Re: Application of East Hartford Sand& Gravel,Inc. to Amend Special Exception
1440 John Fitch Boulevard
Dear Members of the Planning&Zoning Commission:
Enclosed please find the application of East Hartford Sand& Gravel("EHSG")to amend the Special
Exception granted by this Commission on November 28, 2000. The Special Exception allows EHSG to sell
building materials at 1440 John Fitch Boulevard,but only materials mined from the earth on site. This new
application seeks to delete this condition as explained below.
The circumstances leading up to this application are as follows. On or about February 15,2000,this
Commission granted EHSG's application to renew its Special Permit to excavate sand from its property
which was located in a residential zone. EHSG's property abutted the property of Redland Brick, Inc.
("Redland"),which is located in the industrial zone. EHSG had been excavating sand from its property for
many years and selling it on a wholesale basis from the site. Over the years,EHSG had also been selling
from its property on a wholesale basis a variety of other types of landscaping materials which were not
excavated on site, including topsoil,various types of sands and stones,and gravel. In addition,Redland,
instead of discarding the bricks which it rejected due to damage or imperfections,sold them to EHSG which
then crushed and screened the bricks and sole them on a wholesale basis as landscaping materials.
During the application process for EHSG's renewed excavation permit,the town staff and ultimately
this Commission informed EHSG that the sale of landscaping materials not excavated on site was allowed
only in the industrial zone and not in the residential zone. EHSG advised the Commission during the public
hearing that it would negotiate an arrangement with Redland to lease a portion of Redland's property from
which to sell the various landscaping materials in question,thereby bringing its operation into compliance
with the zoning regulations. The Commission indicated during the hearing that such an arrangement would
be looked upon with favor.
As a consequence,EHSG entered into negotiations with Redland. An agreement was reached which
provided (1)that EHSG convey a portion of its property to Redland,which Redland will use to excavate clay
to manufacture its bricks; (2)that EHSG has the right to excavate the sand from the property referred to in

(1)above; and(3)that EHSG has the right to lease some of Redlands property in the Industrial Zone to
stockpile and sell the landscaping materials described above. After this agreement was finalized and
EHSG's property conveyed to Redland,EHSG, on or about October 16, 2000, applied for a Special
Exception to sell on the Redland site in the Industrial Zone the same landscaping materials it had been selling
on the abutting parcel for years. A public hearing on this application was held by the Commission on
i n no concerns or issues
November 21 2000. There was no opposition from an member of the public and pp Y P
raised by the town staff. On November 28, 2000,the Commission voted to grant the Special Exception with
the condition that ilhSV can Sell only the sand it excavates iroin the slie. EHSG now asks that this condition
be eliminated,because it prohibits EHSG from selling the very materials which prompted its application in
the first place.
The condition imposed by the Commission is unwarranted for the following reasons. EHSG seeks to
sell a variety of landscaping materials. Those materials consist of topsoil,various types of sands and stone,
crushed brick,mulch and gravel. These landscaping materials will be stockpiled on site and sold on a
wholesale basis primarily to contractors. The materials are loaded by payloader into trucks which will utilize
the same access road used by the Redland trucks. Since there are no retail sales,the only traffic to and from
_ the EHSG site will be truck traffic. The EHSG operation will be operated in exactly the same manner as it
.; has been operating for the past several years from its former abutting property,using the same access road
and selling the=same materials on a wholesale basis.
The sale of the landscaping materials in question is a permitted use by Special Exception in the
Industrial Zone pursuant to Section 6.1.3.2 of the Zoning Regulations. Given the wholesale nature of the
operation and the location of the proposed business far from any residential on property used for the
excavation of clay and sand and the manufacture of bricks,EHSG's application easily satisfies the criteria
for a Special Exception set forth in Section 6.1.3 of the Regulations. There are no adverse traffic impacts,no
negative impacts on property values,the land is well-suited for the proposed use,there will be no adverse
environmental impacts,the infrastructure to support the proposed use is adequate,and the proposed use is
compatible with the Plan of Development,the surrounding area and the needs of the community. Since there
are no concerns which justify the limitation imposed-by this Commission,EHSG's application to remove the
limitation should be granted.
Thank you for your consideration of this Application.

East Hartford Sand & Gravel PH 5/8/01
1. Request to continue excavation of sand and gravel in the remaining phases at
property located behind K-F Brick. The site has frontage on Strong Road and is
about 63 acres; however, sand and gravel excavation is currently occurring on
about 9 acres on the western part of the site. The latest approvals were granted
by this Commission in 2001. The previous permits included seven phases of
gravel excavation; the applicant indicated in the past that he would excavate
about 20,000 cubic yards of material per year, and anticipated about a 10-year
timeframe for excavation of phases 4-7. (It has been about 6 1/2 years since
applicant began excavating Phase 4.) There has been very little activity
occurring on-site since the last approval granted.
2. Access to the site will continue to be from Route 5, via Brickyard Road, as it
has been in the past.
There are regulated wetlands on the site and the current approval expires in
January 19, 2005. The Army Corp and DEP are also reviewing the wetlands
disturbances on the site and have not issued a permit to date.
4. We are currently holding two passbook bonds on this project, for a total amount
of$25,000, to ensure erosion and sediment control as well as stabilization after
each phase is excavated. A bond in the amount of$91,000 was required for the
reparation of the destroyed wetland areas.
5. Proposed excavation will result in maximum cuts of 12-14 feet, slopes at 1:3,
and some cuts up to 4-5 feet into the groundwater table.
6. Section 14 of the zoning regulations provides guidelines for the Commission for
the approval of sand and gravel operations, including the effect of such removal
on surrounding property and the future usefulness of the premises when the
operation is completed. Also, according to the provisions of Section 14, such
permits shall be issued for a period not exceeding two years. The regulations
also allow PZC to grant unspecified extensions of time or modifications to the
scope of work originally approved..
. e pplicant is also applying to modify the Special Exception to Section
6.1.3.2 for approval for the storage and sales of landscaping and building
materials, on property located at 1490 John Fitch Boulevard (the Redland Brick
site), I zone. East Hartford Sand and Gravel leases land from Redland Brick for
this operation.
8. The Commission may recall with the most recent approval of the Sand and
Gravel operation the conditions placed on the approval were: The four corners
of the lease area must be delineated in the field; and this approval is for: sand,
gravel, soil and other unprocessed materials mined from the earth. These
materials must be mined on site.
9.`, With this request, the applicant is seeking permission to sell topsoil, various
` types of sands and stones; crushed brick, mulch and gravel. The materials are
n sold on a wholesale basis. The only traffic will be truck traffic.
. 10.Special Exception criteria include:
• The goals and objectives of the Plan of Development are met
• Adverse traffic impacts are not created;
• Negative impacts on property values are not created;
• The land is physically suited for the proposed use;
• Adverse environmental impacts are not created;
• There is a balance between neighborhood acceptance and community needs;
• Present and proposed utilities, streets, drainage systems, and other
improvements have adequate capacity to accommodate the proposed use;
• Historic factors are adequately protected; and
• The overall physical appearance of the proposed development is compatible
with surrounding development and the Commission's goals for the
neighborhood/corridor.
If approved, the Planning Department has no other requested approval
modifications.
