The undersigned hereby applies for the regulated activities listed in paragraph H
above, for a Inland Wetlands, Watercourses and Conservation permit for the property

or in the case of anticipated activity, binding. A knowing failure of the applicant or
any of her/his agents to provide correct information, or performance exceeding the
levels of activity anticipated, shall be sufficient grounds for revocation of any permit
under these regulations.
4. By making this application, the applicant gives permission to the Inland Wetlands,
Watercourses and Conservation Commission members and/or its representative to
enter the portions of the premises which are subject of the application for the
purpose of inspection and investigation and otherwise evaluating the merits of the
application both before after a final decisi rl h been issued.

ATTACHMENT H
The purpose of this application combined with Redland Brick Inc.'s (RBI)
application to the Town of South Windsor Planning and Zoning Commission for
an Earth Removal Permit is to allow RBI to increase their mining acreage. In the
spring of 2000, RBI's mining activity was severely limited as a result of the
extremely wet weather and RBI was almost forced to shut down their brick
manufacturing plant because a lack of stockpiled material. In addition, RBI plans
to implement a major capital improvement project in order to keep up with market
demands. The completion of this project will allow RBI increase production
capacity to 60,000,000 brick annually, an increase of over ten percent. RBI will
only proceed with this project if raw material reserve issues are resolved.
The geology of the area includes a deposit of sand up to ten feet thick on top of a
deposit of clay. Most of the sand has been removed, by East Hartford Sand and
Gravel, under separate permitting. In the spring of 2000, RBI had core drilling
performed and determined the clay deposit is over 100 feet deep. The addition
of this acreage to RBI's mining operation will add over 16 years of clay reserves
but it will be mined in addition to the existing quarry over many additional years.
RBI's mining operation includes removing any remaining sand or overburden and
either stockpiling elsewhere on RBI's property or using for reclamation. The clay
is loosened with a farm type disk, allowed to air dry, pushed to a side of the
quarry, loaded into trucks, and hauled either to an enclosed storage shed or a
stockpile outside. By opening up additional acreage, RBI will have additional
drying time and will minimize the effects of wet weather on the mining operation.
This permit will include that property, owned by RBI, and formerly owned by Enet
Silvestri, and permitted by East Hartford Sand and Gravel (EHSG), and known as
Phase 3 (88,417 sq. ft. or 2.03 acres) and Phase 4 (78,750 sq. ft. or 1.8 acres).
This activity is part of the long range plans of RBI as presented to the Town of
South Windsor, Inland Wetlands Commission in 1999.
Ms. Enet Silvestri recently transferred the deed to her property, known as phases
1, 2, 3, 4, 6, and 7 to RBI. RBI has leased a portion of their property, identified
on the attached maps, to EHSG and will allow EHSG to operate their business
subject to approval of the appropriate permits.
There are two small areas each approximately 225 square feet, for a total of .01
acres to the north side of phase 4 which has been identified as a wetland area.
Prior to mining any part of phase 3 or 4, RBI will construct an earthen berm on
the south side of the wetland area outside of the 40 foot setback area, as
suggested by Jeff Folger. The berm will be planted with a seed mixture
suggested by Jeff and covered with hay mulch. This will prevent any
encroachment into and any degradation of the wetland area by any mining
activity. There will be no alteration of any streams by this activity.

Re: Inland Wetlands and Earth Removal Application
Dear Jeff:
Enclosed are our applications to the Inland Wetland Commission and the
Planning and Zoning Commission, with copies. The plans are being completed
at present and will be submitted next week. We would like to obtain the
appropriate permits in order to be able to mine clay from that section of property
known as Phases 3 and 4.
Our permit for Phase 1 and 2 expires next year. Assuming we get a two year
permit from this application, we will have a permit expiring every year. In the
interest of saving time and engineering costs, we would like to combine these
permits with our existing permits for Phases 1 and 2, so that the expiration dates
are all the same. Therefore, we will have a permit for Phases 1-4 which expires
in 2002.
We would like these applications to be received by the Inland Wetland
Commission and the Planning and Zoning Commission as soon as possible and
then scheduled for hearings. Per our discussion this morning, I understand that
the schedule for hearings is quickly filling up. I will be unavailable from October
18-24 due to prior commitments, so I would prefer that we be heard prior to then,
if at all possible.
I would like to thank you for scheduling time to review our applications with me
on August 21, 2000. If you notice any errors in our application prior to our
meeting, please call me and I will try to make the changes before our meeting in
order to avoid delaying our schedule.

Re: Addendum to Applications
Dear Jeff:
After meeting with you last week and also talking with counsel there are several
comments I would like to add to our application packet.
1. 1 was somewhat confused over our application to the Inland Wetlands
Commission. While I was calling this application a Wetland application, it is
now clear that we are actually asking for a sediment and erosion control
plan to be approved.
Since our continued operation will not have any effect on the tiny sections of
wetlands in phase 4, we believe the sediment and erosion control plan can be
approved administratively.
2. Phases 1, 2, 3, 4, 6, and 7 will soon be conveyed over to Redland Brick Inc.
by Enet Silvestri. In our application, we listed the current map and lot
numbers as 86 and 2 respectively, and the zoning as I, RR. When the
property is conveyed, which will occur before the hearings, the map and
parcel numbers will be 97, 7 and we should note the zone is completely RR.
After the public hearing, we will change these numbers on the final map
submitted.

RR & I zone. This approval is subject to the following conditions:
1. One blueprint copy of the entire set of plans and this letter
reproduced thereon, must be submitted to this Commission. This
must be completed within 65 days of approval prior to any
construction activity on the site. Plans submitted to Planning &
Zoning Commission shall be considered having met this requirement.
2. The application shall indemnify and hold harmless the Town of South
Windsor against any liability, which might result from the proposed
operation or use.
3. The permit is valid for five years and shall expire on November 1,
2005. -It is the landowner(s)/applicant(s) responsibility to track
expiration dates and notify the Commission of a renewal request at
least 65 days prior to expiration.
