(Unfortunately, due to a prior commitment, I am unable to be there.) I am not alone in my feelings but people who live on Countryview are hesitant to come forward due to the aggressive manner Mr. and Mrs. Sirois have demonstrated since moving to South Windsor. This addition, an in-law apartment, is, to my knowledge, the first one in our neighborhood. Therefore, it sets the tone for any future development of that kind. Unfortunately, this addition is very unsightly and I believe it will affect our property values in a detrimental manner. The entire addition is visible from the street, not discretely added as a separate apartment, as other in-law apartments in town have been placed. There are two separate po rches, separated by a single car garage, giving the appearance earance of a two- family familY house. One of the porches, the new one, has, since it was built, housed at various times, garbage cans, lumber, metal pails, etc. This storage area is unsightly. There is no-separate entrance to this in-law apartment. In looking at the plans provided to the Town, this addition appears as an empty 27' x 15' box so it is hard to know what has been placed in that space. Therefore, I am unsure how your Commission can determine whether or not this addition meets our Town's planning and zoning regulations. I would request that the Planning and Zoning Commission go out to this address and view this already-existing proposed addition to insure it complies with the zoning requirements of our Town. I know your Commission has worked long and hard to insure that our Town remains a desirable place to live by requiring all residents to adhere to certain guidelines. Before approving this addition simply because it has already been built, without approval, I implore you to insure that it meets the standards of our Town's Code. Thank you for your consideration. Very truly yours, 04$ 9r Anita E. Cappalla 25 Cheshire Drive South Windsor, CT 06074 Sikois In-Law Apartment PH 10/23/01 1. Request for a permit for an in-law apartment at 58 CountryView Drive, A-30 zone. 2. The PZC in-law apartment regulation has specific criteria for the unit; and provides for a 5-year permit period. These criteria include: ♦ The in-law apartment cannot be larger than 900 sq ft or 40% of the gfa (whichever is smaller) ♦ the entire structure must maintain the appearance of a single family dwelling; ♦ off street parking for three vehicles must be accommodated; ♦ adequate water and sewage disposal must be provided; and ♦ the owner of the dwelling units must occupy either the in-law apartment or the main dwelling unit The Commission may waive one or more of the provisions above (except the requirement that an owner live in the apartment or house) after determining: ♦ There will be minimum adverse impact on existing uses in the area; ♦ Surrounding property values will be conserved and the character of the neighborhood will not be unduly disrupted; ♦ Due consideration to preservation of historic factors has been demonstrated. 3. This in-law apartment will be incorporated into a 15 X 27 foot addition onto the side of their house. The applicant has provided a floor plan and an elevation of with the original building permit application, however we did not receive a layout of the proposed apartment. We also cannot verify that it meets the size limitation. The commission may want to hold open the public hearing for the additional information to be submitted. If this application is approved, the Commission may grant approval for up to five years. The applicant will be asked via letter to reaffirm ownership of the property every two years. At the end of the permit period, if the family situation has not changed, the applicant may request renewal by staff. Sirois In-Law Apartment PH 11/13/01 1.
