podunk River and on neighboring around
waters. The river is likely to be affected by silt and pollutants. and the groundwater is
likely to he affected by spilled pollutants flowing through the groundwater over the
impermeable underlying laver of clay, and into neighboring wells.
The agency clearly has the authority to prevent this impact by denying the
application. We hope the agency accepts the responsibility that goes with that authority.
Very truly yours,
A
